500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?

Bill rate? 70/30 basis?? Contract??? I would like the OP to report his employer to DoL. DoL and USCIS will kick both the OP and the employer. It is easy to get carried away saying that the employer is blood sucker etc. But very clearly, you should know that there can't be these kinds of contracts on H1. The employer knows that people who go to them are on thin ice, and so does the employee (employer is there to do business -- he is not running charity).
Maybe you guys want OP to go to DoL so that both the employer and OP get kicked out of this country (that is good for all of us) due to obvious immigration fraud.
To top it, OP goes on an offensive when people point of the bitter truth to him. This site should not promote illegal behavior, anybody seeking advise on these topics should be severely castigated, because they broke the law too (and they know it, just dont want to admit it). Or maybe we should encourage these people to report to DoL so that all of them can be punished for misusing the laws.
While I did not suggest him to go to DOL. Let me tell you that working on hourly wages is legal on H1. The best solution is to find the job quietly. How do you know how much is his employer making and what he has got? There could be very significant difference.

Pre-Adjudication is just a work flow method and not a policy. There is a high chance that a pre-adjudicated case may just get an approval when the visa numbers are available. But, who knows, they may have reasons to still issue an RFE requesting employment verification based on certain triggers such as change of address, over a year since case was pre-adjudicated etc.
So we may not be able to say for certain that all Pre-adjudicated cases will be approved when visa numbers are available.

I don't think the threads on IV should only be related to GC retrogression. Yes, retrogression is the primary objective of IV. But, there are other threads on IV that are related to non-retrogression issues and, are very informative like threads on 401K etc. Anything related to immigrants should be welcomed.

You mean to say sell US real estate for GC/citizenship? I don't see this going very far. I can see anti immigrants waiting for this one. Best is to lobby using aides of big corporations, developing relationship with lobbyists who already have connections, hiring lawyers, developing strong case, donations in election campaigns etc. All of this needs loads and loads of money. Are we ready to donate to IV and build strong lobbying group for our cause? That is the only way to change our current situation.

My intention/question here is if an applicant is on H1 (most of the cases 5th or 6th yr of H1) and then loose the job and until he finds other job (has EAD but never used it) the applicant does not have payroll running during the break. then technically is he ok or does he has to maintain h1 status or does EAD protect him.
Coz until he finds a job and files for AC21 an applicant does not do any thing.
And what do you mean by satisfy AC21 criteria. unless you find a job you cannot file AC21....so during the gap (what is the status of this gap?...technically I am trying to find an answer. please point me to a link or document. If you are aware of it, else can IV find an answer to it)

EAD IS NOT A STATUS. EAD is given because you filed 485 and you are pending AOS, so you are permitted to stay till a decision has been made

Even if the Labor cert says "Masters" then as long as you had BS + 5 years experience before you filed for labor, to qualify for EB2, this should be ok. Unless the BS was a three year degree and you did not have the required experience.
From USCIS perspective to qualify for EB2 you should be Masters or BS +5 experience.
I think if this is true you have a good chance to fight this.
Looking at the Labor cert , it says "Masters degree" and NOT "Masters or equalent". that might be the caused the I140 denial .

If the recapture of unused visas does happen, what is the estimate on how much EB3I would move?
Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.

Why the bloody hell are you guys judging him for what he has done? He only asked for some advise regarding immigration implications of his situation.
I do not think any of you who is beating him down like this has any right in doing so. I bet that each and every one of you have done more mistakes than Mr.Sahaayam did. You just were never caught. I have been now for 7 years and still waiting... my wife who graudated law with top honors in a top university in india and was pracicing with a leading corporate law firm joined me in US and to make it good we spent around $65K on her law school graduation here and then another 15K on bar exams preparations for NY and CA. She managed to pull through all this. we decided to have a baby and take care of her wihtout day care the 1st 2years. now my wife sits home since she cannot file a H1 though there are willing employers becuase she has stayed here for 6 years on h4 and my llabor filed 2001 was still in BEC.... what can i do... i left a Director job in fortune 50 company and joined as consultant so that i can make use of a pre-approved labor, then another regression happend and i am still waiting to file 485. I just want to let my wife to work for a couple of year and make use of the effort she spent in her US law school and bar exams and want to return back to India.... but when can i get that 2 years.....
