    I think Senate is serious in passing the bill. Some of senators worked hard for months to draft this bill. But House reaction we will come to know after Senate passes. There can be lot of things which can derail the bill as both pro-immigrants and anti immigrants are not happy about the bill but both group got something.

    What are the chances to pass the bill?

    Thanks again for being ever so helpful. That being said, can you please share your thoughts on the following situation?

    140 approved, 485 pending for more than 180 days, EAD/AP approved, and in hand.

    Candidate leaves sponsoring employer and joins another employer (similar position/salary, etc.) New employer's attorneys send the AC21 letter and G-28 forms to the USCIS. The attorneys are very familiar with this, have handled lots of AC21 cases (Fragomen).

    Is there any way the candidate can call USCIS customer service and ask for the attorney/representative's name on file, just to make sure that the G28 did get processed and the attorney name on file got changed from the old law firm to the new one? Would customer service share that information with the candidate?

    Even if its multiplied by 100 we should be ok, if the USCIS does a good of not waisting visas by doing their best in the month of Sep. Say we have 6500 * 2 .25 (Family) = 15000people waiting from EB2 2004. Looking at the spillover numbers from last year, we might be lucky enough. Just trying to be optimistic for the next 35 days.

    We received our 2nd biometric appointment notice for Sep 11th. Our Notice date is Sep 19th 2007. Just keeping my fingers crossed and hoping for something good. :)

    Spouse working - Yes, in theory they could allow H4 to work. However would that be any job? If so then the H4 would actually be far better off than the H-1B who is restricted by job category and employer qualification

    Long term - Yes, in theory, a 20 year H-1B takes some of the stress off. But what of Citizenship? If you stay 20 years you'd want to at least have the option of becoming a US citizen. At present I believe only a GC holder has the option to progress to citizenship.

    Employer based - This is the key. Unless an H-1B is no longer employer sponsored but self-sposored then the H-1B holder is still living on a knife-edge and can be sent back home at any moment if their employer fires them or goes under and they cannot secure another similar job quickly enough.

    So yes, they could make H-1B 20 years, allow spouse to work, allow application for citizenship and make it self-sponsored and not employer dependant. But why do that? They already have this kind of Visa. It's called a Green Card.


    I disagree, GC has more .... Like doing business in here. and no need for getting visa stamps.

    I would be happy if a visa like the TN-Visa made available to all not only to canadian and mexican nationals, though it doesn't have a Path to GC.

    That's exactly my point. I am not saying one should not go to India. Canada is really an option for those who have spent a significant part of life in US and for personal reasons would like to live in Canada.

    That having been said, I would lile to hear experiences from those who have moved to canada or who have "real" friends who have moved from US. I am not interested in hearsay.

    If you have moved from US to canada and had a bad experience please post it because we should know what to be prepared for.

    I have heard the following -ve things about canada.
    1. Smaller economy
    2. Fewer IT jobs
    3. Require licensure in other fields
    I think the above are true but I want to hear real stories.
    1. What kind of software co.s are there.
    2. What kind of IT support organizations(bank/healthcare/manufacturing) are there.
    3. What skill sets are in demand.
    4. How hard is it to land interviews.
    5. What kind of interviews can one expect

    What are the +ve things about canada?
    1. Freedom to choose profession
    2. Freedom for wife to worl
    3. Cheaper housing.
    4. Anything else?

    Let's keep the ideas flowing ....


    Here is what people forget in this debate. They point out disadvantages of Canada over US. Fewer jobs, High taxes, extreme cold etc.

    No doubt US is better than Canada for most people. That is why US is our first choice and Canada is backup - not the other way around.

    We arent talking about people who have a choice here. If you had choice between US GC and Canadian PR we would always choose US blind folded.

    But we are people without much choice. Yes we have choice to go back to India, and it may be a good choice for thoise who have come recently and have work exp in India. But some of us have spent 10 plus yrs in the US, have US degrees, never worked in India etc. For us it is extremely difficult to move back to India when we dont have a days work exp there. Ofcourse if you are SC/ST or OBC o reserved category your kids have great future there but not for other "normal" people.

    So what other choice do we have. Well English speaking countries you can migrate to and who are taking people as PR's are:

    1) CANADA
    2) AUSTRALIA
    3) NEW ZEALAND
    4) SINGAPORE
    5) UK.

    UK is very difficult to go to as PR. The points required are extremely high. Unless you have MBA from top 10 school or make over 100 K it is difficult.

    Singapore is a good option also, but cost of living is high and you can only apply for PR after working in Singapore for 3 plus yrs. Also Singapore is not a democracy.

    New Zealand economy is 10 times worse than Canada

    That leaves Australia and Canada. Well Canada is closer to US, but Australia has better weather. Canada is less racist but Australia has cricket :).

    So bottom line is conduct this discussion as if US is not the option. If we could stay here with PR for sure we wouldnt even be having this discussion.

    I'm sorry for posting my question here. I know its not a right thread for my posting but I don't find any link for new thread.

    I'm a July 2007, I-485 filer with PD dec 2004 EB3. I have been working as sr.project engineer for the past 4 years with an MI based company. At present my company is not doing good business started downsizing. i don't know when I'll be victimized. So, I have started searching for new jobs vigorously and got an offer for Designer position ( Permanent position with all benefits) with slight increase of pay. I don't have to use my EAD as employer is willing to transfer my H1B which is valid till 2010. Friends my question is -

    There is a degrade in position, Does it effect my Gc process? I know, no one will be in this type of situation. my heart bleeds to accept the lower level position but, the fear of going out of job with wife and two kids is forcing me to accept the offer... If it doesn't effect my GC process..

    Guys MY PD is feb 2008. I am recently watching vias bulletins. I am in EB2.
    Based on my watching previous visa bulletions ( after sep 2008) I dont see that it makes major difference if you file in EB3 or EB2.
    Both are backloged very much and sincearly I dont hope inspite on being in EB2, I will get EAD or GC till 2015.

    What are your thoughts, is it worth filing in EB2?

    I filed my I485/EAD/AP on August 7, 2007. Does this mean that I do not have to pay any fee for EAD renewal now ?

    The instructions say this -

    Special Instructions :
    If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

    I am surprised some friends thought Ed should mention our agenda in an article which is talking about how to keep & increase the vote of the GOP.

    Even if every member of IV is given a green card this afternoon, none would be able to vote in 5 years, unless you are in the military. We have less connection to the citizens in the United States than the undocumented workers. Latino citizens vote for more Latinos, but some Chinese citizens may think there are too many Chinese in the United States already!

    In one word, none of us can vote in 5 years. Neither can we persuade the citizens we know.

    Then, why ED should mention high-skilled worker in an article for VOTE anyway?

    "For example, when employment-based visas are not used during the year they are authorized, they are lost and are not available for future use without special legislation. In FY 06, over 10,000 employment-based visas were lost, even though USCIS had an estimated 100,000 to 150,000 pending applications for employment-based green cards. Based on USCIS use of visa numbers as of May 2007, at present consumption rates approximately 40,000 visas will be lost in FY 07 without a dramatic increase in USCIS requests of visa numbers. As illustrated below, since 1994 there have been over 218,000 un-recaptured employment-based visas lost due to underutilization of the employment-based visas."

    Guys,
    First of all, please be decent to each other. Now, to the PBEC issue - this is a major problem, and a huge issue for all of us. Currently, the debate in Senate/Congress is centered around Immigration reform and this is a definitely a good time to raise these issues.

    There are a few things we should strive for:
    1. Keep all provisions of Specter's bill related to EB.
    2. Re-instate per country soft limit.

    If both of these provisions are passed, Priority dates for all countries will be current in EB2 and will rapidly move in EB3. A lot of folks in PBEC might be able to use PERM to apply another labor and priority dates will loose their importance, so it is important that these provisions pass.

    Its easy to say than to do it. Not everybody that have been wait in PBEC have a chance to do Perm. Not every company willing to redo the case.

    Senate should address legal immigration first before do the reform for Illegal immigration. They can keep give amnesty to million of illegal immigration, and million will come why ? one quick answer crapy system.

    If only they can create a better system (not like PBEC and DBEC) I believe US will have less ilegall immigrant.

    you guys who tough only retrogression issued is really narrow minded ( sorry for my frustration). This retrogression is only temporary relief for couple hundred thousand people. Still if they allow people to submit their i485. With DOL not doing their job right do you think you can get your greencard fast ?
    it's all depends on your luck.

    if they can't clear 35000 thousand case at PBEC now. Do you think they can process million greedcard application in a year ?

    Perm may process fast but it also create more greencard application per year + other family based greencard, L greencard and illegal immigration greencard (if the bill passed). There will be another retrogression and another backlog in the near future.

    Therefore the one that they should look into is to create a bill that build a better DOL administration :)

    What better way to open senate eyes about DOL Mess, PBEC case :)
    then Retrogression issue.
