My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.

I have couple friends who moved to Australia 3-4 years back, they love it. they mentioned that they have already applied for citizenship. 3 years back we decided against migrating there because our PD was almost current, we are still waiting. :)

I have applied for my H1b extension back in April......Have not heard anything yet........once I get my H1b approval, can I apply for H4 extension from inside the country?? (Is that even required if you are already in AOS pending status?)
No, it not required but maintaining H1/H4 status allows person to remain in USA and apply for appeal if, for some reason, I-485 is denied. Otherwise, person is out of status from the date I-485 was denied.

Federal law does allow H-1Bs to purchase firearms if they have lived in the US (Same residence, if you move, the clock is reset) continuously (if you leave the country, the clock is again reset) for 90 days and fall under one of the 4 exceptions listed below.
- Possess a valid (unexpired) hunting license issued by any state in the US
- Are a Law enforcement officer from a foreign nation, here on official duty
- in the US to participate in a shooting sports competition
- get a waiver from the Attorney General
The easiest of these 4 exceptions is the Hunting license exception.
Once you meet the above mentioned criteria, you are okay, per federal law to possess a firearm. Doesn't matter what non-immigrant visa you are on (H-1B, F-1, AOS).
Next step is to check whether your state has additional restrictions. I don't think any states completely bars non-citizens from possessing firearms (atleast none of the states that I have lived in do), although some states have restrictions on the type of firearms non citizens can buy. e.g. in MA, non-citizens (including GC holders) can't buy handguns or high powered semi auto rifles (ARs, AKs) but they can buy non-large capacity rifles and shotguns.
As someone pointed out, trying out guns at a public range which has rentals is a great way to introduce oneself to the sport, learn basic firearm operation and safety, and to try a wide variety of guns and calibers.

IV has it's own lobbyists and has been using their services to get Green Card increases attached to various bills. Good lobbyists cost a lot of money like good attorneys. Though IV has hired the services of one of the top 10 lobbying firms, IV is limited by funds in utilizing their services. Most of IVs funding comes from few recurring contributors and other members who contribute one-time every now and then. Most of the money gets spent on these lobbying efforts.

Hi,
I am also in the same boat and waiting for the approval as I have recently took a new job with EAD. Yesterday I called USCIS to check what the options are if I don't get my EAD in 90 days. The customer service representative told me to take an info appointment further to get the Interim EAD. I have explained him that local offices are not giving Interim EADs and surprisingly he told me the following thing.
"You can continue the work with I765 receipt notice provided your employer is OK to continue and told me to provide the receipt notice to the employer as a proof of your application is in pending. As I am surely aware of the fact that in order to continue the work we must have an approved physical EAD. I was totally surprised and asked him "Are you sure?? can we continue the work with the receipt??", he replied "Yes and only if your employer agrees for that!"
I have no clue???? What to do, friends please share your thoughts on this.
Hope you noted the officers's ID number. if not, call again and see if you can get similar reply with some other officer. If you get the reply, try to get it in writing and also get the officers ID number, note the date and time.

Guys ! I know couple months ago a lot of us got RFE's and the status says " response received and cased resumed" but nothing after that , do you'll think that they might look into our files even with different PD dates.
I received RFE and later after submission of requested documents, the satus is now 'recieved and case resumed". Is it possible to know if a case is pre-adjudicated?

1. if your company pays for everything, why such reluctance to put up a few more dollars for your own cause? think of those that pay for everything themselves and still contribute.
2. each contribution to paypal costs, they take a chunk off it. making small 10 buck contribution is really not the intelligent way to go.
3. there used to be a 20/mnth recurring contribution. now it does no exist. what do you want? should we throw out the original 20 buck guys? of course they can continue doing it. i can't imagine why it would put you off? btw we did not really lose any money by going to a minimum of 50- you know why? those who were serious still contributed. others who were whining at that time (why is there not a 10/mnth option) were in many (though not all) cases not going to contribute anyway. this is just fyi.
4. what is 50 bucks a month? step back and think sometime. a family meal/movie? do you indulge yourself occasionally worth 50 bucks?
i think in many cases the answer is yes. the money we need for lobbying ie very large....it's hard to make it form 20 bucks at a time when barely 5% of the membership contributes.
you have the choice hereof donating 100 now and considering it as two 50 buck donations, so your next one will be delayed. there are various ways of looking at this.

It is a personal choice plus the level of risk you take, I bought my house before my GC was approved and here I am now. Setting aside GC concern, the only problem you might face is securing a loan with good rate, all lowest rate that you notice in internet banner or Bank flyer is not applicable to you, simple reason H1b Visa is considered as temporary Visa, once your loan application is taken by a banker, one of the question in loan app. pertain to Citizenship, if you're US citizen or GC holder then chances of getting loan with lower rate is higher(though many factors contribute to lower rate and loan approval), but if a person on H1B visa approach for a home loan, then Under writers perceive you as high risk borrower, some bank may deny loan if you claim as H1B visa holder, but some banks will approve loan but on higher rate.
In my case I was on EAD when my loan was approved, it was a hell lot of problem in convincing UW to approve loan, I approached my lawyer to get a letter stating that a person on EAD is one step closer to GC to get final approval, still I ended up taking 0.25 % more rate.

Company A CANNOT revoke approved I-140. I have checked this with 3 to 4 attorneys & also with Gurus on this forum. Only the USCIS has the authority to cancel the approved I-140, if it detects that it was obtained fraudulently.
One more suggestion, ask company B to file your H1 with Premium processing. Once you get H1 approval then submit resignation to Company A.
