My wife is on H4 visa with a valid I-94 (till Feb 2009) but her status will be on H1 from Oct 1st, 2007. Do we need to go for stamping before she starts working. Also who applies for SSN - Her employer and do we need to file ourselves. The employer kept the original H1. Do we need the original to apply for SSN? How soon can we apply for SSN?
Thanks in advance.
You dont need to stamp your passport before you start working. Stamp is only needed to get into the US.
I think you have to go yourself and apply for SSN unless employer tells you otherwise. That's what my wife did. There are SSN offices everywhere. You can apply right away. Make sure you apply ASAP because unless you get your SSN, you cannot be paid and it takes a few days to get it. You need original documents. More information here (http://www.ssa.gov/online/ss-5.pdf).

I am an American, born and raised in the US and I wholly support Team IV. This initiative not only supports IV, but also helps prevent childhood obesity in the US which are two very important issues that we currently face. Being an avid runner, I am always looking for worthy causes to support via running and I am excited to be a part of this Team.

Thanks Mark for your posting
Please do not get me wrong, I fully support the work IV does and the need for more visa numbers, backlogs, errors etc., and would like to help iv in any way I can, as I sure others who's children have aged out do too but we are desperate and crying out for help with no one to turn to. If you need me to attend any meetings in Florida on behalf of IV, please let me know
So if you can suggest any pointers where we could raise the work of iv and awareness to the need for compassionate age out cases to be approved that would be great
I do appreciate iv cannot diversify or ask for too much otherwise nobody will gain anything. Just a mom airing her anger, upset and frustration of having to sue the USCIS to be reunited with my one son who has aged out

The fees quoted in this posting are incorrect, please double check the amount on each form as you download. I have just filed and I 485 is $325 + fingerprinting fee, I 765 is $180. Be sure to get your checks right when you have waited so long you do not want to give the USCIS reason to send your application back for the sake of a few dollars missing from the fee.
Hi to all,
These fees are as per Dec '04. These details are to give an idea only. Some of the information may be out dated like fees. But the lists of documents are right. You need all these documents fro each petitioner.

Thanks guys for sharing your knowledge. I am not into DT or anything but the read certainly helps in understanding how the financial markets work, beyond the simple buys and sells that people generally see.

With this attitude and arrogance, I rarely think there would be motivation for anyone to do anything for IV.

Please read my initial post before commenting. I always said, I am for IV cause. just convince me so that I can convince some one
Gisa pita dialogue,...dont ask what IV has done,, ask yourself what you have done... COMMON
Here it is, I can write in BOLD and RED
No one is going to waste time in convincing you. If you are not convinced but you think green card is an important issue, then start your own organization, spend your money, provide customer service and convince others, like the way you want others to convince you. Maybe you will do a better job.
The $1/bill in Indian restaurant is the most foolish of all the ideas. Indian restaurants don't let waiters/servers take $1 tip, you think you can let them raise $1 for you? A great soul said - Be the change you want to see in the world. Why don't you start your organization and do the things you are telling others to do for you? That way you will not have to read this forum or reply to posts you don't seem to like.

I don't have clear picture on what IV is planning to do now except that FOIA drive. I request the core team to inform all IV members explicitly about their plan. I guess there will be more donations than they expect.
suggestion: while sending emails that there is a reply to your post, they should also add the actions they have been/ or planning to take.
Good luck with that - They will respond when they want to. Atleast seems like it.

Subject: Follow-up to Update on July Visa Availability
Further to the email earlier today about July visa availability:
Several members have asked whether they should continue in their efforts to
file adjustment of status applications for employment-based cases. Of course
, this is a matter for each attorney's best judgment, but note that:
-It is not certain what day the revised Bulletin will be issued.
-It is possible that the revised bulletin will not issue at all--efforts to
stop this unprecedented action are being pursued.
-If you "front desk" the application, i.e. decide it is futile to file, and
a remedy opens up later, having submitted the applications may improve the
chances of utlizing whatever fix might be available.
-If you do submit the adjustments, be sure to use a method whereby you can
document delivery, and keep that documentation for each client.
-AILF's Legal Action Center is seeking plaintiffs with respect to both the
adjustment applications that were or are expected to be rejected for June
and the adjustment applications that are expected to be rejected in July. Go
to InfoNet Document # 07062975: http://www.aila.org/content/default.aspx?docid=22798 on InfoNet for the Potential Plaintiff Questionnaire and related FAQ.
We cannot predict now what will happen, but will continue to update the
membership as developments occur.

It's better to apply for 485 after getting the H4 stamp. Once you leave the country it is considered abandoning the green card application. So you may have trouble getting a visa stamp. I may be wrong. So once you get your H4 stamp then you can come in with a valid H4. If you are planning to travel only in July why not file 485 and Advance parole then you can travel with Advance Parole as a backup. It's just my opinion.
My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?
3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? Should I wait and apply for I-485 or EAD until Sept 2007?
In short: Could anyone please advise regarding the risks of filing in June the I-485, travel in July, have a consulate appointment abroad in August to stamp the H-4 visa that expires in Nov 2007 ? Should I wait until I come back? Much appreciated any replies.
