    Infact my 485 got denied in August 2009 and in september 2009 filed MTR,which got approved on 22 sep 2009 and today we got 485 approval emails.

    just curious...

    I like IPAs...Iam in seattle, they have this nice brewery (Pike Place Brewery), the head brewer over there, split open a new cask of this mild IPA, It had a nice bitter after taste. Kindoff like this whole fiasco (except the nice part)

    We have learned that in all probability House Judiciary committee will finishing marking up HR5882 in the next committee meeting. The bill is likely to be brought to the House floor the following week. We have been told that if our bill(s) pass the House, Senate will include the language of the bill(s) in another Senate bill that has majority support. We must admit that the time is shot but its still possible.

    We request everyone that starting monday, please call all the members of Judiciary committee. Thanks to the members who have already made phone calls to the lawmaker's office. We request you to please call again to show your support starting Monday.

    By the way read INA about this and let us all know if there are specific provisions regarding this " EB1 -> older of (EB2-I, EB2-C, EB3-I, EB3-C)"

    There is no specific rule regarding "EB1-> older of ...", however, DoS made it clear in the Jun/Jul bulletin that the spill-over is given to the oldest first.

    BTW: EB1->EB2/EB3 is actually in INA.

    I think he can just talk the talk.. it takes backbone to walk the walk.

    These people are causing fissures in the community for their petty self-interests... just by plain talk.. It took years to build it.. and we see some hope because of what IV has achieved and things that are in pipeline.

    At this critical juncture, if people are causing rift in the community and trying to sabotage our campaigns then such people need to be challenged.

    if we are united we can achieve a lot!

    We got our GC cards on Friday.

    It seems that USCIS is processing cases which have been pre-adjudicated very fast.

    Good luck to all who have been waiting... there is definately light at the end of the tunnel

    Can anybody tell me what do i need to put on I-765 , Q11, as i am not able to rely on my company's attorney.


    11.Have you ever applied for employment authorization from USCIS?


    As per the following link - http://www.uga.edu/oie/ISSIS/form/Department/PR/Instructions%20for%20I-765.pdf

    it says that you need to put yes and have to attach all the previous 797's.

    But my attorney says that you need to put No. Only those who applied for EAD earlier have to put yes (Which i feel not correct).

    can anybody clarify please.

    Hello,

    I have heard of the TERM 'Interfiling' to port your priority date from EB3
    to EB2. This i hear happens when your 485 is pending with USCIS and
    you have an EB2 labour with current PD date. So you transfer the PD using Interfiling.

    Any one any thoughts or have you done this ?

    My $0.02. This could be a pre-emptive measure on the part of AILA. There must have been some talk at the state department of mid-month regression. This might be a strategy to scotch that. Raise a ruckus and send a message that we are prepared to file a law suit. Who knows? We are mere pawns in this grand game. Whatever happens, I hope people keep some perspective and not lose sleep over this.

    I have a couple of very urgent questions that I want to check with you folks:

    I am currently in the US on L1 Individual visa - my current visa is expiring on the 10th of March. My employer filed for a fresh L1 Blanket Visa instead of doing an extension because I have to be in India for a few days in March anyway. My visa interview is on the 11th of March.

    My first question is: Is this alright? Am I going to have any problems because I did not extend my visa and applied for a fresh one instead? I have just been in the US for 5 months in my current visa.

    Second question is related to PIMS:
    I have had 3 L1 visas till date - first one was stamped in 2003. Second in 2005 and my current one in 2006. I have never overstayed and I was out of the US for 13 months before I came on my current visa in Oct 2007.
    Will I face any delays due to PIMS when I go for stamping on Mar 11? I plan to be back and rejoin work on the 18th of March.

    Is PIMS delaying folks only in case of L1/H1 extensions? Looking forward to your help and guidance. Thanks a lot.

    cut to short the message is for myself---we are still waiting for the visa number and for mywife ---case is under review. hope to wait and see????

    If your Notice date is in Sept 2007, we need to wait for our turn. Look for the NOTICE DATE on your 485 application.

    How to Contact USCIS and FBI to Check Case Status

    1. USCIS Online Status Check
    With a case number, you will be able to see the current status and the last updated date (LUD).

    You can set up a profile, including user name and password, and create a portfolio that includes all your immigration cases. Then log on and see the latest updates on all of them, such as I-485, I-140, AP, EAD, spouse’s cases, etc. Another useful feature for this option is that you can set up an email alert to receive automatic updates. Note that if there is a LUD change, but the message remains the same, you will not receive an alert.

    2. Call National Customer Service at (800) 375 - 5283
    Unfortunately, the customer service representatives don't know much more than what the online system shows. So it is not very helpful in most cases. However, on the phone you may place an inquiry with the service center that is processing your case.

    3. Place a USCIS Inquiry
    If your case is 30 days outside of the current processing dates, you can call customer service ( 800-375-5283) and place an inquiry. The representative will send an online message to the service center, which then mails you a letter in a few weeks to explain why your case hasn't been adjudicated. Recently, the answer is usually "your case is pending security check" or "your case is still within our processing dates."

    4. Talk to a Service Center Representative Directly
    Still by calling 800-375-5283, you will hear a long list of options. Choosing the right options will lead you to the service center that is processing your case. Because each case is unique, you need to listen to the options carefully and choose the ones that fit your case.

    Even if you reach the center, you may be automatically transferred back to general customer service. But sometimes your call will be picked up at the service center. Explain your situation briefly, be polite but persistent, and ask about your case status. They do know a lot more details about your case, but have been instructed not to reveal much information, especially regarding background checks and FBI name checks.

    5. Set up an Infopass Appointment
    An infopass allows you to talk to an immigration officer directly, who has access to more information than the online system. So this is a better option to check on case status. An officer would be able to tell you whether your FBI name check has been cleared. This information alone is worth a trip for many.

    6. Place a Congressional Inquiry
    Writing to your senators and/or house representatives is another good option for people whose cases have been pending for a long time. Go to these websites:
    and find the congressional representatives for your region. Write a personalized letter to briefly explain your case details (a copy of your i485 receipt notice would help), mention how long it has been pending, and ask for his or her help to inquire about your case status. If you are stuck in FBI name check, and have completed an FOIPA request, send in the response as well which might help.

    Some congressional offices are not willing to contact the FBI directly, some will but only if your case is pending for more than one year, yet some will not even respond to your letter. So your mileage may vary. Also you may have to wait several months to receive a response in the mail, possibly due to the increasing number of letters asking for help.

    The FBI has clearly stated that congressional inquiry will not help expedite the name check process. However, due to the lack of communication channels with the FBI, even a confirmation that name check is pending is worth the effort for many people anxiously waiting. Sad, but true.

    7. FBI Name Check
    The FBI is no longer responding to emails sent to FBINNCP@ic.fbi.gov, so a congressional inquiry or infopass with the USCIS may be the only options.

    8. FBI Fingerprint Check
    Call the FBI at 304-625-5590, and a representative may be able to tell you when the result was sent back to the USCIS. Since it is usually within 24 - 48 hours, this is only useful to confirm that FP was actually processed.

    Any guesses on number of approvals so far this month? has about 450 which i think is only a fraction of actual number
