    xyzgc,

I agree with your message that immigrants should clear their dues before they leave. I'm of the belief that, even if they complete 36 points in Social security when they leave, they should leave honorably without any dues/liabilities. That is the choice we made knowing the repercussions.

Having said that, the way you pursued your argument in the context of non-GC holders having a home is not correct, in my opinion.

Yes, I don't believe we have anything against each other except replying to each others posts! :D

And I don't want to get between you and masternyc! :-)

When you reply to me and use the word "you", it could be taken as personal instead of treating that as an impersonal pronoun!

"Make sure you pay off your mortgages if you do and cover all your liabilities" could have been rephrased as "Immigrants leaving MUST ensure that they pay off their mortgaes" with a strong emphasis on 'must'

    Thanks,
    GCisaDawg

Congratulations to all those who got greened & best wishes for those who are current in sept. Hopefully, trends of approvals will be clear by 10th of Sept and will give some idea how OCT vb my be like.

Good luck to those current and would-be-current.

...only if approved. Guess, luck matter a lot when ur dates are current...as those guys are picking up cases randomly. Majority of approvals thus far are Feb/Jan 06 , when oct/nov guys are still looking forward..Please, dont get me wrong....Systematic approvals helps everyone...as you know the celebration time has come

SR/infopass is such a routine a thing ...they have standard reply to mail out. It definitely is frustrating to sit on the edge and keep waiting....

    thanks gbof...

    Speedo,
    Guys,

I received the card in the mail today. It was mailed in Texas on 04/14.

So here is the events from 04/10 when I received the Welcome email.

    04/10 - Welcome Email
    04/10 - Card Production Email
04/15 - Case approved Email (Shouldn' this be the first one they should have sent? Anyways I'm not complaining )
    04/16 - Card received.

It felt so good have it finally in my hands!!!!

    Congrats Lasantha :)

One question: in one thread you mentioned you've also got canadian PR. I did apply for canadian immigration, got approval but have to land before 24th april. My 485 was filed in july 2007, EAD, AP aprpoved and PD for october 2005 got current in the May bulletin. I am thinking of abandoning the CA PR as even if I get that, I will have to abandon it when I will get for US PR. So the question is, what will the CA PR benefit when you already have GC?

The three days were packed with drama - Like any good drama, this too had it's moments of tension, action, and humor....the funniest one was:

Right before the rally when Aman was EXTREMELY busy, he actually had 30 seconds for each reporter. Our sweet little Jane walks up to him and asks "Aman where are my clothes?"
Aman had the funniest expression on his face

Here is the background : All of us had stayed in the same hotel and at the check out time we had kept out luggage in the baggage room. Aman had the tags of Jane's bags and Jane thought that Aman would get her luggage @ the rally!

Guys u had to be there - It was hilarious:D:D:D:D

    Meenal

hahaha, I remmeber on Monday night while getting out of Situation room, Aman figured that two of his bags were missing and he was trying to figure out where they are. He only had his laptop bag with him. When I drove in to pick up 3 guys at the hotel, the guy who was with Aman (I forgot his name) thought I am picking up Aman and started putting Aman's laptop bag in trunk of my car. Aman saw it at the right moment and took that bag out of trunk and probably thought no wonder why his two other bags were missing.

I think he eventually found those bags, people taking care of thos ebags took them for ride and dinner.

beenwaiting, by the way they had to cut your (and mine too) interview on AajTak. They had to choose between our interview and LogicLife's speech, it was an easy choice for me as logiclife's speech was more important. I'll post the clip as soon as I have it. You should be on one of the other channel interviews, thanks a lot for being available for that.

This is reality, my friend. There are multiple approvals showing up already on other sites.

What matters is "had my approval and even better GC arrived?" . The answer is No, yet. So let's keep the hype down and remember we all have long and will continue, but hopefully our kismat will change. But till than ...

    Hi Guys,
Place A has mentioned as the place of birth in my passport and place B has been mentioned as the place of birth in my Birth certificate. Distance between place A and 5 or approximately 3 miles and both the places comes under one Taluk/Mandal.

I would like to know is this going to be a problem in I485/AOS status, if so can you please suggest some way to overcome this problem?

    Thanks very much.

Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.
Valid point. what ever it is, if you live in this country as a legal immigrant or non-immigrant for 10 years and paid taxes continuously for 10 years, automatically it should lead to Citizenship.

you didnt understand my question. I do not have a birth certificate at all. in this case, what document should I use? thats the question.

having a birth certificate is mandatory...this document will prove that you belong to a particular country and fall into that country limit etc...

regarding not having the name on the birth certificate one of the attorney said that USCIS is aware that some countries issue birth certificates without names and so it is okay with the parents name and 2 persons who(around our parents age) can notarize saying that we r our parents child is good enough..

Very well said.. This will give a little hope to everybody..
    Thanks for your post.

QUOTE=shantak]Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.

    1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
    2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the Other Worker Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.

Now lets go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.

To be honest with all of you, I was really disappointed in the message from AILA. In the rush to inform, they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I want my clients to know this: at this point, I am not worried that the visa numbers will not be available throughout July. If I were worried, I would let you know. My responsibility is to guide you through this process and if there is any genuine worry on my part, I will let you know IMMEDIATELY.[/QUOTE]

Slammer, if you got visa number last year you should have gotten an interview months back, UNLESS your consulate appoinment schedule is backlogged.

    Good luck

Sorry, should have said that the NVC had visa numbers for us - last year. Of course we won't hear anything from them until our PD becomes current.
But thanks for the tip to simply call the NVC and inquire about the status of our application, until now we only called the automated system and sent inquiries by email. Talking personally to someone might give some more information than the automated response :"Numbers are not yet available."
I'll keep you posted ! And good luck to us all in the future ! :)

    Hi,
Could someone guide me what to do with my situation.. here's what happened so far

    1. Applied for passport renwal at CGI Houston and USPS tracking tells me it was delivered on Jan7th 2009. It was about to expire on Jan24th 2009.
    2. I waited for almost this long and called them this week, they said they dont have it in the system and not even in the return sender list.
    3. USPS says they delivered. All i had is just delivery confirmation, shud have had a signature or certified mail or rather used Fedex.

Not going back to USPS ever again, needless to say it was painful to get CGI Houston on the phone only to hear that they cant find my passport application....

Could someone please help with ideas !

    Any help is greatly appreciated.

    -P

    1) I have read some of your earlier posts on this thread and what you have primarily done is merely re-iterated what the issue is. Without any contribution or suggestion as to how to actually resolve it. And since the situation has continued to stay the same for several years due to Congressional indifference, you seem to have decided to pick on IV for all the faults with EB3 backlogs and the lack of effort therein to resolve the same. For a minute, please understand that we all know the facts and realize what plagues EB3 backlogs.

2)Yes I have been on every EB3 prediction thread and know the numbers are too bad to be resolved by anything other than CIR (dead) or standalone bills. I do not know why you are stuck on insisting that we all think EB2 becoming current is the only solace for EB3 (associated spillovers etc etc.). IF Eb2 I gets current - well and good - Eb3 will still need some legislative relief (here I go again with EB2 vs EB3 - something I hate to do). But then one of your original gripes seemed to be blaming IV for not considering EB3 provisions in this Diversity Visa Bill which, at this early stage, is completely befuddling!
    3) Your entire approach of going after EB2 applicants and blaming them for your dreamt up failure of IV is insane. Diluting the discussion with vitriol and then blaming everyone around you for not participating makes you a bigger "bigot" (sorry - just paraphrasing one of your used words) than what you blame others to be.
    4) You do not represent my opinions. So please stop advocating yourself as an EB3 representative (which you are doing whether you believe it or not). With the points you have raised and the negative vibes you have created between EB2 vs EB3, you have shown that you are concerned and frustrated only about your own personal GC situation and are trying to use the EB3 tag to shove it down my throat. Which I completely detest.
5)I think IV should remove the EB classification that shows up with people's profiles. I do not wish to be "branded" even before joining in a discussion.
    Thank you for the inputs.

That is because no idea we have currently works sor the situation. The only way is to think outside the box. Ok so i came up with an outside the box idea. Maybe it is a good idea maybe it is a bad idea but i did.

2)Yes I have been on every EB3 prediction thread and know the numbers are too bad to be resolved by anything other than CIR (dead) or standalone bills. The idea is that EB2 had benefited to a certain amount because of the change in spill over rule which is good for them i am all gung ho for them. Now since EB2 is in a postion where it will move ahead (fast or slow but it will move) IV focus will have to move towards the other category they claim to represent.
Why is doing something specific for EB3 (even with a chance of failure) NOT and option in IV. In DV bill if IV makes a stand that the 55 k visas should go to oldest priority first that is a chance to wards helping EB retrogressed applicants (Both EB3 and EB2). IV does not even need to make a stand now since it is too early. Has IV even considered it?

    3) Your entire approach of going after EB2 applicants and blaming them for your dreamt up failure of IV is insane. Diluting the discussion with vitriol and then blaming everyone around you for not participating makes you a bigger "bigot" (sorry - just paraphrasing one of your used words) than what you blame others to be.
What failure are you talking about. IV is a success only problem is the success has been to a small group out of the complete EB community. What vitriol are you talking about. All that vitriol came from you guys on IV forum. I am not blaming anyone for not participating in this effort. If the idea has strength people will do that on their own. If not it will die a natural death. Please remember that my Post named (Perhaps it is time to realise a few facts.. ) initially listed the idead and the rest of my posts were spent trying to reply back to every vitriolic attach on the same post. And what did the post say. It said think outside the box

    4) You do not represent my opinions. So please stop advocating yourself as an EB3 representative (which you are doing whether you believe it or not). Which I completely detest.
No i do not want to represent you (An EB3). I am not even advocating myself as EB3 representative and ofcourse to the rejoinder (which you are doing whether you believe it or not) i say come on guys if according to you i am a lazy good for nothing person who never donated and never participated (My choice but i wil let it slide to make a point) to IV and never worked on anything constructive why teh hell would i want to suddenly become a representative of all EB3 (Shudder!!!!!). Will it not collide with my lazyness and selfishness.
I did not create any negetive vibes. All i said is it is time to consider piece meal (Is this not the same thing that IV advocates to lawmakers)
As far as showing something down your throat who is doing that? I stated a out of box idea and i have spent the whole day today defending it (Its a wonder how me and you all get our work done huh :P). In fact if anything i have spent the whole day removing all the comments and abuses from you guys from down MY throat

5)I think IV should remove the EB classification that shows up with people's profiles. I do not wish to be "branded" even before joining in a discussion.
I have no comments either ways because that is just changing the outer covering. The insides is still the same and it still needs some fresh approach to get out of the problem of retrogression

BTW - When i reply back to messages i do not even see the EB3 and eb2 calssification. Thsi is beacuse the messaage itself tells me what category you are. I must rephrase that... I do see the classification when i am providing advise to people becasue you do not want to gove a wrong advise to anyone right !!!

Is there anyone here in this forum who has file I-485 without a birth certificate. meaning instead of birth certificate what document did you use? could you please share it with us. Thanks.

Here is what my attorney recommended-

    1. Get a "Non-Available Certificate" from the municipality
    2. Get 2 people to provide affidavit (close relatives) in support of your birth date.

Hope this is helpful. Check with your attorney too.
