    As some of you know, I have been working with news media, government leaders, and immigration lawyers over the past year because of the stimulus debacle. As a result, I have developed some strong contacts in government. I will be meeting some congressional immigration staffers in the next few days and I have developed a list of issues to discuss. If you want to post your own issues, feel free to do so in this thread and I will add them to the list. These are the same people who helped get the last stimulus bill changed in our favor, so they do have influence.


    What was in "our" favor in the last stimulus bill? Which bill are you talking about?

    I thought, 15000 members was a small goal. But I guess we have to start with even smaller goals. I agree with Amit.

    There's too much at stake to give up this campaign. Without membership, we are a weak bunch. To fight organized campaigns by groups such as Numbersusa we need the member strength.

    Let us aim for 8000 members by Jan 15th. Current membership stands at 7919. We need just 80 members to reach the 8000 mark. If 10% of the current membership brings ONE member by Jan 15th, we can easily reach that target. With 300000 immigrants in this kind of quagmire, cant we get 80 people? I believe we can.

    Let's join hands one more time and try to Add just ONE member by Jan15th. It is for our own sakes we will be doing it, so let's do it!!!

    Congrajulations to each one of you, we only need 37 members to reach 8000 mark. Last night we needed 80 members to reach 8000. So we added a good 43 members in a 18 hour period.

    we have almost as many folks that have not called as those that did. why? oh why? just pick up the phone and leave at least 1 VM today!
    Various reasons may be possible: some people may think that phone campaign may not be an effective method. However, all of them who decided not to participate, did not post a message and explained why do they think so. It happened initially for the flower campaign too ... however when momentum build, lots of no sayers also started sending flowers.

    Second, its quite possible that anti-immigration people are creating the account and voting against the campaign. Some one should take a look at the accounts who voted against, and see when exactly they joined IV? At the same time, some people who are EB2/EB3 ROW, think that if these bill pass, their GC will take more time.

    Another aspect is: majority of people still do not realize how grave the situation is. I was talking to one of my good friend (EB3 India), I am chasing him from last one year to join the fight. He nodes his head and says Yes every time I talk to him, but never comes forward. Yesterday, when I urged him to participate in CHC campaign, he told me "Don't worry, I will help you". This one sentence clarified a lot. He still doesn't see himself impacted by this situation, and still believes that some day his GC will appear magically. He is just living in a fools paradise and enjoying his EAD/AP. BTW, his PD is April 2004 EB3 India. Afterwards, I had to be a little straight with him, and convey him in bitter words that I am not asking his support for my GC, but I a asking this so that he can help himself. Hope someday he will realize this.

    USCIS does not differentiate US or Indian degrees.. Yes US degree has its own advantages... It more than just LEARNING...

    Education is a bigger word than learning... Institutions can impart learning only... You can be highly learned with big degrees... still not educated :-)

    Take a chill pill friends... Degree is important to USCIS like MPG (miles per gallon) to Car.. as its a basis to compare different entities :-)

    EB3 is gone U for rest of Year. Very SAD. we must need visa recapture now.
    That is what I have been saying all along. people said FOIA ..well now if IV really files FOIA then we can hang that information on our walls ..have a recapture campaign NOW !!!

    Hi Ron,

    Tons of thanks for your time and this letter. Though most of the case are pending with Atlanta, there are few people struck with chicago as well. But the number is very small compared to atlanta. This template sounds very good to me, I will post the same at IV and let you know the feed back. Also I will direct the folks struck in chicago to you, they can hire you if they want you to represent them or I will ask them how do they want to proceed.

    If we give the case number and employer name, would there be any impact/side effect ?

    All of the Chicago cases have been transferred to Atlanta. If the Chicago guys want to talk to me, I�m happy to do so. They don�t have to hire me if all they want is information. As for putting names and case numbers, without that information, they won�t take the letter seriously. Also, I think that this will get the DOL to move on those cases. Almost every time I have made a specific complaint, they have responded by resolving the case right away in order to make the whole thing go away. It wouldn�t surprise me to see the same thing here.

    not a bad idea. Only that those who came here on an F-1 will need to get an F4 (something like a dual-intent work visa) after graduation. those of us who came here on F-1 and worked hard for GREs and through grad school did it only because we wanted to settle down here.

    See, if you had immigrant intent, the F1 should have been denied. There should be no dual intent for any work visa whether F4 or H1 or L1, period. If the worker is supposed to be in a permanent job, only option should be to get a green card. The current system has encouraged a bad habit of pretending that permanent workers are really temporary workers who would eventually go back.

    Hello,

    I have a pending Labor application in Backlog center with PD 03/01/2003. In 2006 the corporate attorney applied for a new Labor certification with PERM that got approved.

    The jobs descriptions were slightly different, so he recommended NOT TO re-file with PERM and leave the application in the Backlog center as it is.

    Unfortunatelly, I checked the application status in the Backlog center and it shows as withdrawn. It seems that DOL withdraws the applications from the backlog center queue if you have a PERM application approved without giving us any option. My attorney contacted the backlog center but they woudn't want to re-instate the case, because they say I have a PERM approved... However, there is no law that prevent somebody having 2 petitions for 2 diff positions... Am I right here?

    I'd want to know if you heard about this type of issue and I'm open to any suggestions.

    What should I do?. Is it acceptable to contact AILA?

    Mirage, I disagree with you. Let us focus on reaching out as requested by this campaign activity. This is NOT the time to debate or get distracted.

    Each and every call counts. It all adds up. This is a democracy. The more calls that these offices get, we have a better chance that they would take a balanced view towards these bills.

    So, please do NOT get distracted or get into long drawn debates. the admins have done a lot of the groundwork, given a script and are asking people to call. Let us not second guess them or try to play 'smart alec'.

    Congratulations to all who got their approvals in Sept.

    I really need your advise , it seems my case is frozen and no one is looking at it.

    My priority date is Aug , 2003 ,
    And RD = Jun 17 2007
    and ND = Jun 18 2098

    My dates were within processing dates for 3 months in 2007, 9 months in 2008 and 3+ months in 2009 but still no one is adjudicating my case.

    I tried following

    - Enquiry thru Aila
    - Service request their toll free number.
    - Enquiry thru office of local senator
    - Enquiry thru Ombudusman's office.
    - Enquiry using info pass

    All of these enquiries just send very standard formatted response suggesting we are working on your case get back in 6 months.

    Any suggestions?

    Please advise.

    Individual lawsuit. You will get it asap ( provided everything is clear and good to go ).

    My attorney sent an email inquiry to DOL regarding my case. Within less than 12 hours a response was received -

    <BEGINNING>

    Case: (A-xxxxx-xxxxx) is still in process and official correspondence will be forthcoming.

    Applications are processed in the order they are received. Once the Analyst reaches your case in their queue, based on the principles of FIFO (first in first out) it will be reviewed and official correspondence will be issued.

    However, because each application is unique, processing times may vary depending on the specific circumstances of the case.

    The policy of the U.S. DOL/ETA National Office prohibits the expediting of applications.

    We apologize for the delay.

    It probably wouldn't take them much longer to just approve or deny my case. It's amazing how they are quick with anything that is NOT productive. Don't you just love it when they used the term "FIFO" as though they knew what it really meant? I am a positive person but it's sad and enraging to me that I have to subject certain aspects of my life to a system so dysfunctional and about as modern as Flintstone's automobile. It's said that governments are designed to be bureaucratic, which I do not disagree with. But this system is terribly impaired and down right chaotic from time to time. That is beyond bureaucracy.

    Many people in this society sometimes take on a very convenient attitude toward this issue. "If you don't like it you can leave." But on the other hand they turn around and bark just as madly when they think the government is not doing something right that matters to them. This is not about staying or leaving or any other such choices in life. This is about equal rights. This is simply about people getting their jobs done. To what's broken and what's rotten in the immigration system, I say we all work for a paycheck and we all have a job to do. Difference is I make sure I deliver what I'm paid for and you aren't capable of the same. For this reason I'll still be around right here long after you are eliminated and replaced.

    Sorry for the 'rant' after I've exercised the only tool available in this situation, email inquiry to DOL, and received a totally meaningless but well expected result. Feel free to do the same then you can post it here so we can compare and see if they made any typo. I doubt they will because it has to be a simple copy-n-paste job...but again with them you never know. :o

    CIR wont pass in 2009 or 2010. It may pass in 2011. Here is why..

    - No lawmaker tocuh a big immigration bill when unemployment numbers going up
    - Health care bill is a major major change. lawmakers need atleast one election cycle to rethink and pass any other controversial bill like CIR
    - Dems does not have enough votes in the house to pass CIR. think Blue dogs.
    - CIR wont be touched in an election year 2010
    - Obama already satisfied Hispanics with Supreme court judge
    - Health care reform already turned into Immigration reform and you know what happened.

    There are plenty of reasons CIR wont happen.

    I think your calculation is wrong. If there are 8742 applications then it should take less than 3 years not 5 years. In the 2nd case for 14583 applications the wait would be around 5 years instead of 10-12 years. This is due to the fact that every year around 3000 visas go to EB3 category. Though this is a long wait too so either way we need legislative fix for all the cases.

    For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.

    For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.

    Now the only way forward will be to lobby with IV for a legislative fix. Apart from that there is just no option, the sooner people realise that and help IV with advocacy, the better results we will get.
