Its illegal for an employer to charge for H1B. You cannot expect employee to know and enforce the law. Employers know its illegal to charge money and in this case his employer is in violation of law.
I wasn't moral policing, I was just laying out the legal stand that anybody can have under these circumstances. I am sure that the so called "Desi shop owner" is not so dumb to so flagrantly violate the law when his employee is going by the book, unless the employee is seriously gullible.

As I understand, if we win the lawsuit, they will accept all 485 filed in July, no matter July 2 or 31. But they will process July 2 case first.
In its note http://www.uscis.gov/files/pressrelease/VisaBulletin2Jul07.pdf, the USCIS clearly says it would reject applications starting 7/2. So, how can it accept July applications--especially when many of them haven't been sent yet?

Even I was thinking on the same lines and discussing with my friends. My son travel with us using PIO. But I was thinking to apply for the OCI.
Now the question is Pros and cons of OCI on PIO.
With OCI pro is
- one can live in India as long as he wants.
- Donot have to pay NRI fees in the school and colleges.
Cons -
Indian law will be applicable, means something happens US government won't do anything.
Rest of the NRI rules are applicable, no right to vote, limitation on kind of investments
Guys this is all I know, put more together so that everyone of us in the similar situation can make a decision.

I applied for PIO card for my son and daughter and both was rejected as both me and my wife are Indian citizens. I was under the impression that kids who hold PIO card need not have to pay NRI fees during college. Is this something true?

I think there are plenty of people who always planned to go back .. the GC /USC was just a career advancement tool for these people. In fact, a survey of US returnees to India after 2000 shows that the majority (around 60%) were USCs/ GC holders, which is clearly an indication that the relocation was by choice rather than any immigration issues.
There are many factors which make the adjustment/re-starting issues bearable : In many cases, the country you will go back to will be a much improved place from the one you left.Besides, many of us immigrated not because we were desperate to get out of our home country; but rather because at that particular point in our careers going abroad was the best way forward. After close to decade's worth of experience in USA, many find that the best way forward now is to go back to your home country .. thats becoming more and more common with globalization. And finally, many of us have family issues like taking care of aged parents which either makes the re-location inevitable or in some cases may coincide with career goals.
Personally, i think returning to one's home country solely because of retrogression is not advisable and has the potential to cause lots of frustration and disappointment.
I just wanted to get this discussion back on track of ppl wanting to be able rise up a little, let their wives work and feel the freedom to make a decision to go back.

But let's assume things start moving and we get our GC's in a year or so. the main question is how do we increase membership .. the answer to that has to be in meaningful and visible campaigns.

i really appreciate and applaud what you and other members of immigration voice and other pro-imigration groups have done but for personal reasons i believe that fighting the congress is a losing battle and i sincerely doubt if we'll have any pro-immigration bill passed before the 2008 presidential election and when the new president comes this will fall att the bottom of his/her agenda. Look at Bush's tenure he's promised pro-immigration measures since 2004 and squat has happened. The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

I am not sure, if this topic has any merit. But, basically what we can learn is that, it is difficult to legally fight corporates, though I do not intend to discourage people, if there is any issue based on race or gender, going to HR may seem to be the right way, but 95% of cases, that will not work in favour of u, rather will work against you, especially being on H1b.
The reason I opened this topic for discussion is to see if it helps folks understand how certain things can affect ur path to GC. This is one aspect that you have to atch out in your journey towards GC.

I'm not sure about the usefulness of this poll? If you look at the percentage of people applied on 2nd July, it is close to 70%. Assuming some error in the polling percentage, this poll indicates that atleast 50% of people have appplied already on 2nd July. As per the press reports, USCIS has received around 55000 applications on 18th July. That means another 55000 people only are going to apply by 17th Aug making a total of 110,000 plus minus 20,000. I do not believe this number and the poll. Any arguments here?

Lot of people , who otherwise would have qualified for Eb2 went ahead with EB3. First of all why did you you agree to it. Because, that time, that was something easy to get instead of changing it to EB2. That was the fight under your control. Not the one you are asking for.
Someone rightly said, you need one scientist,2 qualified/experience guys and 6 eb3 guys to do actual work. A right pyramid for an organisation.
But how can you miss govt. requirement. They need more PhDs. So they are asking us to do more study, earn more higher advanced degrees because thats what they need. Not our so called BE/Btech degree. In another 4-5 years, I wont be surprised, if only guys with masters will be only allowed to apply, if they find equal number of master graduates. Who cares for ordinary graduates. EB3 min qual will be raised to Masters with 5 years experience. What will be your say then ?
So look ahead and act accordingly. Make sure you can anticpate their moves. Its not a rocket science. 6-7 years back, there wasnt much application for EB category. But looking at the last year number, I wont be suprised, if they decide to raise the criteria bar. Simple, and all backlogs will be over. The reason they are not doing this because they still need eb3/eb2. But not in quantity, you would like them to but rather what they would like to have.
As far as country uota is concerned, everyone knows China and India, over populous contry. You increase the number to a million, and that would also fall short. But then they do not want so many people from a single country, as it will have a lot of political ramification in the future.
You are making up things here; Eb1->Eb2->Eb3 is correct only from education and experience for the Job point of view but not true from Quota point of view.

True! People with PD's closer to the current PD's can anxiously wait on the next bulletin to see if their PD will become current. It doesnt make sense to discuss the same point over and over when aplicants PD is far away from being current. Does it? It doesnt help to have a prediction thread for the next 2 months on the forum's mostly discussed topics. Does it? The worst part is it is infecticous and every one does it.

I think what Godbless bought was Universal Life Insurance policy where the Company invests in Mutual funds etc. but that has lots of finance charges and hidden costs. Traditional Whole Life on the other hand has no such thing because by law the company can only buy bonds, govt securities and Mortgages only. Hence the return on Traditional Whole Life policies is low (5-6%) but they are safe and do not have hidden charges and infact insure you at a fixed cost for whole life hence the premium never changes and policy cost to the insured remains fixed while the cash value is an added incentive for the long term. It's like putting money in bank and earning some interest but having a life coverage at the same time for not just 20-30 yrs but uptil 98 years of age. I have a few family members who are insurance agents and they always recommend Traditional Whole Life if you have good income and patience to stay long. For all other folks Term is the best but note that when you retire at 60+ and have built immovable assets then to cover the risk for them you need to have some Life insurance policy and getting Term at that age is like walking on fire. Nobody gives Term after 65+ and even if they do so then the premium is very very hefty which can be a good turnoff.
So, it all depends on your priorities and situation. 95% of US Citizens / PRs with above average asset values & income buy Traditional Whole Life policy because they are living longer and working longer and building assets well into their 60+. Term provides good & cheap coverage for young people but only for max 30 years period. After 60 + people are in soup again without Traditional Whole Life coverage.
