Do you all ever wonder why 1996 to 2000 was great and the economy never went to quite the 2000 levels? It is because of useless wars and getting the job shipped to other countries. That is the republican agenda. If you think you will have a better chance of green card under Republican rule, you are sadly mistaken. The economy will continue to go down, while there will be another Iran war to turn the attention from problems with economy. We need someone who can think clear and be steady. It doesn't matter if the republicans have pro immigration stance or not. The economy is going to dictate if companies are going to keep us employed here. You need to see the bigger picture..

Look where has the capitalism and free market has taken us today, nobody has a clue as to how to fix this mess, all this bail out solutions are just temporary and is pulling us further into debt trap. INA Section 202(a)(5)(A), added by the American Competitiveness in the 21st Century Act (AC21), provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the otherwise unused numbers may be made available without regard to the annual per-country limits. This provision helps to assure that all available Employment preference numbers may be used. In recent years, the application of Section 202(a)(5)(A) has occasionally allowed oversubscribed countries such as China-mainland born and India to utilize large quantities of Employment First and Second preference numbers that would have otherwise gone unused.
For example, let us assume that 11,600 Employment Second preference numbers are available in a calendar quarter. There is heavy Employment Second preference demand by China-mainland born and India applicants; however, each country is oversubscribed and would ordinarily be limited to about 800 of the available numbers due to the prorating provisions of INA Section 202(e). Applicants from other countries that have not yet reached their per-country limit have reported a total demand of 6,500 numbers. After taking the worldwide demand into account, it is determined that as a result of the China-mainland born and India per-country limits only 8,100 of the total available Employment Second preference numbers would be used in that quarter. In this instance, the otherwise unused 3,500 numbers could then be made available to China-mainland born and India regardless of their per-country limits. Should that occur, the same cut-off date would be applied to each country, since numbers must be provided strictly in priority date order regardless of chargeability. Phew! I didn't know that I was out of status for an year. As I dig deep, I came to know how much trouble I am in now. If hope and pray that I wouldn't receive any RFE at the time when IO review my application. I didn't had any problem till now.

Unfortunately, this doesn't seem to be quite true as it contradicts the April bulletin. The bulletin says there are unused visas in the second category going to EB-2 India, and doesn't mention EB-1 at all.
There also seem to be people who are going to sue because they believe DOS ignoring per-country quotas is hurting their chances at EB-3 visas (i.e. they claim that if EB-2 India should get any extra visas then all of EB-3 ROW applications should be approved first). This situation is turning out to be quite interesting. I wonder if we're going to have another fiasco like the July 2007 one.
Just a question out of curiosity....why would someone choose 'taliban' as a login handle, knowing fully well the kind of unneccessary negative attention one can get. I do fully respect the individual's choice to choose her/her own id but just curious...And to jog the curiosity even more , this member seems to be tagged as 'banned' now.. :D...did the admins not like the chosen handle as well !!

This is what I found from other web site when I tried to get more membership to IV. These are the comments I received for the IV. How can we make people aware of our good faith effort. This is another road block we are facing. Many people will not believe that our efforts in full good faith. IV needs to put more emphasis on these issues also.

If the restrictions in H1b comes then I may be impacted also many of my friends and relatives may be impacted. For our personal lives H1b and green card are important if we want to stay in USA. My point is if congress make sure that if I or you will not take any eligible US persons job in USA that is acceptable for me. That will make sure everyone happy
Anyhow we will see what next for CIR and we will do more analysis when it comes.

You mean Microsoft and Google and other companies want to stop outsourcing. They would not have build a huge team in india if they wanted to do this. The point that you are missing is that they need H1-Bs here because no american born is availabe here to fill those positions.

This meant that the thousands of immigrants who followed the government�s instructions and obtained the correct paperwork actually had no chance to receive a green card.

I am yet to see any legal basis in the case which states that DoS has to give notice of x days before changing the visa bulletin. All it says that they have "policy" of visa bulletin good for a month. Such policies, unless backed by legal basis, are not enforceable.

Most times, desi employer looks for himself in these cases. These jobs are not obtained by stringent interview processes. Consulting companies and candidates kinda use each other to legally get into the system.
While someone wants to do h1b for their wife, the only way seems to be conssulting companies or MS - OPT - job.
When people have the luxury of approaching consulting companies to do h1b for wives and nephews etc... they must also be ready for crap. Will someone approach Microsoft for doing h1b for wife??
We all know it is not easy to geta job if you don't have good US experiencee and such candidates are a challenge to get placed, thats why consulting companies request u to pay payroll taxes so that they can legally run payroll and keep u on rolls till u get placed.
It is totally upto a person whether they want to deal with this or not.

Spciy thread?? This is not spicy. This is serious stuff. I am not the OP, but the subject of the thread might be spicy to some folks. This discussion has come so many times. Atleast now we see that we have equal number of people split on both sides.
Assume you make it paid. Then what. We will have maximum 400-500 users and you want to go and lobby or fight with congress with that much number of users. I still do not understand why this thread is still active. Well my post is going to bump it up so I'll not respond to this post any more. Lets focus on other drives as suggested by pappu. We are just waiting too much time discussing fruitile things.

It seems that in FY-2008-Total number of Employment Visas approved were-
Till April 2008=>8048 (Oct'07) + 5813(Nov'07) + 5070(Dec'07) +13174(Jan'08) + 21432(Feb'08) + 25626(Mar'08) + 28792(Apr'08) + 5520(May'08) + 2489(Jun'08) = 115964 (till Jun'08) out of 162704 for 2008.
Also, till April 2008, they had used=> 107955 which is 66% of 162,794.
So, the above comment by the Director of USCIS that till April 08, they had used 65% of the Fiscal 2008 quota is correct.
My guess in July and August is that they have used around 11000.
So liberally there are still 35000 unused visas for Sept. 08 and conservatively around 22000 for Sept. 08.

We have 113475 EB I-485 processed until May 08 (in 8 months), if we take 80% acceptance rate the number of visa used will be 90780 and if we use 90% acceptance rate USCIS may have used 102127 visas.

It seems that in FY-2008-Total number of Employment Visas approved were-
Till April 2008=>8048 (Oct'07) + 5813(Nov'07) + 5070(Dec'07) +13174(Jan'08) + 21432(Feb'08) + 25626(Mar'08) + 28792(Apr'08) + 5520(May'08) + 2489(Jun'08) = 115964 (till Jun'08) out of 162704 for 2008.
Also, till April 2008, they had used=> 107955 which is 66% of 162,794.
So, the above comment by the Director of USCIS that till April 08, they had used 65% of the Fiscal 2008 quota is correct.
My guess in July and August is that they have used around 11000.
So liberally there are still 35000 unused visas for Sept. 08 and conservatively around 22000 for Sept. 08.

Due to the return of unused July numbers by consular posts abroad, and the limited amount of pending demand eligible for final processing at consular posts, it has been possible to reestablish cut-off dates in many of the Employment preference categories.

Reading the posts about the economy has just shown me how ignorant many of the IV members are.
The economy is just going through it's ~10-year cycle. While it is a concern, it is NOT the end of the world. It just strenghtens USA's position in the world. Once again, it has proved that "if USA sneezes, the world catches the cold". The 10-years economic cycle follows a kind of Darwin's Law of the Fittest. The firms that are bubbled up get washed away, the economy cleans up and rebounds back. The 1990s saw it, the year ~2001 saw it with the dot.com burst and ~2009-2010 is seeing it with the mortgage burst.
While it is each one's perogative as to what you want to invest into (good time to buy stocks, or buy gold), another thing to understand is FDIC does NOT insure just 100K per account in each bank. There are multiple ways to increase this insurance to over $2 million in the same bank by opening different type of accounts or having different beneficiaries. Consult your bank for details.
No amount of govt. intervention can change the economy. It has it's own mind and will take it's own course.
There is no need to panic, pack and run.
Let the economy go through it's colon flush.

I agree with you..
I've so many hard working American friends... it really make me want to work harder to compete with them, but these bunch of cry babies at Numbers are scared of skilled workers, they don't want to upgrade their skills, they want to work 9-5 and get paid for their incompetencies.

Everybody stands in one single queue......one line not five lines......one line my friend, irrespective of your nationality. so if you wait 2 years, or 2 hours..I wait the same. Unlike NOW, where some people wait 5-8 years and others 1-2 years.
I think what USCIS can do in order to achieve your "fair play" is they will start to put country limit on H-1B also and then cut off date show up for some countries for H-1 applications(PS: unused quota can't go to oversubscribed countries at 4th quarter). In this case, years later, there's no need for specific country bulletins for EB.
The current case is over 50% of H-1B issued to Indian and Chinese every year. And that is why now most people here are waiting.

EB-2 India went to unavailable because USCIS stamped 2003/2004 petitions left and right to consume VISA numbers. Then they realized there were bunch of 2001/2002 petitions gathering dust. After no VISA numbers left, they had no option but to move the priority date backwards to make very few petitions current.
I am betting that they will move the dates forward to 2003 in August or September and process few more EB-2 India petitions. For any forward movement to happen to India EB-2/EB-3, ROW EB-2/EB-3 must become current again. If not, we have to wait till October 2008 for new quota to become effective.

Most times, desi employer looks for himself in these cases. These jobs are not obtained by stringent interview processes. Consulting companies and candidates kinda use each other to legally get into the system.
While someone wants to do h1b for their wife, the only way seems to be conssulting companies or MS - OPT - job.
When people have the luxury of approaching consulting companies to do h1b for wives and nephews etc... they must also be ready for crap. Will someone approach Microsoft for doing h1b for wife??
We all know it is not easy to geta job if you don't have good US experiencee and such candidates are a challenge to get placed, thats why consulting companies request u to pay payroll taxes so that they can legally run payroll and keep u on rolls till u get placed.
It is totally upto a person whether they want to deal with this or not.

I filed for I-485 for my son on 2nd July but did not receive the receipt so far. My son is turning 21 next month, my lawyer is guiding me to file for F-1 for my son to be on the safe side. Is filing for F-1 going to effect the I-485. What will happen if approved F-1 comes before receipt?
