    Thanks. Looking at the demand data (as of Sept 08 as it states ) we may or may not have "net" backlog reduction of 40K for 2009-2010.

    EB2 - net has come down by ~30 K but Eb3 has a net add of "10K"..Hmm unless they really approve a ton of them in September, we may be looking net reduction of 30K.

    I really hope they get cranking on EB3 -ROW , they have ~44K pending . Expecting USCIS to work through this backlog in a year or two is reasonable or even next year .

    At that point, EB3-I would be primed to receive overflow but the question is will they open up the flood gates and receive all new Eb2 applications or let them in a phased manner .

    If they let them in a phased manner , some of the pre approved EB3-I applicants in 2002-2003 will get there GC . Even otherwise , new EB2 applications need processing time so few lucky Eb3-I (If you can call them that) may get their GC's.

    Another thing is when will they let new EB2 applicants , if it is early in the yearly cycle say Oct-feb , then processing on such new application will be complete by June and EB3-I will continue starve.

    So basically lot depends on how and when they will open up the gates for new EB2 applicants.

    If they do it at the end of the year and they do not want to loose visa numbers , then there are ton of EB3 application in a pre approved stage for them.

    If there is a non-controversial immi. law change attempt I will donate $500. I will also bring my friends and the total may exceed $2000. We all willing to donate but only if we know that there is good chance of passing.

    If there is an attempt to push ideas like recapture, forget it. It will not pass in this economy. I do not want to waste my money and time on those kind of ideas.

    IMHO. Not to find fault with anyone. Please do not mistake me.

    recapture is not controversial and has nothing to do with economy...not sure where you got that from, recapture of EB numbers is what we are proposing - this will not take away any american jobs but only alleviate the wait times for folks like you and me. Also, we've to accept the fact that anything related to immigration will be controversial - there is no denying of it, unfortunately.

    Coming to the donations, please don't donate in huge sums because you'll have huge expectations...I'd say start off in small steps - 6 USD per week for 6 months...I signed up for it and it took me 5 minutes and 150 USD for the next 6 months, not too bad right!

    Called USCIS just 5 mins back.. first a lady answered and asked me questions about the reason of calling..

    I explained that i am calling to find out the status of my i-485 application that i filed on June 25th. And I would like to know when will i get my receipt no.

    The lady asked me to stay on the line and transferred to another person.

    Another lady picked up and asked my last name.. I told my last name. (i did not spell my last name)

    She asked for reason for calling..

    I said to I filed i-485 on June 25th and I did not get my receipt no yet..i said
    i would like to know when can i expect my receipt no..

    She put me on hold for few mins and came back and said
    "You have till August 17 to file your i-485. If we have visa numbers available and if your application is accepted, you will receive your receipt no before August 17"

    I said I aready filed my application on June 25, before the July bulletin.

    She said "listen carefully" and explained the same thing again.

    I said thank you and hung up..

    It doesn't make any sense.. I think(hope) she doesn't understand my question properly or she doesn't know the process..

    Hello Gurus,

    I have red in many places that there is some cases which are "Low hanging fruits" or "Ripe cases" when they say this what exactly this means? my understand is that for USCIS every case which has all proper supporting documents then they will adjudicate that case no matter what if VISA number available, can some one help in understanding what is "Low hanging fruits" or "Ripe cases" :confused::confused:

    once you get past the I-140, the typical reasons for denial of I-485 are some criminal background, out of status >180 days, mistakes on forms etc.

    IMO a simple case would be someone who:
    - has never changed employers
    - was employed with a large US corporation which is more likely to have paid him his salary every month (as opposed to a 3-4 person company where getting hold of the W-2 is the only way to confirm).
    - was never denied any application (change of status / entry to US)
    - has clear medical records
    - has clear documents related to birth certificate

    Complicated cases are when:
    - someone has repeatedly changed and employers since entering the US. The IO will need to make sure status was maintained throughout all those transitions.
    - some document was not submitted, or not submitted with transalations/affidavits etc. Commonly birth certificate issues.

    We don’t claim that my proposition here will make the housing crisis go away but what I am proposing is to let us think out of box and help each other.

    We are an association of highly skilled immigrants, waiting for our permanent residency status. There are approximately one million such people in this situation.
    Before we proceed to make our point, we would like you to consider the following facts regarding ourselves:
    • Average age: 30-35 years
    • Average years of stay in the USA (all legally): 7 years
    • Average legal status in the USA: Final stage of the green card (called I-485 stage) and posses employment authorization document (EAD), renewable every year, indefinitely till one gets his green card.
    • Average Salary: $75K+
    • Average net worth: 100K-400K (mostly liquid)
    • Average occupations: Information technology, Doctors and Financial Analysts
    • Average education level: At least undergraduate
    • Average credit history: Excellent

    Note: If needed, we can cite the source of the information, which is from the government itself.

    As mentioned earlier, we are in the final stage of our green card process and at this stage there are very few rejections (<1%). It means that we would eventually get our green cards but it may take several years. Please note that the final stage (called I-485 stage) is the stage, where the applicant has already been found eligible for immigrant visas (aka green cards). Since government can issue only limited number of such visas in a year, the wait becomes long. Please also note that after applying for I-485, people can get their EAD enabling them to work for any employer. The EAD has to be renewed every year and most of us have their EADs

    Even though the chances of the rejection is very low but most people, out of fear, have been postponing any major investment decisions, like buying a house or a new car, in other words, living conservatively. In addition, due to the turmoil in the market, several of us, in spite of our excellent credit history, income and high liquid net worth may not qualify for loans as EAD is valid for only one year.

    Our organization has been urging the government to fix the green card process or at the very least relax the hassles of the yearly renewal ordeal for EADs. Either of these things will bring certainty in our life and prompt some of us to take some big decisions.

    We are writing to you with a hope that our situation will be highlighted and our intellectual and financial potential contribution to this country is appreciated. Please let know if you are interested discussing the matter further and how we can help each other.

    If you want a good discussion on a topic stop generalizing things and do not use rants like racist engineers etc. When you make an assumption please be clear about. You have assumed most people work for consulting companies and most people are frustrated with it. Not so. I don't work for them and I am not frustrated with them. My only concern with them is they are exploiting the system to their advantage and at my cost. This has two fold affect not only the take cut from your salary but also put a bad name to H1B visa program in general. Whoever wrote the bill or whatever are the consequences there is definitely some good things in that bill. Let me list out how some provisions are good:

    1. If you are employable in US and you have the skills you will get the job with or without these middlemen. They come into picture only because they can start a corporation and then start the exploitation game. If a bill is taking these guys out what's wrong with it ? This will allow genuine corporations to hire the right candidates.

    2. Putting 30 days of ad. to hire US citizens first ? What's wrong with it ? If their skills are really outdated and you are the best and the brightest you will get the job.

    If you need more evidence of why H1B program needs reform look no further than H1B cap used up on first day. This has put good undue hard ship for good candidates while Infosys/Wipro etc will once again take the lion's share of H1B numbers. Why do you want them to win at your cost ? Stop calling people affected by this mess as "Racist Engineers". Try to put yourself in their shoes and some of these practices are affecting both the H1B visa holders (with indentured servitude) and citizens with wage depression. No body wins in the end but the people who are exploiting the system.



    on the face of it i largely agree, you are however misisng something important in my opinion. Look at the Lc process for Gc carefully. A company is required to advertise then employ any citizen with "minimum requirements" whether or not they are suitable or the best candidate. If the same were to be applied to the H1b- and to renewals, mind it, consider whether most H1B visa holders would be able to continue.
    the fact that reform is needed does not mean this is the best way.
    and btw i wonder what happens to true consulting companies- BCG, Oracle etc whose business is to provide these services. They are not some abusive offshore operation....how is it fair to them? Seems a bit radical to me...not that i oppose the need for reform.

    First of all I don't know who sachbole is ?

    I have contributed to IV in faxes, phone calls and sending numerous letters. You can always check my history before analyzing from a blind eye. I have been here for a while, I have even spoken to a few IV core members.

    That being said, IV need's be more organized, blind actions and blind analysis wont get us anywhere.

    It is the IV core members responsibility, I am aware of the challenges, but people are quiet frustrated and desperate for a change.

    If IV is committed on its objectives, then organize a rally or a meeting with USCIS, I will be there.

    Show the world what you are and stand for, not just talks should be the motto of this organization. Need my trust and money, please earn it.


    IV does not want your money. Its not asking for Charity.

    IV is working on getting relief for people stuck in EB green card mess. If you would like something done in this regards contribute money, time and efforts to IV.

    Hi Guys,

    I am in tough spot. I was laid off from my GC sponsoring employer (A) in 2008 and joined another employer B . I did not do a AC21 notification. My dates are current and now I received an RFE to provide employment letter from current employer. The exact words of RFE are as follows:

    "Submit a letter of employment attesting to applicant's current employment. This letter should be written on the company's official letterhead, citing the date the applicant began working, if a permanent full time position, the position offered, the position the applicant is currently working and the salary offered. Include corroborating evidence such as recent pay stubs, income tax returns, with all W2s or other evidence as appropriate. "

    Now I am not working for original GC employer. I don't have a problem providing above from my current employer B. But whether the EVL should also mention that I am not working for GC sponsoring employer and that my current employers job profile is in same classification as previous based on AC21. Do I mention about the AC21 also in the letter? My current employer's attorneys are not that great but my current employer only wants me to use their own attorney.

    Now here is the situation:

    I have a job offer from another employer (Employer C) and they are in the middle of doing a H-1 transfer. In fact by tomorrow they will file the H1 paperwork. Now I don't know whether I should provide the letter from my potential new employer C . In that case, I won't be able to provide W2 or pay stubs until I join them. I have an opportunity to use my own attorney here (like murthy, Ron Gothcer..)

    OR

    should I provide a letter from my current employer using their attorneys and whether or not I should mention about AC21 in the employment letter.

    Also they sent the RFE to my previous employer's attorney even though my current employer's attorney had sent the new G-28 forms. Can my current attorney respond to the RFE or will the response get rejected because USCIS still has old attorney on file.

    Interesting (and scary) article about NumbersUSA and related organizations. Although the article is from 2002, and the numbers will have of course have changed, the article claims that the whole anti immigration movement revolves around a group of about 20 very rich people and a few thousand sympathisers, and that member numbers for these organizations are inflated by dividing the total contributions by the annual membership fee and not taking into account large contributions.

    Here is the pitch that McConnell and Lott are said to be using -- and the pitch that only you can persuade Republican Senators to reject:

    Lawmakers are being told that they must agree to vote for cloture on the amnesty in exchange for a chance to have some favorite amendments brought up OR they will lose a chance to "sit at the table" in final fashioning of this bill.

    A senior GOP leadership aide confirmed that anti-amnesty Republicans are being told by Party leadership that they “need to get on board if they want to remain relevant.”

    I have some actions related to Democratic Senators that I'll detail further in this email. But our most urgent work today is with GOP Senators.

    NO MATTER HOW MANY TIMES YOU HAVE PHONED IN THE LAST MONTH, YOUR PHONE CALLS ARE DESPERATELY NEEDED TODAY.

    No matter how many amendments are allowed for votes, the end result bill will be terrible -- maybe slightly less terrible than now, but still terrible. There is no point in trading away a YES vote on cloture for the chance to offer an amendment.

    You must make it clear to every one of these Senators that they will be made to pay politically over and over the next year (maybe their whole careers) for a YES vote if this bill comes up again on cloture.

    Remind them that Sen. McCain has seen his front-runner status in the Presidential primary race plummet because of his highly public support for this bill.

    Why would any of these Senators want to carry around that same kind of baggage?

    And tell your Senators that they have all the "relevance" they need by being the representative or your state in the U.S. Senate. They don't need George Bush or Karl Rove to give them relevance, especially if relevance has to come at the expense of principle.


    EXPOSE AND CHALLENGE THE LIES THAT POLLS SHOW AMERICANS SUPPORT THIS AMNESTY


    Yet more news media polls are being released purporting to show that the majority of the public supports this Senate amnesty bill. The big use of these polls by reporters and open-borders advocates is to supposedly prove that all of your phone calls are just a loud-mouthed minority.

    The fact is that nearly all the media polls fail to offer people the choice of Attrition Through Enforcement.

    When Americans are offered a choice between legalization, attrition or mass deportations, most Americans choose attrition. And an overhwelming portion choose either attrition or mass deportation.

    THE BASIC MATH


    Last week, 45 Senators voted for cloture. It takes 60 votes for cloture to pass, thus ending a filibuster and allowing a final vote, which at this time would require at most 50 votes to pass.

    The pro-amnesty Bush/Kennedy coalition has to persuade 15 Senators who voted NO last week to switch to YES if the cloture vote comes up again.

    The only thing that can keep that from happening is an even larger outpouring of phone calls, faxes and local demonstrations at Senate offices, etc.
