Hi all,
I have taken 2 printouts and have signed them and put in 2 envelopes as advised. I will be mailing them this evening. I am going to cast my vote in the tracker thread once I have put both the letters in mail.

PD has no effect on filing a civil action as visa bulleting is changing every month. My friend in Oregon got I-485 approval after filing Wom even though his PD is not current on the latest visa bulletin.
I thought uscis generally followed 'first-in-first-out' rule. That is one reason I-485 receipt notices never show PD. Am I right?

I do not want to scare you but what you are claiming here i.e. while working on EB3-EAD aceepting promotion for a EB2-level skill can not be accepted by USCIS. You simply can not accept higher skill level based promotion like that. I think you should first sit down with a good lawyer and find out the solution of this already created mess and then think about interfiling.
Based on all info you provided it looks like our cases are not similar. I have already new approved I-140 - EB2 base - approved in year 2006. My 485 is attached to EB3.

It is not confirmed yet whether they would consider all of the 12k towards the decision for the May Bulletin or not.
They might want to disperse the 12k numbers in the subsequent months, if they try to be a little conservative.
This is a very simple calculation. Following are the numbers before Oct -2006. These total to ~ 12K.
EB2-C - 3521
EB2-I - 9345
The dates will move further if more than 12K numbers are infused into the system. I would say that the dates should be in Oct - Nov 2006 range with these 12K numbers, having Nov as buffer as they may issue RFE's to folks.

According to the newsflash on murthy and other sites, the AILF is working with several organizations to prevent 485 applications from getting rejected next month. Can IV core work with them to make the case stronger?

i don't what is the problem you have with AC21? it works just fine and nobody has a problem with it.
if you ask them to mess with it, and it seems to have no problem, they will either make it worse or take it away.
i think you guys are far too risk averse and want everything guaranteed in black and white. it does not work that way and we are not so important in the scheme of things anyway.

My wife has H4 stamped on her passport which expired last year. We had got H4 extended last year, but has not been stamped. After that she changed status to F1 again not stamped. Now as per my lawyer's advice probably we will need to change her status back to H4.
My lawyer has suggested that it is not advisable to be on F-1 while applying for 485. You might argue that you are not the primary applicant ( on F1), and USCIS might buy that. But risks remain. Specifically if you have to travel out of country before your I-485 application is adjudicated you will have problem.
Since we all know that right now USCIS is just taking applications, and it might be mighty long time before applications are adjudicated, I have decided to not take risk applying on F1 status.

Over the past couple of days I have had 10 of my friends/colleagues who have signed the letter and they have been mailed out to the president. I also have copies of them to mail out to IV once I have all that I can get..
I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.
Anyone out there who has more letters going out??:D

Hi Friends,
I am really sick and tired of my attorney. He is making money out of immigrants but he does not like immigrants based on our dicussion.
I think we are very well educated and can easily take care of 485 filing.
My attorney will charge me at least $3000 for it although I got his referral from AILA. On top of that he delays filing my PERM and 140 and having serious attitude problem.
I can easily take care of 485 filing by myself.
My only and great concern is- Is my attorney can screw up my GC processing if I fire him and file 485 on my own?

I agree with focusing on the Logfren bills, but the flower campaign might not work. Last year it was a combination of pressure on the lawmakers, USCIS and DOS by IV, AILA and a other groups. the flower campaign highlighted the issue to the public and gave us wide exposure...last years fiasco did not require a law change. In our case the clear cut issue is to make recapture happen. The only why for it to happen is by pressuring the lawmakers to take a yes or no decision.
I think we should all request our employers to call the lawmakers, individual calls will help but we need to take it to the next level as the window is very short.
Ok it too late for the letters..we need to focus on the HR bills by Resp Sen Lofgren..we have a narrow window here.. and bi partisan support..we can send her flowers and request the Senator to take this up seriously..also we can send the flowers to the co-sponsors..at thier local offices instead of DC ..since DC office is closed now..
What does EB-3 thinks..we can send flowers to these guys and also to Charles Oppenhiemer...

Also please contact your attorneys and tell them to complain on this half baked PIMS implementation.
My wife received her approval email from Mumbai consulate yesterday. When I contacted my attorney, he asked that after she returns to the US, to send him more details and he will lodge a complaint with the DOS through his liaison.

Why would they think like that?, USCIS made a mistake. They tried to cover (by making visas unavailable) their ass to save their jobs. Thats why we have congress to help us out.

The pain of waiting for 9-yrs is nothing compared to the wait now (after dates got current)...Refreshing my yahoo mail on iPhone atleast twice per hour, Clicking on Safari where the last visited page is that of case status online (Click the status btn frequently) --- Life is difficult :(
