    ...that my daughter just got approved for a two-year EAD even though she will, in all likelihood, get her green card in October. I checked with my attorney who said it seems they are giving two-year EAD's to everyone whose PD is retrogressed at the time of filing. It might be interesting to monitor the approvals for this?

    While I agree with most of what you have said, some of this anxiety will be removed or minimized if USCIS has a published or documented way of going through with these approvals (like PD,RD,ND etc)instead of randomly choosing a case.

    It is good to see lot of peopel of EB2 India are greened in the last 48 hours. However there is no single approval of people having PD earlier to 2004.
    What it means?
    Either one of the following should be true.
    a) IV Tracker data of 65 pages ( 65*50=3250 approx) is wrong or Not updated
    (Filtered by EB2 India Pending)
    or
    b) USCIS is processing I-485 randomly as usual , ignoring earlier PDs

    IV Gurus / Seniors / Experts / Critical thinkers can comment on this.

    BREAKING NEWS: LOFGREN GIVES USCIS THREE DAYS TO ANSWER QUESTIONS

    Congresswoman Zoe Lofgren (D-CA), chair of the House Immigration Subcommittee, sent Secretary Chertoff a list of questions and a request for documents from USCIS to get to the bottom of the whole Visa Bulletin fiasco. The letter is very interesting not just because it puts a heck of a lot of pressure on DHS right now, but also because Lofgren's folks imply from the questions that USCIS was short circuiting established security clearance procedures to "pre-request" visa numbers from DOS. If it turns out full security clearances were not carried out, USCIS will either need to say that they had the legal justification (which would be a public relations disaster for the agency) or that they intended to complete the checks after the fact (which would be a direct violation of their own regulations). The only way to avoid answering the questions and to make this go away would be to eat crow and start working the case July cases.

    Thanks for your response.
    If you have an argument with some members on the forum, I think it should be restricted to just that. Calling every EB2 applicant a bigot is rude and uncalled for.

    My colleague who recommended me to this forum is an EB2 applicant and is supportive of complete EB backlog elimination and is active in the IV state chapter inspite of getting his green card last year. Even the EB2 applicants on this particular thread have largely tried to point to how we should focus on the larger issue instead of fighting among ourselves. If you do not believe in IV, thats your choice - but I think we need this platform to achieve any relief for EB3.
    I look forward to working on IV action items and lawmaker meetings. lets get this issue resolved for every EB applicant

    Hear that you EB2 bigoted persons. Here is An EB3 person who is supporting IV inspite of what ever is happening. Will this open your eyes to the fact that EB3 folks are not against EB2 folks,but all that they want is that they should get some measure ofjustice.

    Mr gc_dream2009. I feel a respect for you which i do NOT feel for EB2 folks who have tried to denigrate whatever i talked about (Must be their superiority complex)

    I would now like to comment on some facts which are result of my observation over a period of 3 years starting from 2007 till current date

    The only proposal which helped EB3 is July 2007 fiasco with EAD and AP benefit and before we give thanks to IV please remember that back peddeling by USCIS was not just because of just IV but also because of strong pressure from AILA. If EB3 benefited from July 2007 fiasco it is only because EB3 was part of all the EB categories and not because IV was aware of EB3 plight.

    Now after July 2007 nothing has been ever done to relieve pressure on EB3. All the benefit have been provided to EB2 and all EB3 is told is after EB2 gets current EB3 wil get benefit but nobady talks about EB2 never getting current and the fact is EB2 will never get current and till that time EB2 will get all spill over visa and EB3 will get 0 (Zero) spil over visas

    i am totally frustrated in following all these stupid bills (along with illegals) and these dirty politics etc. I am more furious that we all are fighting only by ourselves and none of our employers are pitching in for the very reason we are all here. This said, we are wasting our time in following all these bills which has so many loop holes to get bogged down(especially for clauses pertaining to legal immigrants). Guys, this is personally for myself, i am not going to waste my time anymore on this crap. I am going to set myself, some fixed time that i will wait for the GC to come through. If not, i am going to pack up my bags. I am just speaking for myself, atleast that way i know that i am not waiting for some useless bills to pass through. Atleast i know my wait will end by that time. I am just speaking my mind over the way things are going and totally frustrated due to this freakin retrogression..

    I am also completely in same thought.
    I am planning to pack at the end of August,if nothing passes (S2611 like) in HOUSE.

    Hi IV members!

    I know many of us have been toying with ideas to increase membership. I wanted to start a separate thread just to highlight the following idea - Every member bring one additional member to IV.

    Specifically, these are the bullet points I suggest:

    1. By December 31, each of you bring one member to IV.
    If you really think about it, it is not a difficult task. Every one of us knows atleast one person stuck in GC process, that is talking conservatively. It takes less than 15 minutes to call one person and explain IVs efforts and request his/her support.

    2. By January 15, each of us take responsibility to get the member we brought to IV to contribute to the cause. And I am not suggesting any particular amount.

    3. Each of take responsibility in having them update their information on IV website, so that when the need arises, they can be contacted (for sending webfaxes etc. like last week).

    Also, whenever you bring someone to IV, please post on this thread (it will encourage others). I feel this approach will work, if we keep this thread alive, and try to stick to the time deadline (deadlines might not have worked before, because they were too long term).

    Also, please keep this thread on track, without any other discussions.

    So IV'ers, lets add ONE member, and get ONE contribution!!!!

    Thanks so much, this is an excellent idea. Add one-2-3-10 members, lets keep this thread alive and kicking. Lets keep it to the top. We can do it. In a single day last week the thread we started calling sessions went from 35 posts to 150 posts.

    Immigration voice is actively involved in advocacy, campaign efforts in Washington DC.
    we need members all over the country to meet or call local Senators and house Reps, about Employment Visa issues regularly and ask them to sponsor, support Bills for our concerns.
    This will ensure our voice is heard during meetings of each Chamber - Senate and Congress.
    Legal Immigration reform is the core goal of Immigration voice.
    This thread will discuss any bill introduced for Legal immigration, including employment and family based.

    The advantages being:

    1. CIR will not happen for the next 2 years with a republican house majority.
    2. This will be a much smaller Bill and a larger percentage of people would support this.
    3. We should distinguish ourselves from illegals for a path to the GC
    4. We have a big lobby ourselves, with hundreds of thousands pending, to up to 10 million GCs, citizens involved.
    5. We deserve preference for following all rules
    6. Illegals have a major point lacking - they did not use a H-2A visa and instead broke the law. Due to this there is popular discontent which may doom their legalization, or drag it on for many more years.
    7. Legals directly add benefit to the society and tax receipts. Many of us have paid close to 100K in 5 years to IRS. Taxation = fair representation. 5 years = 10 billion from all of us at least, if you assume only 100K immigrants.

    Please add points supporting or refuting this.

    I have no Ill-will towards illegals, this is just my opinion on what is better for the long term future of this country.
    I have the highest compassion for all the poor and needy of the world, but it is irrespective of race, religion, color.

    How come no one in your company B asked you whether you are married or not and whether or not you need H4 filed for you spouse. Same thing about company C. Either of these companies' HR or immigration lawyer should have asked you about dependents and spouse?

    I dont know but even the smallest of consulting companies dont make this kind of mistake and they would remind you if you forget. My company's lawyer is quite lazy and slow but even his paralegal asked all the right questions and got all documents needed and didnt forget stuff when filing for various things.

    Well that's where small consulting company comes handy. I had this experience with a big company. They never asked for my wife's I-94 till the 11th hour when I brought the fact that I'm married and my wife (no wives here :( ) might need some extension. Since, it was my first H1 extension after marriage, I really didn't know that company has to file for her extension as well. I thought it just happens automatically..how naive I was.

    The biggest weakness of DOL/USCIS is going back to the older cases while newer cases are piling up. They do not have any service level agreements to adhere to. That is why many labors in the older process ended up in BECs.

    Please raise this problem with your local senators and representatives and put pressure on DOL. The longer it takes at DOL, the longer it takes for your GC. Do not be under false hopes that your I-485 will be picked up based on the PD. For USCIS, RD is the convenience and they wil only go by that even if the law is written otherwise. So get your application out faster.

    Weldonspring,

    I am on the same board. I am also planning the samething.

    1) After 11 weeks that is next week Friday call the customer service and raise a Service Request
    2) Within 2 wks no response, on 90th day I will walk into the local office (SFO) and ask for interim EAD.
    3) If Still create the issues, packe the bags and go back to home country. It is really bad,
    getting frustrating for everything no regulare process and always waiting.

    So I give up, I applied on april 1st and still waiting no updates:mad:

    Like I said you can start at the same pace as you normally walk from your car to your office. Do that for 20 mins or 30 minutes this week and we will increase the pace very slowly and add a few minutes each day. Also always listen to your body and do what your body can. it is very important to respect our body's limitations. I have learnt that the hard way

    Yeah I started off faster than normal and for the last five minutes I did a stroll.. Its gone now, I don't feel it anymore.

    Years we have been told priority date establishes your place in the queue.

    We have spurned job offers and declined the new PERM process to hold on to the priority dates.

    Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.

    People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.

    Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

    Aint fair. Aint fair at all. How can this be. How can rules be changed in the middle of the game.

    Dont worry. If your LC still in BEC with old PD you are more luckier than the guys going to file 485 now. DOL commited to clear backlong by Sep 2007. Oct VB will come up with priority dates in stone age. If your PD is very old you will get GC with in 6 months. Filing 485 in July and Aug with very new PD will not bring them any fruit. They have to wait more years. 750K 485 and 750K EAD and 750K AP will result in choking the CIS system. They will feel the challange of renewal on time.

    I am very conficent that USCIS is not going to process all 750K at a time. They will definitly modify the processing method, fom current practice. First, they can not schudle FP for all 750K applicants in available ASC centers. So, they will sort the 485 based on PD, and process tham based on PD and country and catagory wise. A guy with PD 2007, will not get FP notice very near to his PD become current.

    so, you will be in better shape.
