I just call them, was told that they have no additional information that what is available on the recorded message or the USCIS case status web site. I said I wanted to know if the case is 'pre-adjudicated' and the lady mentioned that that information is not disclosed. ;(

I have nothing more to say guys. what some people are saying is logic and what i'm saying is the fact.
Anyway, My lawyer used the PERM. right after i received my Labor I had to renew my H1b which took 6 months (regular processing). After i received my renewal I sent my I-140 application. I didn't even bother to use the premium processing for my i140 because the i485 was not current that time, instead it way way back as a EB3. anyway, you know the rest of the story.....

What do you mean "heart, mind, soul, ethics were sold"? How do you know that? Just because someone called the U.S president "his president" does not mean he/she sold anything, let alone someone's soul and ethics. That is their right to call the U.S president his or hers.

If one becomes a permanent resident of USA then also USA still only expects that person abide by the law of the land and do not involve in "anti USA" activity. It still does not expect "fidelity" towards USA in legal sense.There is no legal or social or political or any kind of pressure from USA or any governmental or non governmental institutes within USA on any particular person coming from other country to become its citizen. One can stay on permanent residency forever till death(At least based on current prevalent law) and legally work and s/he does not have to become a citizen for working legally. And I do not know about other countries but in India it is not considered "illegal" and/or "unpatriotic" to go in other country(Except Pakistan and Bangladesh) for legal work so coming to USA for legal work whether on work visa or becoming a permanent resident in USA while maintaining Indian citizenship simultaneously is not unpatriotic or illegal. Very unexpectedly, just last year in a hospital, the doctor told me that unless I get operated ASAP, there is not much chance for me to live. As I was still trying to digest that news, I was thinking...
***k the Green card. ***k my job. I just want to live few more years until my son grows to at least 18 (he was just 1-and-a-half at that time).
And I really laugh about the whole incident now. And when I see others vent or getting upset about something, I can't help but get a smile. Because I learnt the hard way that we never appreciate what we have got and always complains about what we haven't got.
It's New Year time!! Enjoy and cherish your presence. And forget about the job/visa for a day or two.

In theory, the idea that a gathering of even 200 people in company's parking lot (Cisco, goolge, microsoft) - IS GREAT.
Immigration Voice has always appreciated efforts of members who get employers involved.
However, I am inclined to believe that company HR will resist such activity on their own premises, especially during business hours or even lunch time. That's because its loss in terms of productivity and distractions for all employees, even those who are US citizens.
BUT...
If someone pulls this off and if there is a gathering to protest green card delays at any of these companies -- Cisco, Oracle, Microsoft, Google, Intel, Amazon...anyone...THEN IV leadership will fly to such an even from wherever they have to fly and attend it at a moments notice (provided your employer allows us in your buildings/premises of course).
Not only that, if you can pull it off, then IV will honor you will a "IMMIGRATION VOICE MEDAL OF HONOR" for doing that. Its a square medal with imprint of GC on one side and EAD card on another side. :):)
So if you can, by all means, pursue that opportunity and email me or Aman on how we can help you do that. Microsoft has 3500 employees in green card wait line in Seattle alone. Cisco is also hundreds of employees in San Jose alone (and Cisco employees is one of my favorite groups of people in IV, they have shown up every where IV has done anything...must be something in the water out there in the bay area, its a land of activists...).

I have one question: My I-485 applcation (employment based) was rejected due to I-130 attachment in error.
If USCIS reject my entire package of I-485 because I have attached I-130 application. What are my options? Is there any law that USCIS can only reject I-130 and accept I-485 appplications (myself and for my wife)? I have seperate fee checks for all the applications.

My I-140 was lost in mail just this year. My employer contacted USCIS, and they told him to file form I-824 (yeah, with fee). We did, and I got a duplicate approval notice back in about a month. So, if that's your case, here is the answer.
I did FOIA on my previous LC attempt (not I-140); it took over 6 months to get all documents back (you can request a CD instead of a stack of photocopies -- they'll scan all papers and burn the files on a CD for you). I've heard it's getting worse, in terms of response time.

(1) If you decided to change to new employer using EAD - there is nothing you need to do. Just join and work.
(2) As employer is asking what they need to do - tell them they need to provide an AC21 letter of support - you can find various formats on the web.
(3) Your new job must be in same or similar category.
(4) Call customer service to verify your address on file - also hire a personal attorney and make sure they file g 28 and have them on file too for USCIS communication
(5) Your AC21 letter may/may not reach your file depending on the service center, officer and a lot of other factors.
(6) Usually most AC21 cases go through just fine unless your ex employer requests a revoke on i 140 - in such a situation you may get an RFE, NOID or a straight denial on 485 - nothing to worry about - you can resolve all these and you will find yourself back on track.

PD movement results in both 485 approvals + new 485 filings. CIS blames backlogs partly due to the policy that allows 485 filing whenever PDs are current. if PD movement results in 5 approvals, it also results in 10 new 485 filings and thus a backlog is built over which they have no control.
So in their opinion, PD movement should only control approvals & 485 filings should be controlled separately. If this happens, there would no backlogs and no one will ask them any questions or drag them to court for hearings!

This is simply putting cart in front of horse ... he hasn't been president for more than 9 months and hasn't solved a single economic problem our country is facing.
And if being simply president was creterion than our ex-presidente (Mr Cheney ... oops Mr. Bush ;)) would had got 8 noble prizes + 4 from Papa. It re-inforces my opinion that europeans are ... simply out of touch w/ reality. Look america has already showed world, it can elect a black as a president from country of pre-dominatly white ( still white, check census). And what have these european self-labeled-elites done comparably?
