i feel frustrated at some peoples' unwillingness to admit that eb3 needs iv's help now more than ever. They are saying that nothing much can be done for eb3, as ins merely corrected its wrong interpretation in visa allocation
I went to the advocacy days in DC this June, and the biggest push IV was/is making - country cap elimination. The biggest benefactor of this change is EB3 (eb2 will be helped too, but that is how INS preference system works) - again, the biggest benefactor of this legislative change is eb3. IV has been pushing this issue over and over - try reaching out about town hall meetings or any such meetings with lawmakers - and you will figure out how much iv is working on behalf of eb3. Unfortunately, not many eb3 were active until the last 2 vbs. So, please do not say, "nothing much can be done for eb3" or "IV is not working for EB3". Its just that you may not see value in the route that IV is pursuing. It is eb3 members' unwillingness to admit that IV needs grass root help more than ever now.
but, if we are all willing to put our hearts and minds to it we can surely come up with new ideas that will help our cause. Surely, laws are written so that justice can happen. So if justice is not happening, the law would have some answer, somewhere.

cal_dood, couldn't make out clearly what you said. However, the main point I guess is to contribute to AILF, right? I would say yes, but not directly. The best option would be to contribute to the IV and let them know that you want the money to go to the AILF. I am sure that is what IV is planning to. It doesn't make sense to fight 2 wars against the same enemy. But said that the AILF has made requests for contributions but not very seriously. The main thing they want is to join the case and even that (the numbers required) I believe is already accomplished. So sit back and enjoy the summer, while spreading the message of this injustice.

Total applciation that can be approved : 300k
40% indian applicants (approvable) : 120k
40% EB2 India (approvable) : 48K (can range between 40k and 60k)

I do not think that they above restrictions will be in the CIR bill for H1-Bwhen it passes. We know, the tech companies know and most of the law makers know that they need us.. There will be an H1-B increase, restrictions removed and there will be a provition made in parallel to the merit system for EB green cards.
Our job is to get backlog relief.. How we do it is the question....
If people think that after CIR fails, we will have a better chance of getting favorable provisions with some other Bill or on coat tails of appropriation bills, it could be a risky gamble.
However, looking at the mood of Senate there is a very good chance that post-CIR we might be thrown a curve ball with some hard line H1B restrictions and fee increases extracted from almost passed CIR. So opposing CIR due to H1 alone is not the best strategy.
CIR is on the table because there are lot of interests driving its existence. If Compete America and us(IV) cannot drive in a small amendment into a popular bill like this, it would be a big blow. Is there enough bite in the coalition to create our own bill or fight an anti-H1 wave out there? That's up for judgement.
My point is, please do not assume H1B status quo will stay that way even if CIR fails. Like someone pointed out in these forums, big Corporations might enlist these anti-consulting restrictions/fee increases and use as compromise to increase H1 numbers(even post CIR).
And we thought life was tough now, imagine paying 10K for every H1 extension and not being able to consult and status quo on current GC system still place. Thats a hair raising thought for me.

Our best bet is to partner with groups/org (hi-tech lobby) that have as members big firms that are impacted by this. This would give us a more directed approach on opposing.
I am trying to identify the group of immigrants impacted by this rule-making and was trying to highlight that the rule restricts DHS from approving visa petitions from Employers.
As such EADs are not filed by employers and moreover are not Visa application.

What I am saying is spill over from ROW goes to EB2 first. It does not split to EB2 and EB3 evenly. So more people from EB2 gets visa granted and thus people who joined EB2 bandwagon from EB3 and had earlier PD, they get Visa quickly. Now generally this spillover does not go to EB3 from EB2 having high demand from EB2 and thus EB3 get stuck with conventional numbers with 7% country limit and thus EB3 numbers move slowly. But if that spillover happens for both EB3 and 2 equally than EB3 can also move little bit quickly which is not the case. Thus shortening the queue by switching over to EB2 does not give full advantage to remained lot of EB3.

I'm having less and less faith in the claims made by members that USCIS is inefficient and clueless. ok, they have been and continue to be in many areas:):). However, they have a game plan this time. In retrospect, we know they had a game plan in June 07 also.
There are several unknown variables (repeatedly and extensively discussed here)which make accurate prediction impossible for us. However, USCIS has the numbers of RIPE CASES. And they moved the dates based on the availability of remaining GC numbers for this fiscal AND the ripe cases.
They could have moved it to just Dec 2005, instead they moved it all the way to June 2006.
Best\ optimistic scenario- Most EB-2-I cases upto June 2006 will be adjudicated before Oct 1st.
Conservative scenario-Upto at least Dec 2005 PD all cases will be adjudicated , and a few CP cases into early 2006 will be adjudicated. With spillovers happening in each quarter, the PD should continue to move.

Look, no one is saying that McCain is the savior, but at the same time, it is important for us to understand that Obama is not the light at the end of the tunnel, its the fast approaching train towards us. So, some of us are just pointing to others that be prepared for the train wreck. That does not necessarily translate into saying that McCain is the savior. It just means what it means.
And you are right, none of us can vote. But if this community supports Obama, its like 300 million Americans voting for the President who works against the interest of majority of Americans. Won't we also be guided by the "misguided" ideology and rhetoric if we act in the same manner.

There are many business models and you need to be aware of how each model works. There are a lot of companies, banks, insurance companies, even small and medium manufacturing companies that hire contractors for developing IT applications. They remain contractors for a reason - once the application has been developed - the contractors turn over the application to the company for maintenance and enhancements. A small percentage of contractors stay on and become permanant employees - but others move on. It would not be cost efficient for those companies to hire all developers as FTEs - the cost associated with benifits, taxes, 401K, etc are much more costly than having a contractor. Ofcourse, they can lay-off the employees after the project is completed - but what would that do to their reputation? Any company that follows a "hire-and-fire" policy cannot survive long.
Let me give you a simple real life analogy. Let us say that you have a decent family sized car that you and your family use on a daily basis. Then let us say you want to go on a vacation with your friends family. What would you do in this case? Would you go out and buy a mini-van? Or would you rent one?

On a different note, Congressman Gutierrez is a true leader. He took the lead in sponsoring COMPREHENSIVE IMMIGRATION REFORM bill. Congress is full of people who do not look at the merit of the issue but simple look at the polls to decide their stand on the issue. Congressman Gutierrez showed exceptional courage and quality of a true leader by sponsoring STRIVE bill. If you don’t know, STRIVE bill has very good provisions to end green card backlog. But of’course, why would you care, you are simply dying to go back and simply wanted to show to the crowed that you are better than others. How the hell do you expect a Congressman to answer a question that is meant for an immigration counselor/attorney? To begin with, why did you even ask such a question in this event? Do you have any idea what Immigration Voice is about? When you are saying you want to go back, why don’t you simply leave? Why the hell is there a need for you to come to a meeting and ask a question that does not represent the problems of the majority and the representative sample of IV members? It would be one thing if your question represented the problem in general. But it is entirely different thing when you come to such event and want to get answers for your question so that you don’t have to pay $100 to an immigration attorney. I truly feel ashamed of being called as “highly skilled” immigrant when elitist like you ask such stupid question. On a different note, Congressman Gutierrez is a true leader. He took the lead in sponsoring COMPREHENSIVE IMMIGRATION REFORM bill. Congress is full of people who do not look at the merit of the issue but simple look at the polls to decide their stand on the issue. Congressman Gutierrez showed exceptional courage and quality of a true leader by sponsoring STRIVE bill. If you don’t know, STRIVE bill has very good provisions to end green card backlog. But of’course, why would you care, you are simply dying to go back and simply wanted to show to the crowed that you are better than others. I also got my "Card production ordered" status few days back.
however I also received a mail for biometrics appointment of 05/02?
the biometrics letter date is 4/14 and my "Card production" status change was on 04/21.
why would they send me a biometrics appointment and then approve my 485 and issue me a GC? is this common?
should I still go for the biometrics appointment or just ignore it, I'm assuming that i'd have my physical GC in had before 05/02
