    source is USCIS Ombudsman

218,759 EB visa numbers available for recapture since 1994. See Page 34 in the report for the full breakdown. Click on the link for the Ombudsman report (http://www.dhs.gov/xlibrary/assets/CISOMB_Annual%20Report_2007.pdf) May 2007.

What is the source for the number 218,000? Is this purely speculation or in some official reports? USCIS Ombudsman report, some official USCIS publication or from any other organization?

    Thanks!

gc_chahiye is correct - this is precisely why my lawyer advised me not to go with 2nd set of 485 + if one gets rejected the other one automatically gets rejected (when both are combined)

We decided to go for 485 that had older PD

I know someone who applied for 2nd set and then withdrew the 2nd application as soon as he got Receipts (his application was in Neb and wife's was in Texas << this could lead to major delays as the files are now physically located in different centers)

With all the confusion and movement of applications to different centers... things can only get complicated in my opinion. One can only hope for the best

why would the second app be rejected automatically if the first one is rejected?
Combining them simply puts them all into a single file for USCIS to follow up on. They are still individual files, based on individual I-140s.

AMY GOODMAN: In the beginning of the broadcast, we played a clip

    LOU DOBBS: Sure.

AMY GOODMAN: of you talking about various concerns that you have around immigrants.

    LOU DOBBS: Sure.

AMY GOODMAN: The last part of that clipand maybe we can play it again

LOU DOBBS: Illegal immigrants, if I may, Amy.

    AMY GOODMAN: Illegal immigrants.

    LOU DOBBS: Only illegal immigrants.

AMY GOODMAN: Maybe we can play a last part of this clip that we played, just to go through it again. Well see if our folks have that clip ready. And this is the clip that we played in the billboard. Its

LOU DOBBS: Well, I can recall what was said if its at all helpful. I said that according to a studyI didnt use the attribution, but according to a study that Jorge Borjas at Harvard University had completed, that the cost of excess immigration into this country amounts to $200 billion a year in wages, that the cost of incarceration, medical care, social services approximates $50 billion in this country per year. And the reality is that about a third of the crimes that are of those in state prisonsfederal prisons, excuse me, federal prisons, areIm sorry.

    AMY GOODMAN: Are?

LOU DOBBS: Are those who are in this country illegally.

    AMY GOODMAN: Lets play it.

    LOU DOBBS: Sure.

AMY GOODMAN: And then lets talk about it.

Lets say the number is eleven million, although some studies put the number as high as twenty million illegal aliens in this country. That not only amounts to a shift of six to ten congressional seats among the states based on the population of illegal immigration. The fact is, those illegal aliens are costing our economy $200 billion in depressed wages for working Americans. It is costing $50 billion a year in social and medical costs. And its costing us, no one knows precisely how much, to incarcerate what is about a third of our prison population who are illegal aliens.

AMY GOODMAN: So, Lou, you said a third of the prison population are illegal aliens.

    LOU DOBBS: Right.

AMY GOODMAN: The fact is, its something like 6% of prisoners in this country are non-citizens, not even illegal, just non-citizens.

    LOU DOBBS: Right.

AMY GOODMAN: And then a percentage of that would not be documented.

LOU DOBBS: Well, its actuallyI think its 26% in federal prison.

AMY GOODMAN: But you said of all prisoners.

LOU DOBBS: I said aboutyes, but Iand I misspoke, without question. I was referring to federal prisoners.

AMY GOODMAN: But you didnt say that, and so it leaves people with the impression

LOU DOBBS: Well, I didnt, but then I just explained it to you.

AMY GOODMAN: But you have a very large audience on CNN.

LOU DOBBS: I have a very large audience and a very bright audience.

AMY GOODMAN: And you told them that a third of the population of this country are illegal immigrants. 6% , which is under the population of immigrants

    LOU DOBBS: 6% , right.

AMY GOODMAN: in this country, of prisoners

    LOU DOBBS: In state prisons.

    AMY GOODMAN: are immigrants.

LOU DOBBS: In state prisons. In state prisons.

AMY GOODMAN: No, 6% overall are immigrants. You said 30% are illegal.

LOU DOBBS: Well, I think weve establishedwe could sit here and say this all day, Amy. The fact is, the number is 26% in federal prisons. Thats what I was referring to. I did notI misspoke when I said prisons. I was referring to the federal prisons, because thats the federal crime: immigration. And that

AMY GOODMAN: Have you made a correction on your show to say that 30% of?

LOU DOBBS: Im sure we have. Weve reportedabsolutely.

AMY GOODMAN: We didnt see it.

LOU DOBBS: Do you know how many reports weve done on illegal immigration in this country?

    AMY GOODMAN: Yes, many.

LOU DOBBS: I mean, my god.

JUAN GONZALEZ: Yeah, but Id like to get into this issueI mean, aside from the fact that the GAO report

LOU DOBBS: Excuse me, just one second.

    JUAN GONZALEZ: Sure.

LOU DOBBS: I mean, what if I were to sit here and just hound you because you said I was anti-immigrant, when I am, point of fact, Im anti-illegal immigrant, and its absolutely a matter of fact. We could quarrel over the terminology, if you want. But why should people of good faith and intelligence sit there and be so absurd about it?

JUAN GONZALEZ: No, we agree on that. But this is precisely the lumping of illegal or undocumented immigrants and legal immigrants in one category thats a problem

    LOU DOBBS: Right.

    JUAN GONZALEZ: because, for instance

LOU DOBBS: Right, I agree with you.

JUAN GONZALEZ: the total percentage of the non-citizen population of the United States right now is about thirty-five million, 12% of the population.

LOU DOBBS: Do you know this?

JUAN GONZALEZ: Well, this is Census Bureau

LOU DOBBS: I was justI was just

JUAN GONZALEZ: Wait, wait, Lou. Let me finish. Let me finish, Lou.

LOU DOBBS: I have to say, I was laughing about the NIE, because, as you heard Steve Hadley talk about

JUAN GONZALEZ: Lou, let me finish.

LOU DOBBS: high confidence levels in those estimates,

JUAN GONZALEZ: Right, but let me

LOU DOBBS: What do you suppose the confidence level is of the United States government in the number of people in this country illegally, the number of people

JUAN GONZALEZ: Were assuming nowthe legal population is pretty well documented, right? But the

    LOU DOBBS: Documented, undocumented.

JUAN GONZALEZ: The legal immigrant population is pretty well documented. Its about twenty-three million. And then you add maybe another eleven to twelve million of the undocumented population, and you get thirty-five million. The point ismy point is this: if 12% of the non-citizen population of the United Statesnon-citizens comprise 12% of the population. They comprise 6% of the prison population. That suggests to me that crime rates are far lower among non-citizen immigrantslegal and illegalthan they are among the general population of the United States.

LOU DOBBS: Can I ask you a question?

JUAN GONZALEZ: You have raised the issue of crimeyouve raised the issue of crime in relationship to immigrants.

LOU DOBBS: Well, silly me, silly me. MS-13, all sorts of gangs. You know, the fact that Mexico is the largest source of methamphetamines, heroin, cocaine, marijuana entering the United States. Silly me for bringing up crack.

    AMY GOODMAN: But, Lou

LOU DOBBS: But may I ask you a question?

AMY GOODMAN: I think you agree

LOU DOBBS: May I ask this question

AMY GOODMAN: I think you would agree

LOU DOBBS: May I ask this question

    AMY GOODMAN: that facts matter.

LOU DOBBS: Of course, they do. Absolutely.

    AMY GOODMAN: And so

LOU DOBBS: I am an empericist to the bone.

AMY GOODMAN: And so, if 6% of prisoners are immigrantsdocumented and undocumentedand you said 30% of prisoners, a third of the population of prisons in this country, are prisoners, it conveys a very different sense.

    LOU DOBBS: Different meaning.

AMY GOODMAN: And as youve pointed out

    LOU DOBBS: I agree.

AMY GOODMAN: youve done hundreds of shows on these issues.

LOU DOBBS: More than that. More like thousands.

AMY GOODMAN: And that reinforces the feeling that people have, who watch the show

LOU DOBBS: So, your point is?

AMY GOODMAN: either they believe you oreither they dont believe you, or they believe you and are being fed wrong information.

LOU DOBBS: Well, I dontyou know, I think its important for all of us, because, as you say, Imwere all interested in the facts. So let me ask both of you, please, a question that seeks a fact: Does the United States government and do state governments inquire of their prisoners as to whether they are legal or illegal, and can they under the law? Or are these estimates that were talking about?

AMY GOODMAN: Well, if the government doesnt know, how do you know?

LOU DOBBS: No, thats as straightforward question.

AMY GOODMAN: How do you know?

LOU DOBBS: Well, because in the federal prisons, they are permitted to make a decision as to whether or not they can ask if theyre citizens or non-citizens, but cannot ask if theyre legal or illegal. So it is, at best, a projection. When Juan says eleven million to twelve million illegal aliens, you and I both know that the Bear Stearns study suggests twenty million people. There is no one in this country todaythats why I referred to the National Intelligence

AMY GOODMAN: And the Bear Stearns study has been critiqued over and over again

    LOU DOBBS: By whom?

AMY GOODMAN: by the top economists.

    LOU DOBBS: Oh, come on!

AMY GOODMAN: Bear Stearns study, saying it is wildly exaggerated, that their

LOU DOBBS: The National Intelligence Estimate is closer probably on Iran today than it is on the makeup of the US population today. I mean, if you want to talk about this nonsense, I mean, thats what it is.

AMY GOODMAN: Lets go to break, and well come back.

    LOU DOBBS: Sure.

AMY GOODMAN: Our guest is Lou Dobbs. He is the well-known anchor of CNN Lou Dobbs Tonight and has written a new book called Independents Day. Well be back with him in a minute.

    [break]

You want to foreclose for a matter of 20K -- I'm really surprised by your thinking process. Based on it, I would assume you had a zero down loan.

In my opinion and this is my opinion only ( and this is only from a financial perspective only ), taking a hit on your credit report for 7 years for a 20k monetary hit doesnt make sense.

the moral , ethical part of it -- well there are quite a few folks on either side of it and I'll let them continue arguing for/against it :-)

    hey walden

for some reason, the pdf file is not opening....I will do the flyer posting wherever I can.....We should also probably write up a mail that can be mass mailed to recruit the many who are affected or may potentially be affcted by this issue, or whose loved ones are affected. We should also do a smart media camapaign- even try to draw attention of network programs like 20/20 or 60 minutes that have a mass impact- to the really tragic situation many ppl are in (esp. one case from the last board comes to mind- of course we have to be ultra-sensitive about privacy and other sensitivities of the individuals involved).....getting the attention of the major networks may not be as far fetched as it seems- much less worthy causes have been championed by these programs.....if we articulate it well to the producers involved, with the right mix of facts and the personal, I believe many will consider it seriously, even though immigration is a complex issue to many....like i said we shd not underestimate the american sense of fairness, and we have a very good cause where we need some of it.....it will appear dreadfully unfair to many that people who have been paying social security taxes for 5-10 years are not even allowed the security of knowing whether they themselves will be eligible for it when they need it! That notion will give a jolt to most unbiased americans who typically associate immigration with people sponging off the system

Hi vikki76, bpositive, dipika, caliguy, leoindiano:
If I am correct, your PDs are current, right? Do you guys know if your case was pre-adjudicated and/or assigned to an IO? I keep reading from the forums that some apps with PDs as late as Dec 2004 and a couple of Jan 2005 got approved. Wondering why the earlier (eg. mine is July 04) not approved yet. Could we all join togther and write a letter to Napolitino(Thanks to SoP for the idea) and ask her to take some action on our cases?

Its current. and my case was pre-adjudicated on feb 20th, 2009, assigned to IO on sept 17th 2009.

    Sept 4th, infopass 1 - all clear, pre-adjudicated on feb 2009.
Sept 7th to 15th - 4 SR's - No Response on any of them. all CSR's told samething, everything is clear except FP, opening Request to send them to you.
Sept 15th - Lawyer's email - Not sure if this helped, But, exactly after this, it is assigned to IO.
Visa Numbers are out for Fiscal Year 2009.
Sept 22nd - infopass 2 - both apps with same officer, please wait
Sept 25th - FP notices arrived on 25th, with appointments for oct 21st,
Sept 29th - did a walk-in for FP at local ASC and got it done early. So, it clears the way for october.
Sept 30th - there was a hard LUD, may be coming out of FP uploading.

Got this reply from Senator on 29th.
    --------------------------------------------------------------------------
These I-485’s are based on the principle’s approved I-140, SRC0XXXXXXXXXX as a 2nd preference from India with a priority date of 11/19/04 and there is a current visa available.

TSC is currently processing I-485 visas based on filing date order. There are a large amount of cases that are being worked and these cases will be worked in receipt date order. With the limited amount of visas that are currently available between now and September 30, 2009, there is no guarantee that these cases can be completed before the end of FY2009. It is estimated, that in general, these cases will be completed between 45-90 days.
    ---------------------------------------------------------------------------

Since, apps are with IO now, i am restraining from doing any more inquiries. The only hurdle we knew, FP is now complete.

my case is TSC - EAC - TSC transfer case. original receipt date at TSC was august 3rd 2007. transfer from EAC to TSC receipt date is oct 11th 2007. ND Oct 16th 2007.

What are you talking about? this is not a good news, we will decide that after May Visa Bulletin. For now just read that as a publicity stunt from lawyers and forget about it.

    MC

Most of these immigration lawyers are having hard time these days and are not making as much money as they once used to. This could very well be a publicity stunt for creating a scene that eb2 is going to move very fast so that more eb3 will work on porting, thereby making big bucks for lawyers. Wait until you get your greencard in hand.

yes if you are filing another 485 with your spose as primary and you as dependent..
you need to fill out A#'s assigned with first applications..

if both r filed on the same day ....then there is no way u can mention each other on application...

my lawyer said if if it is filed like that ...u can combine the two applications when u get the receipts...

Vonage's cancellation early termination charge is $39.99 + Some admin charges = $45.

The $100 you are talking about is when you sign up and also ask for the router from vonage. what I did was went to craigslist and bought the vonage router for $15 and signed up for vonage. They sent the cancellation policy and charges by email which is somewhere between $40-$45.

I was earlier their customer when moved from vonage to T-mobile @Home. After a little argument they waived off the early termination charges and now because of the good customer service I joined them back. As by joining I got a free month of phone service as well.
I would say the reps on the other side also human being and depends on how one goes on to put up their point in the most polite manner without hurting anyone or anything in the process and results are always fruitful if the conversations are driven the right way.

Overall for me to make calls and recieve calls without any hassle is the key and I think vonage is pretty good at it. Moreover they moved their customer care I think moved back in US from phillipines as this time the conversation was smooth and didn't have to repeat the sentence again or didn't have to ask to say again.

Also I don't care if any competitor comes up with a $2 less + some more feature. Quality is the key and I think vonage beats everyone in that. I had a tough time fixing up my fax machine wiht sun rocket once upon a time and cancelled my service with them for that reason.

Vonage has a contract of 1 year. Have to pay around $100 if you break the contract.

Lingo has a contract for 2 years. Will have to pay a similar contract break fee for Lingo as well.

Monthly charges for world plan: Lingo is cheaper than vonage
Voice quality: Vonage is slightly better than Lingo. Lingo is ok too.
Customer service: Vonage is better than Lingo
Contract Period: Vonage 1 year. Lingo 2 years
Plan selections: Lingo has more plan selections.
Cheapest plan: Lingo $7.95/month for 250 minutes america plan. Vonage $17.99/month for 500 minutes US plan

Based on the criteria above I dont see how it is illegal to ask what type of work authorization one has, and if EAD , how long it is valid. It may be illegal to disqualify a candidate who has EAD with validity for the required amount of time. But I sure can ask about the details within legal limits, can't I?
    -------------------------------------

It is illegal... On I-9 it clearly says that an employer can not deny employment because of an expiry date on a valid work authorization document. This makes sense, since the employer does not have any authority to check for this candidate's ability to renew the authorization, neither the candidate is obligated to share that information. Per DHS & DOL once you have valid EAD, you are good to go! I am curious though who should be responsible for educating these employers!

There are lot of people losing jobs because of L1. I totally agree with L1Fraud that we need to expose this racket and make sure everybody is following the rules, period....People like ganguteli must be on L1 and they will always support to continue this fraud. Bringing people on low wages on L1 is causing lot of pressure on salary and I have seen whole floors being replaced from this so called highly skilled people on L1. I'm not against immigration but against people/companies breaking the rules..

L1Fraud - Can you post on how to go about reporting this fraud. I know you mention about ICE? Do you have a format of letter and any suggestions on how to kick start the discussions and investigation....

All right, looks like we got (or will get) some attention from media. DOS and USCIS got (or will) it too. That's good. They will forward flowers to hospital, and this is good too (hate to waste flowers)! Bad, if they will not strip messages from buckets, veterans do not need them at all, BUT if they decided to take messages off ... just picture that USCIS will stuck on forwarding flowers instead of doing their job. Who will win?
All right, what next? If BloodDrive will not work, I suggest we have to offer BRAINDRIVE :) Any leaders? :)

I got my I-485 approved one hour ago. I got text messages for me and my family and the USCIS online status changed to CPO.

Opened SR on 09/03. No response yet.
Took Infopass on 09/08 to track my application. Infopass helped me to know that my application was moved to Examination unit on 08/27 and on the way to IO's desk.

    PD: 27th April '06
    Service Center: NSC

Thanks to IV and all other folks in the forum for the valuble information.

I am sure everyone before PD 8th May '06 will get GC's before end of the month.

I don't understand where is the conflict here. The website above - ALIPAC - is "Americans for Legal Immigration". From what I read in their website, they want to stop illegal immigration and they support legal immigration. Unless they have a hidden agenda, they should be supporting IV's letter campaign.

How is this in conflict? Am I missing something?

I dont know too much about the conflict but the first post on the site says this:
Immigration Voice is starting a massive campaign to make it easier for immigrants and those on non-immigrant visas (H-1Bs, L-1s, F-4 students) to get green cards --- furthering the displacement of skilled American workers (programmers, engineers, scientists, etc.)

So, I'm passing along this suggestion from another group:
Please read the email below, and I ask you to cut/paste their letter text, and then
customize it (which is to say reverse engineer it) asking them to CLOSE
the door, not open it wide. We must act NOW to counteract their
    campaign.
