i am looking for help in wrongful i485 denial of 485 with ac21 .
Below is my situation .

labor cert approved : 3/30/2004

I went through the Federal Firearm Law and here is what I found:
(d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person�

As per my understanding, if you are legally in the US, you can own a small firearm...walk into a store and tell them u need a gun and they will tell u what paper work you need or go to your local police station and ask the requirements. I agree with what most of the people here have said. The US economy is in a bigger hole and people buying houses isn't going to save it. It is going to take some creative and strict solutions from the Fed and the Govt to get the economy out of this mess.

Out of curiosity, what are your thoughts on ROW EB3?
I wouldn't expect any movement for EB3 ROW. I'd be happy if it doesn't retrogress further or turn out to be "U". I Base my assumption on the horizontal spillover from EB2 ROW to the rest of EB2 categories. If there is any movement for EB3 ROW i would guess it would come sometime in the 4th quarter.

NK2006 thanks for the post my family and I recently entered US using AP and fortunately we were not questioned at POE. I am in similar situation waiting for 485 and filed AC21 when I changed jobs after six months.
That is not to say that we will not have problem in future. You mention your wife showed them a copy of rules pertaining to AC21. Can you post a link or post them here.
My lawyer never advised me to carry any such documents.

Dude,
I am facing same issue....need to get some money back from India....and there is no way i can get it officially without losing significant part of it. It is really illogical to send money to India for property investment just because we cannot get money back.....I am repenting doing that....
Whenever I ask my friends to do this favor to me.....all they say is they dont have money to send India (since they dont want to disclose their worth to me) or they dont want to send money to India since they know it is useless to send money at such a bad conversion rate.
If you can find some better way, let me know too.

The recorded message at NVC says that on july 2nd they generated the fee bill and it was sent to my attorny. How long does it normally take to get the fee bill through. We are in the last week of jully now that 21days so far.

My only problem is where will these illegals join the line ("Hope they have to join the line somewhere"). If they join the line at the 140 stage directly ie if they dont require labor certification, then what about the 100s of thousands of people waiting for labor clearance (for example im waiting from Aug 2001).
If they join the line directly at 485 ie if they pass a law saying illegals who have been in this country for 5 years can adjust their status straight away. ie file for 485 right away, what about the guys waiting for labor or 140 with all kinds of wage RFE etcs?
I guess if that passes all the legals who arrived here before 2001 are covered anyway. All they have to do is destroy their passports, throw away their immigration docs and apply as an illegal. :-)

Retain these highly-skilld immigrats that the U.S. needs while American universities train more Americans in the sciences, math and technology that the country does NOT currently have and desperately needs to retain U.S. global leadership and competitiveness"...or something like that

If you want OCI, there are a few hoops to jump through -
1. Apply for an Indian passport first.
2. Once the Indian passport is issued, apply for the US passport.
3. Return the Indian passport after the US passport is issued. The consulate should return the Indian passport back to you, but keep a photocopy in case they don't.
4. Now you can apply for OCI on the grounds that your son once held an Indian passport.
His child is born in USA and thus his child is US Citizen and so he can only apply for US passport. He can not apply for Indian passport for his child.

6 months after GC is safer. The "6 months" is usually USCIS rough assumption for calculating "intent". Doest mean that you are absoulutely safe after 6 months. It doesnt mean that you are in danger before 6 months also.
You are supposed to have the "intent" to continue working for your GC employer AFTER getting your GC. The 6 months is to show that you HAD the intent, and after 6 months your intent changed.

I do have both Criminal attorney and Immigration attorney representing me, they say it should be fine. Again they say its upto the VO at POE. can I request the attorney to come to the airport during my POE time, so that i can request the VO to talk to my attorney?

After doing all this "very important" discussion about Rs/$ conversion, if you get sometime, please read some news about immigration bill to find out that there is lot of activity going on with the immigration bill. Most of the time anti-immigrats are calling and putting pressure on lawmakers who support any sort of immigration bill. That is why McCain, Brownback and many others backed out. Anti-immigrants are working overytime making it look like as if their opinion is the opinion of the entire nation. Each person is making 20-30 phone calls a week. But it is ok if none of us is doing anything. Lets all "time pass" and have this very important discussion about Rs/$ eachange rate variation... right?
Communities/groups/societies who do not understand the need to organize and standup for themselves always perish. Durbin-Grassley bill is just the beginning of the time for this high skilled immigrant community to disappear. Reason - When any group of people increases in number there is always another group which becomes its natural opponent/adversary. This community of over a million people also have very powerful opponent/adversary. That opponent is gaining strength and working overtime to purge all of us. But that is ok, let us talk about Rs/$ conversion rate. Anybody here from Uruguay or Morocco???
