First of all, you dont have a binary choice in the matter such as either you learn 50,000 words and their spellings or go smoke dope. There is a middle ground here.
Secondly, why do I see in company after company, especially in the knowledge industry that a straight A student, like your Kavya here, working for a manager who had been a B- student who in turn works for an executive who was a C- student ?
Get educated ... that's fine. But dont get over-educated such that you are a cripple who cannot think outside the box. Too much education, too many straight As, too many spellings will make you incapable of thinking outside the box, taking risks. I guess you are speaking like Tom Peters. But in the end, it all depends on where one wants to be and what is the world view of someone. If one thinks that just because someone is a manager over others, that makes that someone better and more successful than others, and if most B- students manage A+ students (which is fuzzy maths), yes, in that case it maybe that its better to get a B- grade than A+, and there is no need to go to business school either. If the world view and the objective is not just to become a manager or make 100K instead of 120K, but actually do something worthwhile in every stage of your life, rather than just having an objective of becoming a manager, maybe its about learning a language and words, then why not. Strong vocabulary is the first stage to clear expression and clear expression is the corner stone of a successful and satisfying career, including bring a manager. I don't see anything wrong with learning more words, or loving parents or obedient children. Everyone has a different age in their life when we revolt against the environment, just to break free. Its not necessary that one must continue to revolt an entire lifetime to be creative or be better than others. Bill Gates or Steve jobs never wanted to become just managers, they wanted to re-invent the future. College dropouts, but successful. But how many Gates and Jobs do we have? I guess there is no clear definition of success and different people gauge success differently, but most people, more so in this crowd on this forum, relate success to level of education/university (US masters or Bachelors from India), and title at work place. But maybe the key is not how others gauge your success, but how you gauge yourself. Maybe you have set your eyes on squeezing most number of lemons or maybe being fastest eater of a water melon, or climbing on top of rhinoceros back, whatever it is, if you have done it and you feel satisfied, you will see yourself as successful. It is not joke, that's my unbelievable terrible start since this March. When we look back, still think it like a nightmare. And one neigbour told cop she heard my wife shout "Help me, he is gonna kill me." But you knew we even don't speak English at home. Where that ridiculous words from? BTW, when cops come, they firstly mis-arrest my another neigbour, as they also have some argue. Probably that is where it from.... But now that everything we have to explain on the court and convince the jury. Fortunately my wife always stand on my side.
Anyone could tell me what impact to my 485 approval if damn jury find guilty in my case? Thanks a lot!!!!!!

I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
Or
AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
USCIs can make these fixes but they dont want to do it. Its simple

With Eb3 India the Horizontal spillover methodology kills most hope as there is the large Eb2 India backlog. In 2007(I think) the vertical spillover methodology was followed and Eb3 India got 17000 or so visa numbers. So with Horizontal spillover and no number increase I am sorry to say movement is limited.

- While on a H1 or a L1 visa, one is expected to maintain a continous period of employment. If one is on a H1 visa and does not get paid, that individual automatically falls "out of status".
- It does not matter if the person has other seemingly valid visa stamps on his/her passport.
- The only highly-skilled dual intent visas that allow one to work, are the H1 and the L1, as far as I am aware of. Dependent visas do not allow one to work, such as H4 or L2. The only way one can work while being a dependent is if one has an EAD based on a pending AOS(I-485).
- If one is on a H1/L1 and wants to switch to say a dependent visa (H4 or L2), one has to submit a change of status form (I-539?). The person is assumed to be in "authorized status" until the change of status (or even an extension) occurs. If the COS or extension gets denied, the person is retroactively "out of status" from the original date of expiration on the previous visa.
This is correct ONLY if person is maintaining status at the time of application. If the person is out of status then filing change of status petition does not put him/her in status.
- Accruing over 180 days will entail a bar of 3 years for re-entry after the person leaves the US.
- Accruing over 365 days will entail a bar of 10 years for re-entry after the person leaves the US.
3/10 year ban applies to unlawful presence only and NOT for out of status. If I-94 date is passed, only then person starts accumulating unlawful presence. There is a BIG distinction between unlawful presence and out of status.

Consulates in third countries do not entertain applicants for visa stamping or visa renewals if they have not maintained status

There are actions "missed" by Employers. But, that is beyond the scope of current discussion.
I will be writing a detailed note on how to handle out of status issues.

Ask them to follow procedures in Aytes memo. Show the memo. Ask them to contact NSC where your I-765 is pending and alert them about your situation. (Contact NBC or Service Center to initiate EAD production�either Interim or Non-Interim). Ask them to provide Notice to you acknowledging status inquiry. If IO refuses to do that, ask to talk to the supervisor and repeat the above. It works. Basically, the federal regulations require them either to issue EAD in 90 days or issue interim EAD.

Approved or soon-to-be-approved I-140 folks (like me) will get GC on time or faster and others with Maters degree will get GC in 1 or 2 years, and rest must have got admission to MS by now. and there will be some loophole to bank on which will be realized by our stupid Joe after a few years.

I have an nre repatriable demat acct thru icici - it took all of 5 mnths and over 30 calls to cust svc to get the acct opened. The acct was mainly for utilizing the indian stock opts given by employer. You can trade as an NRI but online trading is not available for US residents on nre demat accts - u can however trade thru a broker like sharekhan etc.
All dividends are credited only to your NRE savings a/c - not to regular savings a/c. Any stock sale requires an authorization number which the broker can provide. Taxes on capital gains must be paid only if you sell within a year of purchase - the percentage is the same as for Indian citizens. There is no tax on long term cap gains
Since we do not have any taxable income in India, and many NRIs make charitable contributions regularly, the tax liabilities are usually not very high
Also there is a very informative section on sify.com for NRI taxation. You are not required to file any tax returns if you are in NRI status and are within the exemption limits.

They will know because when you fill out the N-400 application form, you are required to list your employment details for the last 5 years.
I don't quite understand these "citizenship" worries. Am I missing something? You are not required to keep W2s for more than 3 years. You can apply for your citizenship on 6-th year and list your employment after 1 year of having GC. So you appear on interview showing last 3 W2s and that's it. Why would it lead to denial of citizenship?

You have 2 choices:

This is a very bad situation i would highly recommend that you move heaven and earth together to get married and file this month. Pardon me for saying so but ur stars are alligned till Aug 16th only. Good Luck!
