You have a right to demand what is called a temp driving permit which is for 30 days. if your case is not resolved in 30 days, you can go back and get another. this can go on till your case is completed. While carrying the temp cert, since there is no photo ID, i advise you carry your passport or any other photo ID.

With all due respect, the probelem I have with volunteers is that I don't think amtures can pull a job this big, you've got to have profesionals, somethng like a compain maneger.
I admire the courage of your guys, and think the goal is fantastic. But the way it goes, I don't see how it can be achieved.
I've learned a great deal about immigration from the forum here. I very much appreciate it. I try to give back by answering questions others may have. I think IV has been doing a great job serving as that capacity.

My attorney told me that DA offer is not negotiable if just from my attorney side. I knew they have not good relationship, probably they have too much un-happy fight experience before. As before my pre-trial conference, he mentioned she (DA) does not like him. :(
So that day my attorney give me 2 choice, go Trial or accept offer, I select first one. We already set a trial date at July. We have problem on strategy I think.
Yesterday, I have conference with my attorney, he told me he could try to get that offer back. I don't know if trial already set, I can still change idea??? My attorney suggest my wife mail that DA directly and tell her the truth and see if that can help reduce or dismiss the charge. Now we prepared on this.
One more thing, my charge is level 1 misdemeanor, not felony. Is that same excuse for deportation right away? What BIA stands for?

This is a serious matter. Make sure that you have an attorney that understands both the immigration and criminal consequences of this charge. From your description it sounds like your attorney is just a criminal attorney.
NEVER NEVER plead guilty to this charge. Force your attorney to meet with the DA and try to get a Pre-trial diversion (in which you do not have to admit your guilt in any fashion, volunteer to do extra community service if the need be). The definition of "Aggravated Felony" is much more stricter than any state's version of Felony. On top of it all in the eyes of BIA judge this is a Domestic Battery (No matter what the state charge indicates), making you deportable right away.
I don't want to scare you but whatever happens you should not plead guilty to this charge. If nothing works out you are better of taking you chances with the trial (Especially since your wife can back you on your story).
I hope this helps... Get a competent lawyer who understands the gravity of the situation.

Actually very true. I for one have held off on buying a gun (though my wife highly disapproves of guns) simply because I dont have a GC and dont want any hassles. Besides I live in Chicago which has a ban on guns. Ironic that the maximum killings and drive by shootings happen maybe 30-40 blocks from where I live but the city doesnt allow legal law-abiding residents to own guns.

Adjustment in Dollar exchange is good for both US and Indian economy, if $ hits Rs 38, this will certainly makes outsourcing even more expensive, Indian companies which are currently overrated will have much needed adjustment and the ripple effect of which can be seen in local Indian market such as realestate etc. In a long run this is good,

How about contacting other already established organisations like ATA, TANA, DTA,BATA, Kannada kutami etc for help? All these organisations are formed by immigrant people from different states in India. They have a huge membership. We can rise funds and memberships by highlighting and explaining our problems. Is there any one pager or document that can be sent to all these orgs and asking them for help in funding as well as political drives?

Yes, that is perfectly correct. If an employer needed somebody with BS and 2 yrs exeperience, and no US person applied. You (with a BS and 2 yrs experience) applied. Employer filed your I-140, which is approved. Now you wait for 4 years, and in the meantime you get your MS. Technically, you are now overqualified for the position, and employer may decide even not to consider you any more (leave alone upgrading to EB2). Note that entire process is for future employment after you get your GC, until then if you are working, you are working as a guest worker.

EB migration was a added almost as an after thought to the family based immigration bill. Current or future considerations were not taken into account when they wrote the bill, the prime focus was (is and will be) the family based immigration as they get the most votes, they have the most 'heartbreaking' stories. I understand your point. I also dont want to argue about how USCIS distributes overflow. I have been dealt a hand i am dealing with it.
I do want to say that nothing will happen unless you make efforts to make it happen. We need to talk to the lawmakers about our problems. Half of them still think we are talking about H1 and launch into a spin about outsourcing. The H1 lobby has major companies backing them, anti immigration groups are flush with cash and are very vocal. Hispanic caucus is a big group. What about us, do we just keep discussing issues or try to educate people on our problems...if we dont we will stay a minority with no voice, simply pawns used and abused by others.
As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.

As I see, most of you are missing the point. Instead of trying to understand, you showing the maturity of mind. The whole purpose of EB immigration is to meet the Demand(Job opportunities) vs the supply(immediately available candidates).
When there are a lot of opportunities exists for EB3 level(skilled profession) and less opportunities exists for EB1(Ph.D/Executive Director), USCIS should give more no. of Visas to EB3, then EB1.
A country cannot be built with only the kings, and not even a home can be built with only Ph.Ds(Nobody do the dishes).

Ya know what? I am so SICK AND TIRED of our lawmakers bowing down to those illegals, who don't contribute anything to our society. That's right, NOTHING. They steal the jobs that Americans WANT to do, and our lawmakers just bend over and lick their boots!
I married an Indian here on H1-B and it's been two years since we've filed for his greencard. Do you think we've heard anything yet? Only thing we know for sure is that we are getting shafted for following the letter of the law while Elvira (vampire) arellano is sitting up in that pile of crap called a church, with politicians like Barack Obama slobbering all over her. Where are these same politicos when we FOLLOW the law??
Yes I am plenty angry over the whole mess, but what I really wonder is why don't we (the TRUE immigrant families) do the same as the illegals and go out and PROTEST this new amnesty?? Could it be we are too busy working and contributing to society?
Either way, I think we had better get out and do some protesting of our own. After all, illegals are ALIENS, NOT IMMIGRANTS. How dare they steal our Immigrant moniker from us!

The discussion is what we should do to act on these issues. IV core has been (I assume) assembling data for some time now to have valid numbers for some action items. Let's get on with the action items now and see where they take us. If that is deemed unsuccessful then we go for the next. We keep trying. That should be the motto. My 2 cents.

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.
Any body in the same boat? What shall I do?

When I was in a similar situation the DMV told me either to bring the original receipt notice or original approval notice. If we take the Original receipt notice then they said would extend the DL by 240 days, if we take the original approval notice it is extended till the H1 expiration date.
This is not a legal advise or suggestion, use it at your own risk. This is just what I went through.

all i can say is that your situation sounds like an illegal situation... if you are simply going to provide offer letter without actually having a job... but thats between you and your company and you may be perfectly legal and fine... check with a lawyer dude

Do you really agree with multi-national managers(via L1A). This is the area wherein the interpretation is pretty loose. If you dissect EB1 data you would find that EB1C used bulk of it except for this year due to bad economy and tightening of screws. There should be some very clearly defined guidelines for EB1-C, somebody being an onsite coordinator or managing 5 people should not be eligible. This category should be reserved for those who are managing at least 100 people or control business in several millions. I agree that EB1 should be just for the exceptional.
I support you, most of the guys L1A/Bdon't deserve to be in EB1. If L1 (especially the offshoring companies) are that good then all of us are eligible for honorary greencards....
