USCIS issues Employment Authorization Documents (EAD) in the following categories:
EAD: This document proves you are allowed to work in the United States.
Renewal EAD: You should apply for a renewal EAD six months before your original EAD expires.
Replacement EAD: This document replaces a lost, stolen, or mutilated EAD. A replacement EAD also replaces an EAD that was issued with incorrect information, such as a misspelled name.
Interim EAD: If USCIS does not approve or deny your EAD application within 90 days (within 30 days for an asylum applicant; note: asylum applicants are eligible to file for EADs only after waiting 150 days from the date they filed their properly completed original asylum applications), you may request an interim EAD document.
If the EAD app is not approved in 90 days, we can request an interim.Doesn't sound like a big problem then.......Am i missing something? Some folks said Interim EAD have been discontinued....but this on their official website???

Citizenship is going to happen only after 5 years . But by then it would be long time gone .

They will know because when you fill out the N-400 application form, you are required to list your employment details for the last 5 years.

Guys, lets not divide the community again. Everyone is suffering in their own ways due to backlogs. I know some EB2 folks who got GC, got a home and now their home price is way down.
If we complain about discrimination, we don't have a case. Look at EB3-I distribution between 2003 and 2008, inclusive.

I have seen lots of posts about pre-adjudication..how do we know if any case has been pre-adjudicated or not?...recently i got an RFE on my spouse case for Marriage Certificate and Birth certificate bonafide..there is no RFE on my case and had an FP done on 08/11/2009 second time and noticed soft LUD on my case on the day of FP...dose this means they are working on my case...:confused::confused:

There are a few points to be made here.
First, there are many procedural votes and we are not always privy to the happenings behind the scenes. This was alluded to in other places.
Secondly, although it was defeated, there was a healthy simple majority and this augurs well for any reconciliation process.
Finally, any impetus for immigration provisions are likely to emerge form the house side, who have been seeing our plight up close. There are likley to be some behind the scenes arrangements made and the final agreement may look slightly different. For example getting Sen. Durbin's support by getting in the H1b restrictions will get the support of some more Democratic members, they could then proceed with the favourable provisions. All said however, it is likley they wil do this as a rider to some bill rather than in the glare of the public as a stand alone bill.
I just hope the staunch CIR folks, become a little more pragmatic and stop being a hindrance, and stop holding legal immigrants hostage to their issues. They after all call themselves pro-immigrant, right? Ironically convincing them of that seems to be our most difficult hurdle.

Hello,
With me having a pd even prior to of Mar 2002-EB3I, I thought I will join hands with IV to make something happen. To the extent I went and joined the IV chapter too.
Unfortunately, starting with the forum to most of the news that is being discussed seems to be not related to immigration at all. Example, accidents, investments, real estate. I feel the admin should be able to control and strictly adhere to what ImmigrationVoice stands for and delete any other unrelated threads.
Anyway, long story short, I feel IV has lost its focus and feels like for people who are looking at a proper approach to resolving problems, the web site does not give any reason or confidence, to follow or join hands for IV activities.
Just my opinion. Feel free to agree to disagree whoever would like to.
Not trying to blame anybody here, but sharing a viewpoint. In my opinion IV was great sometime back, but feel now there is a lack of direction.

In my opinion if you choose to use EAD, I think you will be very much fine with this route but with H1 transfer it will be tricky. You may have to go through 2 H1 transfer to come up clean legally. First H1 transfer to new employer and second H1 transfer to old employer again As you did not work for old employer for one yerar and hence no pay stubs and hence technically H1 dies there and so if old employer is willing "to hire again after one year" your old employer should file new h1 transfer and then you can come clean.
And during all this juggling make 2 things sure.
- You do not get promotion
- You do not get more than reasonable (10-20%) increment in the salary (The slary which was mentioned in your labor application)
Again before juggling consult the lawyer first.
I will be on EAD for the new job..and the LOA is vacation without pay. My salary is already 30% more than the one mentioned in labor but no promotions..new job has actually lower salary and job description similar.
If i do ger rfe for evl with me in new job then I hope salary doesnot become an issue

If you are not aware you could pass on your term life insurance proceedings to your heir
one of my family member have whole life for $81/month for $1m at the age of 28 in NJ, in this plan we will get back everything we paid after 30 years.

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.
Sending flowers, sending pizzas, sending all these proposals will only fall on deaf ears. Congress understands language of money to pass laws, Rest of the country/orgranizations understand language of laws/court.
For those who think assisting US economy by buy houses (for pending GC applicants) is like selling a GC are just plain dumb! No wonder why we dont have a resolution to the 10 yr waiting that's been killing EB immigrants, is because ppl like you, who love to take pain want others to live through this for the lifetime.
People have been waiting for 10+ years here waiting to get GC, waiting patiently, waiting so patiently that we are getting mentally sick waiting and waiting. How do u think the quota system is ..its not fair in the first place for EB immigrants when we are already here on H/L visas... . We the prospective, EB immigrants want to settle here. Its more than a home here already if you are living and paying taxes for 10+ years.. We just want to buy a house and a permanent visa status is only going to help. Its a win-win situation for both sides....

Most of us have good credit score and can afford to buy houses, this will only help the very thing that the govt. is trying to stabilize.
I'm surprised, how come IV is not aggressively pursuing this. What better way to help everyone here. If they want to address the fundamental issues they certainly can, but this the immediate focus and like quota recapture, will provide immediate relief to decades long wait for applicants!
So pls stop disparaging the effort. Its a good cause for both sides.
We want to be a permanent resident and contribute to US economy. So help us god!

I asked my attorney he said that I need to wait at least 1 more year. The Nov and Dec are gone in holidays. These Gov emp are worst then Indian Gov Emp.

"Retrogression" is the word for the rest of the year for EB3 (I). Learn it, Leave it (eat it, sleep it, drink it - whichever way you want it).
How about Dec. 2000 EB3-I for incoming bulletin? Then "Retrogression at will" as we move forward for the rest of the year. Now don't ask me how because anything is possible with (fill in the blanks).

I myself don't quite understand how exactly education and years of experience are translated into years of SVP. When on my PERM I had MS +5 years of experience required, they said on the denial notice: "The total time time for education, training, and experience entered on Form ETA 9089 equals 5". Which exceeds maximum of 4 years for level 7 (zone IV) and that's why they denied it (again, despite I didn't claim that that the requirements are "normal"). Apparently this 5 is not just experience years, nor just years of education. Does somebody understand how exactly the SVP time is calculated from degree and experience?

My son was on H4 and joined undergraduate course in Canada last year. He is Canadian permanent resident too. As per July VB, I can file for I-485. My question is:
1. Can I and my wife file I-485 as AOS and file I-824 to change AOS to CP for my son, so that he may file I-485 as CP from US Consulate, Montreal, Canada?
2. If not, what are the options?
