You can apply H1 extn earlier than 6 months. Mine was expiring in Sep 07. I applied on Jan 5th 07. Got 7-8-9 year extn in March.

Efiled @ TSC on may 29th.
FP on june 28th, still no approval.
My current EAD expires September 24th and i am working on EAD currently.
Called USCIS and opened a SR on August 4th. Got a letter on August 11th, saying, although my situation is serious, i have not provided enough proof. Called USCIS August 13th, asking where i can mail the proof. Was told there is no mailing address and no fax number.
Scheduled an Infoapss Appt. for August 18th, by then it will be around 82 days.
Around the 90th day planning to meet my Congressman/Senator and hoping they could help me.
If some one can help me in finding fax number to TSC to send in my Expedite request it will be great.

Need Approval in Hand.. Receipt Notice Does not work in most of the states and new states are adding this as requirement every month...

Lots of future immigrants are facing this.. But we need a collective voice as usual with any immigrant issue to get a resolution.. More and more states are joining to make Driver License as your "Immigration Status Document" causing "LEGAL to work but NOT LEGAL to drive" situation....

as per the law u can switch employers after 180 days from recipt of ur 485 application...unless the CBP wants to give u a hard time...he should not jerk u around on that....

I am not sure how encouraging it will be for you to hear about some of our friends in tristate area.
Pretty much like you (Desi employers, 80/20 or 70/30 arrangements, found contracts through dice/monster/hotjobs, filed in jul 07 fiasco and AC21'ed off to full time positions). There is nothing wrong with these arrangements but unfortunately they are considered pretty much illegal from the H1b & immigration point of view.
Employers of many of them who have received their GC and many who are pending are currently being investigated. First they closed the gaping hole called substitution and now they are after all these sketchy employers and the petitions pending/approved through them.
It sucks for people whose petitions have been approved and are now trying to crystallize their lives by buying homes, etc. Administration holds the trump card in that they can revoke GC/citizenship anytime.
Few of these desi employers were nice enough to notify the beneficiaries. Many of these cases involve people who filed for EB2 i-140 to capture their EB3 dates after changing employers.

If our parents stay in US, US economy will improved. We will be buying health insurance and food for them.
We will stop sending money to our native country. All money we earned will be spend here. We will be travelling more. Shopping more. etc.
This will help to improve US economy. I want to see US become super country like how it was when Bill Clinton was president.
We have a great present now. I was impressed by his speech about family value and raising kids together as family. I am sure, we will get help from him.
You know, How J2 visa holder got permission to work in US. A person fight for it and got it for many.

Hi everyone.
I was part of the San Jose rally .. where there were about 300 odd people.
My neighbors had been to the immigration rally in Washington(flew from San Jose) and they said that there were about 1000 people there.
I have been following the immigration issues for sometime .. and I'm not very convinced that such small numbers can make the difference.
Silicon Valley has maybe a 100,000 Indian engineers or more. Add families .. and a much higher number. Add Chinese and European immigrants .. and you have all of Silicon valley :)
We should hold a huge rally say in the campus of some company like Cisco .. or Google(who are immigrant friendly) on a work day .. say Friday lunch time .. and have everyone attend.
Being in Cisco .. you can pretty much get all their employees to attend... which is substantial.
Also have industry people talking in favor of better immigration policies.
(we could hold it in some other company or a common area .. anything works)
Unless we can have a substantial number of folks say 10,000 or more .. I don't honestly see too much of a point.
Even if IV collects a few million dollars .. and lobbies .. it will never have the impact of 10000 people protesting.
We need to see if we can have similar rallies ever month in major hubs like New York, Washington, Seattle, Houston.
Unless we have s sustained campaign and we have the numbers .. I personally do not see things really changing.
I see people being optimistic about 300 folks in San Jose rally and 1000 in Washington. But having been to the rally in San Jose I don't see how 3 times that number in Washington is going to cut it. (Read Logiclife's post ... but we still need the numbers !!)
I'm not being a pessimist .. appreciate all the efforts that IV core undertakes .. but am totally unconvinced of major immigration changes. Looking at something like CIR being struck down .. after being on television for long and being debated .. I think we should get real.

I am not sure what is the level of support among American colleagues in Silicon valley, but their presence in significant numbers would make the biggest impact on the observers. I am sure there are those who see the bad in keeping talent out, many times the lack of certain skills needed might end up causing the whole project to be outsourced.
If that makes national news and you are right it would take about 10K or so for that to happen, then our cause is likely to get more visibility.

This Tracker facility we have in IV is good. Kudos to the Admin team who implemented this thing.
These are my observations. I could be grossly mistaken. Pardon me if I am wrong.
There are approximately 26,000 people who have put in their priority dates and other such data in the tracker. When I compared similar cases, I got some 265 who were EB3 India with a priority date in 2002. That is approximately 1 %, give or take.

Does that mean I could get my GC this year.

Buddy, your tone sounds hostile and as I said we're staying here by choice - but let me tell you this, after getting an MBA (with financial aid) from a decent school here, staying here for a decade, getting into upper management of a large company and having US born kids, I'm relocating to India after the summer. I've just secured admission for my first born from here and it went without a single glitch.
So, YES, I've tried it, I'm pretty darn willing to and I got a strong pair of balls!

Please note that the Form I140 is no longer valid for porting purpose under section 106� of AC21 if the I140 was revoked due to the fact that you did not meet the minimum requirements for the labor certificate at the time of filing. Due to the fact that beneficiary of the For I140 was found to be �unqualified� at the time of filing you are not eligible for relied under section 106� of AC21.

I hope 180 days had passed after 140 approval. A little more detail on the case will be appreciated. Was it a case of substituted labor?

Get the help of your attorney ASAP. Figure out if there is a way to undo the damage.
I am not very sure of the details, a person I used to know was forced to join his previous company because they threatened him in similar lines.
& please do keep us informed along the way. We may be able to be of assistance to you in some way or the other. Local IV chapters have access to local Congressmen etc.
If nothing works go kick the ass of the person who is responsible for your predicament. Interpret kick ass to more severe alternatives. Some companies are anyway taking advantage of people stuck in GC queue. On top of that if they harm us they need to pay a heavy price.

I have a question about leave of absense. Does it mean that you are still employed with them if you apply for LOA? If yes then you cannot work for another employer at the same time, not on H1B atleast.
I would like the gurus to share their opinion of the following option:
Join the new job and start working there. If there is an RFE in future then you can go to your old employer and ask for a offer letter (with the promise that you may or may not joined them) and also one from your current (old) employer. If the adjucating officer says that the letter from the current employer does not qualify under the same/similar category then you can show him the letter from the old employer offering you a job. This will satisfy the requirements of having a job offer at the time of adjudication. Though in this case you will have to join your old employer.
Gurus: Is this possible? Or are there kinks in this theory?

Some more info that may help you. Once you the get exact reason for denial and if it is because of AC21 wrongful denial then file Form to Ombudsman and attach your employment letter with clear job description showing you work in same/similar classification, explaining that you fulfilled AC21 conditions and that your I-485 was wrongfully denied along with your MTR receipt (once you file MTR).
Please note this is from what I have read other posts on this board and not from my personal experience. Also IV would also be able to guide you in resolving this situation.

There is great opportunity for collaboration between IV and USINPAC. USINPAC stands to gain future members from those of us who graduate to a GC. IVs mailing list would be an extremely valuable tool in this regard.
As IV members graduate to a GC, they have to evaulate what political causes they want to support. The absence of a viable PAC supporting the cause of skilled legal immigration is also an opportunity for the future evolution of IV, where establishing a PAC supported by contributions from IV graduates will reinforce IVs message.

My sincere advice to the OP is to avoid posting such sensitive questions on a public board (as can be seen from the backlash by a majority of the posters).
OP , your best bet would be to get a consultation done with an immigration lawyer. And don't worry about others labeling you as a criminal, what's done is done, the important thing is that you learn from your mistakes and never do this again. good luck.

I guess I should be ecstatic! I was able to renew my Mass driver's license online...no going to the DMV, no (pointless) check of random documents, no rude state officials. I received a 5 year driver's license (my 8th yr H1-B expires next year) in the mail within 7 days of my online application.
Moral of the story...move to Massachusetts! :)
