Good that you took it in the right spirit. All the efforts you are trying for us are inline with what even I wanted to do, but dont have as much access as you do. Search the forums with my id and you will see for yourself. To my knowledge there are very few who can do what you are doing. I wish Moderators and IV Core endorse your efforts in the form of a campaign and you will see much more participation. Look at the other drive they are doing for create a fund of $10000.00 If they endorse you (thats we) will get response in that order. Can you please ask Aman to do that, and that way we will have more voice.

I am not sure if most of you guys even remember what my group said. We WILL contribute even $3500 and more, if there is a campaign for EB2 and EB3 and for guys waiting 5-10 years . Not sure why most of you, even senior guys(by join date, and not by # of posts) just rememer the $3500 part all the time with my name :) but miss what we said. Go n read it again.And if Core endorses does effort, I will not be surprised if there will be contribution from as much as 5000 members each of $100 on avg= $500,000. No kidding, thats the pain EB3 is facing.. Anyone to disagree??.

I sent in my OPT application on 26th of March, and it was delivered there on the 29th of March. I still haven't received a receipt and the check hasn't been cashed yet, even though it has been 4 weeks now.
Please do update me change of status. I am also facing problem with 29th March delivery.

Hi All,
MY LC (PD May 2003) is still stuck in DBEC. So I may or may not be able to file withing Aug17th.
My question is regarding the procedure used by USCIS to process AOS applications. It would be great if someone could explain this to me.
These are my questions:
1. Is the AOS application processed by RD or PD?
2. Once USCIS starts processing the I485, do they check PD at any stage, or is it just used as the initail "gate " for allowing I485 application submission?
3. Suppose Tom with a PD of July 2006 applied in July 2007. Then Harry's case gets approved by BEC in August 2007 and he applies in October 2007. Who will get the GC first?

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. EB3I dates never really crossed 2001 after the JUL 07 drama which screwed all EB3 in my opinion.
1) USCIS never looked at those cases which got ported out. So if they try to process cases in 2002 they might end up finding lesser cases needing approval than they actually counted, could be bcoz of porting or people who gave up and left the country. USCIS is auto porting the date if you have old labor and i140, I know few friends who got GC like that.
2) At this pace EB2 will be current by mid next year, once it is processing time for 485 is at least 4 months which will fall into 2012, so the same huge number of spill will come to EB3 ROW. If the spill over is too much USCIS may consider spilling it to worst retrogressed countries.
-ve aspect: If USCIS starts doing quarterly spill over this may not happen. So as per my logic USCIS will start doing quarterly spill soon.
3) The as&***s who decided to change the spill to vertical might get bitten by a mad donkey or a dog and might change it back to the old model. I don't see any &&)) why all the spill has to go vertically from 2007, bcoz we irritated USICS or DOS by kissing their weak spots.
4) As per my Karma or belief model whatever IV does, hurts EB3 more. I don't think any admin fix will fix the vertical spill or recapture.

I received EAD card today. I e-filed on May 8th. Somehow i got 2 years validity eventhough my PD is current. But no worries i have atleast EAD to work on. All the best who are still waiting!!!

The only and simple way to stop H1B abuse is to allow only max 10% non-immigrant (H1, L1, TN etc) employee in a company. Rest 90% have to be Green Card or Citizen. These desi consulting, Indian big companies must be hving at leaset 90 % employees on non-immigrant status.

Not neccessarily. If you look at the approved 485s from TSC, you will see that large number of them have RDs in June 2007. But according to the published TSC processing times, they have been lagging in April something for the last two months. So I don't really think these "published" processing times really reflect the current work being done at a service center at least when ones PD is current.
so now we have to have PD current processing time for that service center is current and also be lucky so an IO will pick up our application to be processed. (it is actually little depressing)

Great work everyone. We now have 7,599 members. 2001 more members needed by Dec 31. If everyone can get at least one member in IV we can easily cross this target.
It is also a reminder to everyone to contribute. In the past 2 days there have been no contributions. In this whole month, less than 15 people have contributed. only 2 people contributed $200 and some $100 and everyone else less than $100. With this you can imagine how much contributions we get. Actually I saw an improvement for 03/20. 6 approvals for that day then it's back to no approvals.
Looks like approvals has slowed down further.
This is why at the end of the year there are unused visas. All due to inefficiencies of USCIS.
We are doomed.

I renewed my passport under tatkal this month. I mailed application overnight on Thursday and Monday got a call from Houston that Money Order attached is less 50 than actual. I mailed balance next day overnight, it reached them on Wednesday and got my passport after 4 business days.

I dont know but even the smallest of consulting companies dont make this kind of mistake and they would remind you if you forget. My company's lawyer is quite lazy and slow but even his paralegal asked all the right questions and got all documents needed and didnt forget stuff when filing for various things.

They never asked for my wife's I-94 till the 11th hour when I brought the fact that I'm married and my wife (no wives here :( ) might need some extension. Since, it was my first H1 extension after marriage, I really didn't know that company has to file for her extension as well. I thought it just happens automatically..how naive I was.

I've contacted NVC and the Consulate many times. Indeed, they just followed the rules and they don't consider it is an extraordinary case.
I have contacted congressmen and senators to try to highlight this issue and to be totally honest most of them have so little knowledge of immigration law they do not even understand the problem.
The CIS do not care, they follow the rules.
It is attention much higher up that is needed on Capitol Hill and someone who is willing to make it a REAL issue.

Same here, sent 2 inquires, the response was "you will be contacted as soon as it has been processed". Nothing more for 3 monthes now, or 5 monthes since initial filing.

i am totally frustrated in following all these stupid bills (along with illegals) and these dirty politics etc. I am more furious that we all are fighting only by ourselves and none of our employers are pitching in for the very reason we are all here. This said, we are wasting our time in following all these bills which has so many loop holes to get bogged down(especially for clauses pertaining to legal immigrants). Guys, this is personally for myself, i am not going to waste my time anymore on this crap. I am going to set myself, some fixed time that i will wait for the GC to come through. If not, i am going to pack up my bags. I am just speaking for myself, atleast that way i know that i am not waiting for some useless bills to pass through. Atleast i know my wait will end by that time. I am just speaking my mind over the way things are going and totally frustrated due to this freakin retrogression..
