I asked the admin and other senior people. But no one bothers to respond.
I have been in touch with the the administrators and they have been very prompt and supportive regarding this initiative. We have been communicating almost on a daily basis.
Like any other initiative or the campaign, the more people and voices we have the stronger the campaign is, I am glad to see the 50 number mark but if we need to make this a solid campaign we need to have at least twice as many people as what we have now. Imagine how many people apply for LC, 50 of them having issue with the process is not going to convince any body that there is a problem.
I am still trying to get people together but that does not prevent us from brain-storming the ideas or even taking actions that does not require a mass scale of support from other people (e.g. lobbying with politicians, etc.)

Actually, H.R. 5921: High Skilled Per Country Level Elimination Act is equally important. Why am I from India being discriminated against as compared to my neighbor from some other country if we are doing the same job for the same company. That way if everybody is in the same boat maybe there will be more uproar about 5882 because I'm sure other populations are more vocal than Indians and Chinese.

It shows that we were ahead of them in following events that happened last week. They posted something today that we knew while it was happening last week.!! Tell me them that even though you are not from the same constituent, the Congressmen will be voting on these bills once tabled in the Congress and you are requesting to support the bill
I called congressman Hinjosa's office.
The staffer asked me where I am calling from. Then said you are not a constituent of the congressman and was not willing to transfer to the person who handles immigration issues. I insisted on leaving a message and he took the message, but was surprised, did anybody else encounter this? How do we handle this if it happens with other congressmen?

I called all the numbers and talked to congressional staffers. I was lucky that i got to talk to a person and not VM.
Many of them assured me that congressman is supportive of the immigration issues and will probably support the bills. Two of the staffers took my home address.
It is my first time calling congressmen offices and i was surprised to find it fairly easy :)

questions are never ending, the only thing in our control is to push our lawyer to file asap.

She obviously cannot wait till Oct 1st or she won't get paid for the first week (at least). Contact the SSN office to find out how soon you have to file. In my opinion, you are eligible to get an SSN the moment you receive work authorization (even if its for a future date).

there was a rencent drive undertaken by IV which involved getting a list from USCIS (or some other authority) about where the visa #s are being used, right ?
Perhaps something to do with collecting money from the requstor..
Basically, USCIS sent letters to a few folks asking them to pay 5000$ or so to get the list as it involved some programming ?
Where is that ? does anyone know ?

How much longer would we have to wait?
Lawyer sent inquiry to DOL and they replied with a non responsive email saying the case status was Processing and they would be reviewed in a FIFO order. It does not seem to be a FIFO processing. People have filed at the beggining of the year and have been approved already. Also some audits approval from replies made on nov/dec 07.

Guys, Please do not ridicule saralayar. he has raised a very valid point. We are so involved with the GC issue that we are not able to think beyond that. I do agree with the fact that IV is so preoccupoed with GC crisis that there is no point (or bandwidth) to raise citizenship issue. I have seen so many of my friends who came with me in US 8 years ago and are citizens by now but I am still struggling with GC with no hope in site. Sometime, I think, by the time, I will get GC (if I), they will become sr citizen :) it feels very bad but cant help it.

Accenture and other big firms will survive without H1b by recruiting GC holders ,Citizens, L1 and B1. So there will not be any long term impact because of this bill. Still most of the H1 cap will be filled as the companies will try to comply the regulations. I do not see any issue in proving that no USA workers available if it is really the case. Right now if H1b and US worker is available with same skills Indian companies are purposefully avoiding US workers for obivious reasons. We everyone aware of it. Because we are impacted personally we are opposing this bill. This attitude will not win. We should be ready for some compromise if deadlock

With the green card backlogs, a lot of companies have many employees on H-1B status, waiting for their green card. As such the ratio of people on H1 to green card is increasing. Why do you want to punish the employee on H1, waiting for the green card for many years, because of retrogression? I am not able to understand the objective and rationale of your suggestion?

So in essence, the bill says that as soon as you employ someone on H1, you have done something wrong. Even after listing the job on DOL website for 30 days and going through all the other stringent requirements, is that how it should be? When an employer hire an employee on H1, the employer is paying filing fee, lawyer’s fee and 8-10% taxes for hiring each employee. This "Investigation" and other stringent provisions to make it impractical to file H1 is simply to destroy H1 program. For now you may see the bill as to how it best suits your individual situation and then you may suggest how it further fit exactly into your situation before coming with an idea, like the one you suggested, but the bottom line is, this bill makes entire H1 program "non-workable" as mentioned by the administrator. Hi folks, just as predicted, my email thread to select contacts resulted in one outright racist response. i dont want this group to get distracted or distressed if you too get such responses. take a look at the original note below and my response. remain brave. remain strong. this is a LEGAL immigration process in the US economic interest too.
hopefully people will begin to realize that anti-legal-immigration is just a facade for deep rooted racism.

I have to let you know that not only will I not support this bill, but I am vehemently against the legal immigration of workers that are originally brought here to usurp positions that would have otherwise been held by skilled Americans. I agree that this is a racist and exclusionary position, but I also know many people who can no longer get work at the level they deserve due to the displacement they have experienced as a result of this foreign worker influx.
Please remove me from any future posts regarding this or related issues.

i will not dignify your self avowed racism with the erudition of economics, capitalism, innovation, globalization, human rights or the rich history of the united states as a melting pot of cultures ... all of which are underpinning factors that are in the long term US economic interests in high skilled LEGAL immigration. of course, these tend to be conveniently ignored on the altar of superficial sentiment, myopic protectionism and deep-rooted xenophobia.

We EB3 folks are not requesting for EB2 visas. We all will be happy to get 50% EB1 spill over visas. The other 50% can go to Eb2s.
right now 100% of EB1 spill over is going to EB2.
Allocation of immigrant visas is not a policy matter. It is based on law. Any change should come thro law change. Congress (&president) has to amend the law (INA) how to modify the allocation. It is not a simple matter. Both DOS and USCIS knows it unfair to keep EB3-IN in 2001; but they can't do any thing. Thats whu EB3-IN folks should try hard to make the congress to change the law. Contacting DOS or USCIS not going to help, as they have no authoity in changing the allocation methods (they only execute the methods).

In this thread we have more than 60 people willing to help to get this issue resolved. We can put a vote and see how much we can collect for this cause. I am willing to contribute $100 especially for this issue lobbying beside my monthly contribution which is a general contribution. I do not see much of initiation or participation of seniors or Admin in this issue(They are working on a bigger issues). We need to take a lead and see if we can get any help from people like Ron even if it involves a fee.

I think current mad rush is because of following reasons.
1) Atlease 35K new H1s filed because of H4-H1 conversions. This is because of retrogression and H4s waited longtime to work and so they are desparate to work. We can eliminate this if we have I-485 filing provision without visa number availability provision of STRIVE act. These people deserve it until there no solutuon to Retrogression.
2) 70K visas are filed by Offshoring/Outsouring firms firms. This is where the actual problem is. They won't send all of them whom they file. They will unnecessarily waste all these H1s after getting approvals. I know so many visas are wasted by Satyem, Wipro, TCS, Infosys, Accenture and all other offershoring/outsourcing firms every year.
3) 15K-20K by US educated students. These are deserved to file.
4) 10K - New H1s for real projects needed by clients. These are also deserve to file for H1.
So, here the problem is Offshoring/Outsourcing firms who are abusing the law by filing and not sending all of them. I can definitely say 85% visas filed by these firms every year are wasted and they won't send all these employees whom they file. They are using this H1 as seat reservation in a bus/train. They only send very few and waste so many visas every year. In all these firms, i know so many employees are having H1 stamped and waiting to come here. But those companies selects very few and send them here. If at all we need any reform in H1B, then it is here by not allowing H1s from these Offshoring/Outsourcing firms. Then everybody will be happy. These firms can use only L1 for their company needs so that H1 won't be abused.
Also, first point, we can solve by passing the curent version of STRIVE.
So, we need to oppose this new H1B reform and make to sure that Congress passes STRIVE act provisions.

Let me guess. You have a friend or a relative in the H1 que. And this H1 applicant is either getting education in US or is not going to be an employee of a consulting firm.
Second guess: You have a US degree or you are not working for a conslting firm.
Why do you think the spouses on H4 do no deserve H1? If they want to work, why do you think that they should not compete in the job market?
BTW, the companies you are cursing, TCS, Wipro, Satyam etc., it is possible that soon the H1s applied by these companies will be exempt from numercial limit. Yes, you heard me right. Here is a bill that would make companies providing scholarships to undergrad and grad programs to be exempt from H1 numerical count. This is not a joke, read for yourself: :p
