on a different note, how is the Kolkata consulate doing on PIMS aspect ... am planning for a visit back home and need to go for visa stamp as well - last stamp expired ...

It's always a good practice to take a receipt notice of any action done by your lawyer & keep that for your records.
When you apply for EAD, soon USCIS will ask you to do fingerprints(BIO-2). I think you missed that part and it might be denied or void as it was left for so long!
You can file for new EAD online at https://efiling.uscis.dhs.gov/efile/InteractionMgr?interactionmgr.interaction=SetupEfo rms×tamp=1127234762990
Create your account & you can file your self with out lawyer's assistance. It's always suggested to file EAD(I-765) & AP(I-131) jointly. You can pay by credit card.

(3) You have to send supportive documents for Advance Parole, like photos,brief explanation of qualifying for AP...I can give you those sample formats !
Coming to I-485 BIOMETRICS, call USCIS & ask them about BIO. Go to this website & register https://egov.immigration.gov/cris/jsps/index.jsp. You must add I-485,EAD,AP & I-140 receipt numbers like LINXXXX and you will get emails when they get approved. You can also see the changes on 'LAST UPDATED' column, which means your case is touched by an officer. But it's not the confirmation of approval until status message has changed or you got an email.
Go thru these 2 links & familiarize well. Hope your I-140 has approved. Finally these are suggestions only & I am not a lawyer. Consult an immigration lawyer if you have uncanny issues.

Mine seems to be few of last applications entered in system during July 07 visa bulletin fiasco(rather fiesta). My Notice date 10/17. I have not seen July filer notice date, later than this...
My notice date is 10/10. It seems cases are approved based on the notice date. My case was transferred from CSC to TSC. You are right that only few cases have Oct notice dates.

My priority date is current now. I read somewhere that I have to file I-485 between June 1st and June 30th. is this correct?? what if my medical exam results are not ready and I am not able to file before June 30th?? can I still file during following month, July?? Please help. Thanks

The flowers are by no means a complement. They pass them to other people and basically, they are forwarding the shame to them as well. Whoever receives it would feel offended. Don't you think so? :rolleyes:
If this is not the paramount of their stupidity, I do not know what else is. Oh wait, it is USCIS... who knows what other crazy thing they may do. :D
This is just getting better and better... Make sure get a screen print for future reference. Maybe a message should be attached to the flower too so that no matter who receive it, they will know who and what that is for. :D

If you want to change the employer with in 180 days of filing 485 - there is a risk involved. If your 485 approved with in the 180 days then you will get in to trouble. If your 485 is pending more than 180 days - irrespective of when you changed employer before 180 days over or after 180 days over are does not matter - and you will be safe.
If you change your employer with in 180 days - then you have to pray to the GOD for not getting approval with in 180 days of filing.
I think it answers lot of lenghty questions either one way or the other.

My Guess is , It is a rumour . since the USCIS suspended the I -140 Premium Service for the month of july . It clearly indicates they are aware/expecting many of the I -485 filings from July 1st and do not want to promise I- 140 decision in 15 days during July .
Yes, I am of the same opinion. USCIS wants to stop the premium processing for I-140 only because it anticipates large volume for I-485. I don't see why it would stop the cash-cow (premium processing) and stop taking I-485s too!!!

I am surprised to see this thread active this long. Earlier I have with help of Saralayar and other members have bring this point to attention. But at that time no one was supporting Idea.
I see increasing support for the Idea as GC journey become longer and longer.
Earlier I have pointed following points that I want to bring to remind if we want to get real support for this idea of early CITIZENSHIP AFTER GREEN CARD
(1) I-140 and I-485 must be approved.
(@) Time should be considered only after getting GC
(3) For getting closer for political support our proposal should be close to Existing laws for FAMILY BASED and MARRIAGE BASED CITIZENSHIPS
So we should argur that if YOU HAVE MASTER AND ABOVE IN STEM FILEDS YOu can get CITIZEN SHIP 5 yrs from date of Approval of I-140 ( which make it closer to fmaily based) and THREE YEARS from Date of Approval of I-485 (closer to marriage based citizens). You can get earlier of two . But when you get Citizenship your I-485 must be approved for ATLEAST 1 year.
The above requirements can get closer to Marriage and family based and also help 90% of IV members.
Adding the clause for the EDUCATIONAL THING might be able to get more political support also

Most of the delay (after the labor) is in I485. Some people wait more than others and any timer that starts AFTER approval of I485 is not useful to those who already wait longer term on I485. Moreover it is I485 process that is most screwed up for the lack of better word. People with PD 2006 got the GC last year while people from 2002 are waiting in the SAME category , from the same country.
REQUIREMENT of masters degree may be a convincing factor in your opinion , but that excludes certain members of the group.
The 485 approval is just an adjustment of status. Technically approval of I140 is when you are approved to be a resident (Assuming no criminal record etc).

As I've mentioned in Rolling_Flood's thread, this issue has some merit and needs to be discussed. My personal take on this is that if you were eligible for an EB2 position at the time of filing the EB3 petition, you should be allowed to interfile.
I'm probably not going to participate in the lawsuit because I don't want to divide an already weakened community. Neither will I try to stop it because I think it raises some valid questions.
I personally think that IV needs to make some changes and the first step would be to stop quoting figures like "we have 25K members" when the reality is that hardly 200 people participate in the call campaigns and it was due to random strangers that we were able to collect 5000 signatures for the administrative fixes. Most people come to IV to get some easy answers or to pass time by playing some games like the visa bulletin predictions game or the identify the TSC approval pattern game, etc. Only the core is working relentlessly for us besides a handful of volunteers. I think that there are enough agony aunts for immigration issues and IV should be exclusively for immigration related lobbying and legislation. It's the only way we can get rid of the 25K - 200 people who do nothing and then focus on the real issues.
