    I am on a h1b currently. I changed empoyers in the US but the old stamp is still valid till semptember 2008. I has taken a visa date for jan30 in mumbai consulate and was going to fly back on feb9. Now planning to cancel the visa stamping because of the PIMS delays. I hope i am still valid to fly as i have a valid visa stamp and a new petition from current employer too which i can show at port of entry. Do let me know your views on the same and if there are any probable issues....

    you will be fine. i have done that earlier.. make sure they stamp I-94 with the expiry date of your current H1 approval... that is important..

    Normally how long the medicals are valid, I have applied my 485 in the past with medicals that are 7 month old


    Normally valid for 1 year but according to my CS these days USCIS is very strict about tb test so they they recommond it to be in within 6 month time frame.

    I am a July 2nd files, they told me to call on the 3rd of October. (I don't know what is the logic to calculate 90 days at the USCIS). I am trying to make the attorney call that day. May be she will have more luck. :confused:

    Hi I called TSC yesterday, when i tried to inquire about is my case is pre approved or not, it seems the representative does not have any idea about it. and he just opened a service request and gave me a number.

    Is this the way you guys get to know that your case is pre approved or not, or do i need to do some thing differently.

    I am in the same situation, and I plan to include photocopy of my courtesy copy of my I-140 with other docs, as I am filing AOS by myself. If anyone else had the same issue, please share your exp.

    Sorry to disappoint you guys, but courtesy copy is not sufficient to file I-485. Read your courtesy copy clearly. It categorically states that

    "This courtesy copy may not be used in lieu of official notification to demonstrate the filing or processing action taken on this case."

    I think it is crystal clear what INS means.

    The big question is, what happens if you do file with the courtesy copy of your I-140 instead of the original one. My guess is, if you are lucky, INS may accept your 485 petition initially, and after a few months then may simply send you a RFE asking for the original copy of I-140. And, by that time you may be able to convince your company or company-lawyer to release to you the original copy. And if you are unluncky and the clerk at INS is sharp eyed, he/she may take this as a case of missing initial evidence and blow up your entire 485 application at the on set.

    You can take your chances.

    Washington (UPI) -- A leader of a semiconductor company wants the United States to ease immigrations standards to make it easier to hire and retain foreign nationals.

    Intel Chairman Craig Barrett, appearing on a question-and-answer forum on FT.com, said a market-based approach to granting work visas should replace the current system, which sets numerical limits on such documents.

    Several leaders of technology companies have made similar requests of U.S. officials, the Financial Times said Wednesday. The visa classification that allows foreign engineers and scientists to temporarily relocate to the United States has a limit of 65,000. Some 140,000 green cards, allowing permanent stays, are granted each year.

    Barrett said the figures are too low, pointing out the work visa total has already been reached this fiscal year.

    'These arbitrary caps undercut business' ability to hire and retain the number of highly educated people in the field where we need to maintain our leading position,' Barrett said on FT.com.

    Barrett suggested, 'We should just staple a green card to every advanced degree granted to a foreign national from a U.S. university in science and engineering.'

    Thank you. I am not worried about the three companies I know of , I am worried about other 3000 companies that I don't know of.
    I also beleive, it is not the companies that are evil. It is the system that provides the incentive. And I am trying to take away that incentive.

    Please wait for few months; let me complete porting my PD to EB2. LOL ....

    If you don't realize, this is what is happening in the GC queue system and I will try to explain using an analogy.

    There are 3 queues to a single counter that issues work permit.


    First queue, for age group 20-30 (EB3) and slowest to get a work permit
    Second, age group 31-40 (EB2) faster than EB3
    Third, age group 41-50 (EB1), fast lane.

    Now, on Jan 1 2000, X who is 21 years old joins the EB3 queue. There are 10 people on EB2 queue on this day. EB3 queue is hardly moving and X remains in the queue for 10 solid years. He is now 31. It is 2010.

    The EB2 queue now has 100 people and our 100th person in the queue is SS and 35 years old.

    The system allows X to join EB2 as he has turned 31 and also allows him to join behind the 10th person who was there on the EB2 queue as on Jan 1 2000 (if he was still there or be the 1st guy in the queue if the 10th person has already left the EB2 queue) as that was how many people were in the EB2 queue when X came in to this system.

    Now SS cannot tolerate this for 2 reasons. One X came from EB3 (an inferior group per him) and next, X is 4 years younger and hence cannot get work permit ahead of him. He does not realize that he did not come in to the system when X came though he was senior and superior.

    The system does not see that way. X was in the system for 10 years and he should be given priority in the system valuing the 10 years wait - irrespective of the queue he is in.

    In other words, his queue might change but not his association with the system which is 10 years.

    Now there could be people who show bogus age certificate and change queues. They have to be punished but not the system.

    You don't set your house on fire just to kill few mosquitoes in there.

    If you still don't agree, SunnySurya, good luck with your law suit! After all every human being commit mistakes in their life and is your turn now.

    Finally got greened. Got the CPO email for myself and my wife today. It has been more than 9.5 frustrating years since I came to this country. But I am finally happy that it came through.

    I am even more happy that I did not just leave it to time. I have been heavily involved with IV from the beginning. I have spent plenty of time and money on IV and happy to see that it has benefited myself and others.

    Don't loose heart. Keep fighting for what you think is fair.

    Milind123, I can certainly understand your frustration but kudos to you for making your post humorous at several points amidst your painful experience. I especially liked your closing remark about Koh-i-Noor - I'm with you. :D

    Come to think of it, even the country where we are right now (i.e., the US) isn't much different not only in terms of lengthy forms and queues (outside of consulates) but also on making our lives a little more than hard by denying driver's licenses, delaying permanent residence perpetually etc. On top of these issues, apparent hate crimes against Indians at LSU and then at Duke would certainly make a lot of parents a little nervous before sending their kids for higher education here.

    I had the misfortune of travelling thru London in December on my way to Mumbai. After I purchased my tickets, I learnt that I need a transit visa (TV) for UK. (Who is going to tell them (UK) that they are no longer the center of attraction esp. if you have lived and worked in US). Anyway, as per the rules, you need a transit visa if you don�t have a valid US visa. (Note: If you have AP, and don�t have a valid visa, you still need a TV).

    I went to their site and did all the research to get a TV. Good god Heavens! Has anyone filled out their painful form for a TV? Besides asking the usual details, they get extremely nosy. They want to know each and everything about you. Where you work, what money do you make, name of your wife, kids and their citizenship status, name of your father and mother and where they were born, their birth date, how much money you have and where the money is (stocks, bonds, CDS) etc. etc. While filling up the form I realized that, even my future father in law did not pose so many probing questions to me. (Please note: I don�t mind answering these silly questions for a regular visa, but for the damn TV, it is certainly overkill).

    Anyway to cut the long story short. The regular cost of TV is/was $92. However, when I filled up the application form they were asking for $184. (The satisfaction of getting a good deal on the tickets was quickly evaporating). I assumed I must have made a mistake in thinking the cost to be $92 and reluctantly paid $184. Next it was time to fill the application for my wife and answer the idiotic questions again. You should have seen the �I will kill you right now� look on my wife�s face after I woke her up in the middle of night and asked details about her parents. After I filled up the form, to my surprise, now they were asking $274 for visa fees. It was already 2:00 am and I have no choice but to painfully enter my credit card details, hoping that they would realize the mistake in their recon process and would reimburse the difference. (Of course, I was only dreaming).

    It is now almost the end of January and I have still now received any money from them. I have tried sending several email to the emb(ass)y, but none of their emails work. I get bounced email for all the emails that I have used. I have tried calling them and left messages and no one has called back. I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me. There is a way to talk to someone in the emb(ass)y, but you need to dial a 900 number, which BTW costs $2.49 per minute. Throwing good money after bad is not an option.

    I just wanted to share this experience with you and remind you of the pain ahead, if you are travelling thru UK and don�t have a valid US visa. Personally, even if they had charged me the regular $92, I will still use other options to travel next time. The amount of time wasted in filling the crappy application form, going to NY, (starting Dec doing your finger prints) is simply too much to handle. Visiting your motherland/fatherland is a very special occasion and all these intermediate steps certainly water down the �good feeling� that you experience during the days leading to your trip.

    I haven�t given up my quest for a refund, but now, not only I want my money back I would like to bring back home the Koh-i-noor too.
