If what I have heard is true, your lawyers made it late.
The Visa bulletin came out almost 4 weeks back. You should have hurried the application in. Check with your lawyer to see is there any special ways to get your app in.
What i will say is hurry it now at least.
Good luck buddy
its common to have delayed approvals for primary and spouse, i wont panic unless its 2-3 months more, however as someone stated you shoudl check with lawyer to expedite if has been delayed
i have seen cases of many folks where spouse got it first and then the primary and vice versa, thats why i called out.

I know it is not correct way. But those who are waiting for long time worth to try. Anyhow most of the persons are eligible to file 485. Few thousand substitutions will not make much difference.
Your suggestion surprises me.

Your EB2 application will be new application so your EAD won't become invalid.
if someone with a PD of before July 2007 that is with EAD, ports to EB 2, will they lose their EAD card/status??

It is so sad that H1Bs are exploited by those "consulting" companies (which essentially are "human trafficing companies" like doing "slave trade") while Americans (at least some Americans) hate H1Bs. We are like modern "slaves" that nobody cares about.

I mailed my passport for renewal to CGI Houston a week before it expired and it came back with a new passport in 2 weeks. I was able to talk to two people. Its very hard to get them on the phone....but yet I kept trying.
The address on the form is kind of confusing. They do not tell in the on-line application that they are expecting an Indian address and a US address unless you print it and see for yourself.

Yes you are absolutely true..... We must have the luck factor also...
As in my case, my PD, RD, ND and BD (BD aka Birth Day also :) ) all are well with in the current processing time frame and still waiting for the mercy of Lord USCIS.
I am praying for those unlucky folks like me, who are still waiting in the queue, to get approvals before the available visas get exhaust.
B+ve
Yes, I just saw your profile. Your ND is early August, and PD is also quite high. You should have got approval now. Wish you very best. I hope you didn't make any job changes, or anything which flags a re-review.
BTW, I was in the same situation last year. When I saw so many of 2005 and 2006 PDs getting GC's I thought I was among the very few left out, but now I notice that there were so many of them. I got the magic emails in Dec 08 when they were looking at my AP renewal. Seems for some reason that triggered it. Perhaps GC was approved in Aug/Sep 08 but no one entered it in the system until Dec 08.

Just checked again and the last 2 approvals are
PD 3-15-05 RD 6-12-07
PD 10-21-04 RD 6-29-07
So they are past the June 8th date, looks like they are still processing pre PERM applications though.
PS pappu, I updated what I know exactly (PD RD of I 485), my lawyer has the rest.
They are definitely approving beyond June 8th but there are many people with RD's from May 07 and before and much older priority dates still waiting. Do not read too much into the approvals you see the approvals are somewhat random to say the least.
EB3 ROW, PD November 2002, RD May 2007. Still not approved. Getting impatient seeing people getting approvals with later priority dates and receipt dates. Think my application has got lost in a corner somewhere.

For me the agony is endless. My deshi employer did not provide me the EVL in time though I was able to file in JUNE. They gave it to me after JULY 20th when I stopped sending timesheets.
I am personally not a big supporter of elimination of country quota. Dont get me wrong. I fully share and understand the endless pain is being gone through by EB3 Indians/Chinese community. Increasing # of EB visa will ease some of their pain.
For an example there are 1000 IT processionals from India wants to come to US with H1/L1/B1. There are ample companies (say 50) owned by Indian and those 1000 IT professionals have enough opportunities to come to US.
On the other hand, for an example, from Ukraine, there are 100 IT professionals are trying to migrate to US with H1/L1/B1 but there are few to none companies (say 1 ) owned by Ukrainians and those 100 IT professionals have few to none opportunity to come to US.
My point is, there are more IT Indians in US do not validate removal of country quota.
Others should get a fair chance NO MONOPOLY is desirable.
Also New Jersey has too may Indians living, may be one day, there can be revolution, and they might ask for a separate country. I am kidding here.
We are really missing the boat..till Oct'08 FY09 starts..:(
waiting continues....it became routine..

Something funny seems to be going on with the TSC EAD processing dept. I got my second "Card Production Ordered" email today, saying new card has been ordered on July 29. This followed the earlier email 13 days ago, which said the new card was ordered July 17! Did anyone else have similar experience?

There is no harm in adding this also as the fifth item along with the existing 4 items. :D
I think CITIZENShip years Credit or Reduction in the years is Make most sense for the highly skilled immigrant from India and China as those are the people who suffers most because of backlog and name check.
I also think we should stick to the "five year federal taxes paid" beacuse that is what they expect from normal family based GC holder. Also adding Masters and Higher degrees in the STEM fields attract possible more support.
We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.
Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.
Making it more complicated like Percent credit for before GC filing, after GC filing, after getting GC May become hard and complicated to convenince politicains who might be amending those rules.
So Keeping it simple - 5 yr federal taxes, MS or higher in STEM, 3 years after GC - you get citizenship (all of these has precedents)
