On the other day Congressman Tom Tancredo was in Lou Dobbs program and they as usual ranted about H1-B visas. I almost fell from the chair when Tom T said H1B visa is valid for 5 years and there are around 700,000 people overstaying their visas. He clearly implied the thousands of people from all over the world staying here legally as illegals.

Since Lou Dobbs didn't challenge Tom I'm sure he agrees with him. I wish somone create a video explaining how H1 can be extended beyond six years, interview some USCIS ( even ex employee), immigration lawyers and put a fitting response to this video in Youtube itself.

I think if number of employees are less than 50 then 50% rule will not be applicable(according to 2007 proposed bill). It may be similar to that.
But are n't they proposing 50 % rule.. how can a small desi company afford 50 % US citizen staff ? That is why may be people think consulting companies will not work.
but what I think is it will make them less profitable. Very small body shoppers will go out of business. Med to large indian owner based consulting companies will be less profitable.

I am not saying that we are reporting fraud just for the sake of not tolerating it. This is effecting our GC. Earlier the effect was related to the job being taken away now it is effecting our GC too.
Initially L1s were sponsored only by large offshore companies like TCS, WIPRO etc.. The effect was that the jobs were taken away. But it did not have much effect on the GC side as most of these large offshore companies do not process GC for their employees.
But nowadays lots of small Offshore companies started doing L1As. These companies do not have lots of clients like TCS or WIPRo but they have a handfull of clients. So to make sure they have their clients they started bringing people in L1As and processing GC under EB1 for them. Although many of these people are developers and should be in EB3 and should be behind in the line. But as they are in L1A and are appling in Eb1 they are getting GC in no time and also taking the visa#s away. There are hunderes of these small offshore companies started getting people in L1As. Thus these EB1 Visa #s are not overflowing to EB2. This is effecting our GC.
Now we have :
1. Large offshore companies sponsored L1s taking the jobs
2. The small offshore companies sponsored L1s taking the GC visa #s.
If the L1As are indeed senior Manager then no problem, but the Developers/Business Analyst/ Project Manager without hire-fire authority are getting GC under EB1.
Thus these frauds should be reported so that at least the # of EB1 visas are not taken by fraud.
So you too can see how this fraud is effecting us all.
Do you know why we are having GC delays ?
1. Country cap for visa numbers
2. Visa numbers wasted by USCIS by their inefficiency

May I ask your immigration status. I believe you already got your GC and roaming around here just beat shit out of others. Each and every of your post is convincing me in that direction only. You would be happy to see the H1 guys thrown out from here. So it will increase your demand and you can make more money. Today is my day. After 13 years into this country, finally I am green. I tried SR, Senator help, infopass without much help. 2 days ago when called, Texas POJ, one nice IO told me case is not yet assigned to officer, will send email, looks like worked this time. You know every time I hear the so called "highly skilled and educated" complaining about predatory lending, it reminds me of our maid servant in India. She would constantly get into trouble by borrowing money from her neighborhood sharks at high interest rates, and then come to my parents for help when she couldn't pay up. My parents would give her a well meaning scold, and help her out only because they knew she was illiterate.
Now I wonder how these guys like punjabi7, kumar1 and leo2606 can blame the lender only for what they got themselves into. They even go as far as claiming that moral, ethics, and scruples are all some kind of fairy tale virtues that are hardly ever practiced in real life. They even have the audacity to assume everyone else here shares their definition of what's right and wrong by saying everyone has at one point or another returned used items to stores!
Punjabi7 still insists on avoiding morals in the discussion and is persistently soliciting for "advice/options" for his so called mess.

The very people tossing aside ethics are the ones who used good faith based credit system. Now suddenly it is all Capitalism, Greed, Bank's and Lender's fault. Whatever happen to personal responsibility ?
All those suggesting foreclosure are forgetting one thing: The pendulum has shifted and the same capitalism that supported the reckless credit is now going to choke it off. You don't want to be on the wrong side twice !!!! The thing about free markets is they adjust to new realities long before people do.Before you know it the easy walking away (or foreclosure) might become the biggest mistake while buying house might be distant second.
In the meanwhile please don't shoot the messenger aka sledge_hammer. If you read his posts he has given the best advice with a good dose of much needed reality and sound language. If you are hostile towards him you are simply in denial. The longer you stay there the harder it will be to cope with the new realities.
Punjabi77, good luck to you buddy. This will pass too, don't ruin everything for $20K. You will earn it back but you can't undo foreclosure and whatever comes with it in terms of personal memory, your credit and things in future that you can't foresee now. Do the right thing it will only make you stronger and someday you will be able to tell your kid that you did the right thing in the face of adversity and eventually not only survived it but thrived out of it.

I called Vonage Customer service , If you signup Vonage World there is no 5k Min. limit. Its unlimited. Guys please don't post the wrong info.

"Sorry for the delay in responding. I've been out of the office unexpectedly and am now just getting a chance to catch up on past messages. Unfortunately we can't pursue candidates with EAD cards either."
There was a thread related to similar issues which I could not find. Apologies for opening a new one.
Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?
My neighbour just got a job at Capital One last week using her EAD . So I am not sure which policy this HR person is talking about. Capital One definately takes people on EAD and my neighbour is proof of it !!!

I am in a similar situation. I applied just 95 days before. My lawyer "forgot" and I applied in a rush in the end. I am hoping it will not be a problem.
My understanding is that you will remain in status even if you do not have EAD or AP. However you cannot work.
I have a meeting with my lawyer on wednesday. I will be asking her about this. I am hoping for peace of mind that this does not become an issue.
I checked with somebody in the forum like you and he got it in 2 and 1/2 months. I checked in the USCIS web site. It says you have to apply 6 months in advance. I did not know about this since I got it in a month last year when my case was in CSC.

I know this topic has been thoroughly disussed above but still would appreciate some response to help me for my situation:
My husband has filed under EB3 category(chargeability India) and has a PD of Oct06. I-140 is pending and we have filed for I-485 (husband primary and me dependent), EAD and AP.
I have filed my GC on July9th and have an approved labor, and am planning to file my I-140 and I-485 as I have a charegability of Iraq.
My question is if I do file I-485 as the primary and make my husband the dependent on the application, do I still need to provide the A# number we received from his I-485 application receipt?
Can it have a negative impact on either of our GC application?
If we are asked to chose when will it be asked?
Please do reply and help me.

Before june bulletin I was thinking to go back home with my daughter (she is under 18) and try to get visa in consulate. It was attorney advice. Also he suggest to file for an asylym for my wife.
Now I'm going to file I-485 for whole family regardless what attorney will tell me.
Is it good idea to go directly to uscis office and ask them (can I file)?
And what will happen if their apps gets denied?
