I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.
Keep posted your experiences.
Thank you.
ajkastar
I would suggest you to get h1 your visa stamped from India and enter on h1 and not on AP. Don't even show your AP to the immigration inspector at the POE.

Why would they think like that?, USCIS made a mistake. They tried to cover (by making visas unavailable) their ass to save their jobs. Thats why we have congress to help us out.
For USCIS its a bad publicity.
I am telling you guys, the USCIS is gonna SERIOUSLY think "Lets keep screwing these guys and getting free stuff AND free publicity"

I think you need to send an email via vonage account to refer someone and the system automatically gives your account a credit when the other person signs up. Dont know if you can give a phone # and say that MR ABC should get the benefit of 'refer a friend'
You will. Agent will get info. I did last time over the phone and gave my friend reference. then we both got 2 months free.

I understand your frustration. I have heard similar things from employers about hiring people on H-1B.
Are you just assuming or have you actually tried to find out if there is indeed some law which allows employers to not consider a candidate solely based on the fact that he/she has an EAD as opposed to a green card? I can certainly understand that you don't want to get involved in a lawsuit and pay lawyer fees when you can easily find another job. But its not that difficult to contact OSC.
Having said that, I do understand that the employer can find a number of reasons to not hire somebody and all that would be legal. But here we have a case where you have 5 companies who have refused to consider you solely based on your immigration status. Somebody earlier has this in writing from Capital One.
I urge you and anybody else who has gone through this to find out more about this by calling the OSC's hotline. (http://www.usdoj.gov/crt/osc/htm/engperliwdiss.htm) If I were in your situation, I would at least want to find out what my rights are, what is discriminatory and what is allowed by law. Call them and simply explain that you believe that you were not considered eligible for a job because you have an EAD card as opposed to a Green Card.
Yes, I am aware about this but in my case I do not have any written or tape recorded evidence. In other guy's case at least he have written proof (Capital One) and that can be the base. Now many companies are doing this so it is ofcourse my assumption that they can do this under "Hire and fire" authority.. And main problem is that, when you are out for a job, you do not stop thinking to takle particular one "no", you want to just move haead and fix your job first.. That is practical reality:)

Something is screwed up.....
Mexico has over 2000 cases in April 2001 yet its PD is May 1st 2001
India has less 500 cases in April 2001 yet its PD is Apr 15 2001
This along with CIS giving "bad/incorrect" data to IV is indication of someone's malicious intentions.
I appreciate IV's effort in getting FOIA executed and now working on aftermath of it.
For people who are angered with whats been going on in last couple of days. All I can say is to try volunteering for IV even for a month.
The missing link is Consular Processing cases pending under DOS.

kcforgc,
Even if you are on a 24.99, you will have to call up the customer service (or go online) to change your plan to something called a "World plan" (which is also 24.99), then you will not see any charges for international calls.
Thanks

Obviously it must be an attempt to protect India from being taken over by Hong Kong ;)
You got that right. Hong Kong is part of China.

I used the format below:
Dear Officer,
My case has been pending since September 2007. Below are the steps I have taken till now in order to get a decision on my case:
1: Initiated enquiry through my attorney.
2: Opened a service request with USCIS (Got an invalid response of no visa numbers available)
3: Made an Infopass appointment with an immigration officer.
None of the above has resulted in any clarity towards my case status.
Below are my case details- (Myself & spouse)-
Applicant name:
Application type: I-485
Category: Employment based EB2 (India)
Priority date:
Receipt number:
Spouse details:

I had the following questions on my case:
1: As my priority date is current, has my case been assigned to an Immigration officer.
2: When can I expect a decision to be made on my case as my case is pre-adjudicated.
If you need any additional details from me, I can be reached at email or phone @ phone number.
Regards,
I will take you up on your offer. Can you please PM me the details on the e-mail/letter, or post here, whatever you feel comfortable with? Thanks!
Enjoy your day!

qasleuth - You do not even deserve my reply. So you are free to write anything that you want!
Kumar1, You have a reputation of "beyond repute" on this forum and one of the leaders who people expect to lead us. Is this the ethical/moral standard you live by ? Disgustingly shameful. And are you one of those people who throw empty cups in a trash can over here but chuck it onto the streets when you go back to your home country ? I bet you are. You rent and have no idea about what you are talking about yet doling out useless/dangerous suggestions.
Paujabi77, I will not get into moral/ethical dialog with you (inspite of your comments like "i will sell it after couple of years and make money")
Actually you should consider yourself in the same group as these so called stupid people, cannot exclude yourself as a smart person just because you did not take an ARM. Any decent website/article/source of info will tell you that you cannot buy a house if you are planning on staying for less than 2 years.
"well it is not my bad decision that has brought down the whole market but the banks and stupid people who took loan"
Here is some real advice:
Letting your bank forclose on you or filing for bankruptcy is not a decision you take lightly asking people on the forum for advice. Your credit score can go down by as much as 300 points affecting you financially over the next few years which you perhaps have not really thought about. Just because you have existing loans (like credit cards) on a low rate does not mean they are 'locked'. Banks can hike the rates periodically based on your current score often to as high as 32 %. This is not pennies but can be hundreds of dollars in interest. Ever got harsh calls from collectors ? Ever got evicted from your place of residence ? Ever got denied when you try to rent ? Try living only on cash for a few weeks and see how it feels without credit. I have not gone through any of those thankfully but have seen and heard horror stories. Consult a professional or do research on your own before making a decision.

The guy has sent you a generic form letter. I dont want to discourage or disppoint you and I thank you for your effort. What you did was good. What I am saying is that he probably didnt read that you are not talking about illegal immigration and borders etc. but the backlogs in the "Legal" variety.
But he just sent our a generic letter that can be used for all people writing about immigration.

Ask them to connect you to the head/Senior executive. I did the same thing with my local cable+phone and was connected to a the head of their customer Service. That person connected me to more senior marketing person. That marketing person called me and emailed me to discuss. The company had no idea about Vonage plan and seemed unprepared to have a strategy to stop the exodus of its customers to Vonage.
All of you can do the same. When more people do it, it will generate market demand and customer demand that money hungry capitalist companies cannot ignore. If you do not do it, then one company will have monopoly over this market.
I agree.
