Here is what my attorney said.
"Completely false rumor. Legally impossible for retrogression to occur prior to Aug. 1. You'll be getting a Breaking News from us on it today or tomorrow."

Wish the statement from your attorney is true and we all will be able to file 485 through the month of July with no issue. I'm luckly to get the paper work done and ship the package to Attorney and waiting on their action, But have few friends who could get Medical Appointment only around second/third week of July. Also this EW Other Worker Quota that became unavailable and also rejection of these applications has made us worry a lot, although it is a diffferent category we are at fear that this could happen to us. Reading the VB again, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002... So this category has only 5000 Visas and I'm not surprised this bacame unavailable and think this category is far more crowded than others... We should be fine atleast in July... May be too optimistic... but nothing wrong in hoping for the best and wish all the members can file asap.

I have submitted my wife's passport for renewal by express mail during 1st week of October. I have not heard anything from them and not able to contact them by phone.
It is reassuring that it is not me alone..

    Totoro,
You have an 'omnibus package on Immigration' proposal in your hand if you collect all the ideas and create a letter. It has too much pork. Just have a simple proposal that is enough to satisfy the appetite.

Instead of trying to include every idea, just focus on the main ideas on IV website by IV core and meet the lawmaker.

Just copy paste from this page and ignore everything else.
    http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47
    1) Green Card Delays and Backlogs :
    2) The Per-Country rationing of green cards that exacerbates the delays :

It seems people are thinking that you are going to meet lot of lawmakers and do some big level lobbying for everyone. From what I read , you are simply going to meet your lawmaker office/s. It is not such a big deal. It is only a big deal for people who do not know about it. Most people are scared to do anything themselves and try to rely on others to do it for them. The other day I saw this link on IV http://immigrationvoice.org/media/HowTo_Guide_MeetLawmakers.doc and I got so much information and interest in meeting my lawmakers. It is not at all a big deal. Folks you and I can also go and meet our lawmakers too. I am ready for it. Let us all try to do that ourselves and meet Senators of our area.

We reached the gurudwara at 4:30 AM only to find that the building said "Catholic Church". Since it was a pretty large compound we thought that the gurudwara might be one of the buildings in the compound or shared by the Catholic Church. So we waited for the gurudwara manager to arrive.

After about 20 mins, I got a call from the manager asking us where we were. I told him that we were at the parking lot. He sounded surprised and that's when I realized that there was something wrong. I asked him for the address and it turned out to be 3801 instead of 3810 (where we had parked). Lucky for us it was just across the street!

The manager was very helpful. He even prepared tea and got us donuts while we freshened up! Not just that; he woke up at 4:30 AM and drove to DC from Virginia to open the gurudwara for us!

After going through our daily lives, we tend to forget that there are such nice people in the world!

I just don't see why you jumped all over the guy. The lawyer told him something that he thought was horrible - and rightly so, based on the info provided to him by the lawyer. So he posted that, in hopes to inform his fellow members about this situation, and probably he was hoping someone would confirm or disprove that. Instead everybody jumped all over the guy. We may all be stressed out with all this CIR / July bulletin roller coaster, but let's not too crazy and devour one of our own. He ain't the one who caused you the pain in the first place.

    Peace.

Every one is here is emotional, after seeing the beautiful collective work of USCIS/DOS/DOL/AILA ect.. Now AILA is jumping high between sky and earth and due to the mismanagement of system. Everyone knows both USCIS/DOS is mismanaging the process. However, What AILA was doing when DOS issued the visa bulletin 15 days back? Do you thing, AILA did not know the estimate of number of 485s going to be filed in the month of July? Why did not they call USCIS and DOS about the implication of making all categories current? Why did they not advised their client that there is a mistake in VB, it is not possible it will become current in just one month? All of sudden, why they are jumping and collects all the money from customers to file 485?

Here is my estimate how many 485s is going to be filed in July.

BEC has almost cleared all the backlogs. The rough estimate about 200,000 LC might have been certified by BEC. Lets assume about 150K out of 200K candidates held back due to retrogression from 2004 to 2007. Let us assume 150 K PERM LC certified between March 2005 and June 2007 affected by retrogression. Therefore about 300K (primary) people will go for 485 in July. If we add dependents it will be another 450K. Therefore about 750K 485s+ 750K AP + 600K EAD applications will be filed in the month of july.

If 750K 485s filled in one month, we need about 5 years sum of EB visa numbers. It needs 5 years to issue the visa. There should be 750,000 EB visas should be immediately available as on July, to make all EB categories current. There are only 40,000 visas available as of June. Does AILA do not aware of this simple estimation?

There are 40,000 eligible/approvable 485 are currently pending with USCIS. The composition of PD and country of chargeability may vary between 2001 and 2007. In order to issue 40,000 remaining visas to already pending 485s they made all categories current, otherwise it will get wasted. In order to approve a 485 the PD should be current. Thats why they made it current. It is not for accepting 750,000 485s, when available number is just 40,000. AILA should have aware of it and advised the USCIS/DOS and customers properly

I came to USA 7 years ago and still waiting for my GC. But I bought a nice home after 1 year, simple reason that I can claim the taxes & mortgage interest. Also I was bale to put my kids in a good school district. Who cares if I get GC or not, that is not my end of my life. Myself and my family live a happy life in a 4 bedroom house with big backyard and have the peace of mind, after all what we are going to take when we leave this world. Let us enjoy the life

this is not just a question of depriving those who did not come.
let's please recognise that many people did have genuine compulsions as well.
the more important issue at hand is that sensitive information should not be released on an open forum. state chapters are free to organize live meetings and brief their members on lawmaker meeting experiences. those who attend chapter sessions are welcome to participate and learn- and join in for future meetings which should continue at the district/state level.

My wife is on H4 visa with a valid I-94 (till Feb 2009) but her status will be on H1 from Oct 1st, 2007. Do we need to go for stamping before she starts working. Also who applies for SSN - Her employer and do we need to file ourselves. The employer kept the original H1. Do we need the original to apply for SSN? How soon can we apply for SSN?

    Thanks in advance.

How much of a chance does she have to have her form I 539 approved now? Any response would be very much appreciated.
    Thank You
Contact a good immigration attorney immediately. Being out of status is a serious violation and her access to US can be restricted due to this. I doubt very much that her 539 will be approved.

    Hello,

My PD has become current as of june visa bulletin and I am eligible to apply for I-484. But currently I am expecting and hence I may not be able to take all the medical exams (X-Rays etc..). Can I still apply for 485 and complete the medical exam later or do they need the complete medical report when I apply for I-485. I would appreciate if anybody can share any info in this regard. Thanks.

I am currently on H1B visa. My understanding is that as long as my H1B is thru my employer it is perfectly legal to start/buy/partner in a company .... as long as I do not withdraw a pay check from that company. Furthermore, as long as I am maintaining my legal status thru my American employer, it would be legitimate to sponsor an H1 for my wife, hire her in the company I own. If some one could clarify ..... is my understanding flawed ? Please provide examples/experiences. Any relevant input would be great.

Another related question was if I change my status after starting my company to F1 .... would that be fine ? Or after I change my status to F-1, would it be fine to start my own firm/company/partnership/practice (PA/LLC/PLLC) and then transfer my wife's H-1 B in this newly created entity. FYI .... This new entity would be perfectly legitimate PA/LLC/PLLC with solid revenues/earnings/5-10 american employees .... and my wife would be fully qualified to work in this entity as a highly compensated employee providing US govt with a lot of taxes .... all done by my savings AND/OR bank loans.

On another note, if I change my status to H4(dependent on my wife's H1) instead of F1, would the same hold good. My wife's full time H1 B would be thru an american employer. My PA/LLC/PLLC just sponser her part time H1 (2nd H1) .... you guessed it .... to start her permanent residency process. FYI .... Both of us are waiting for priority dates to get current to file I-485 .... both of us have I-140 approved from our respective employers as of now. This is an attempt to get out of their yoke and gain freedom as much as possible in these trying circumstances.

Gurus, your expert opinion would be invaluable. Please comment.

I just wanted to say that the rally, all the pre-rally prep, and meeting with lawmakers was such an intense and exhilarating experience! I feel so priviledged to have met some of the core IV people - I felt like a groupie meeting superstars! They are truly inspiring... There were so many other wonderful people I had the chance to meet who now make my wait more meaningful. It was such fun getting to know all of you and sharing the experience. I have wonderful memories of the entire event...

My attorney sent an email inquiry to DOL regarding my case. Within less than 12 hours a response was received -

It sounds like a pre-written text that goes to every inquiry they get.

Thanks for sharing your experience, I dont buy into their FIFO process. May be its applicable in the Non-Audit cases but cases that get audited are just being piled up at someone's desk and that person is most likely dead (does not exist)
