We ( myself and my wife ) applied at Texas Service Center , Dallas Lockbox.
- Appiled on Jul 7th
- mine approved on Sep 10th
- wife's approval on Sep 16th
After like
50days - spoke to National service center ( No help )
56 days - wrote an email to the POBox printed on the receipt notice ,explaining about my situation that i have already purchased tickets and need to travel on Oct 8th . Consider this factor under financial loss and expedite, added 4 photos , 2 each., invoice from travel agent, and attached receipt notice copy. ( not sure if that helped ).
later that day - I booked infopass appointment
next day - I saw SLUD on my case.
Sep 10th - I got text ( from the USCIS online profile ) noting approval,
next day - called NSC and asked why my wife's case is not approved yet, they said they will process individually , and it takes upto 30days to receive the AP copy.
but after 3days i got the physical approval. For my disappointment they didnot processed my wife's case along with mine.( we sent together ).
Then we called NSC explaining, but this time i could tell mine was approved and her is still pending and explained to expedite based on financial loss. she accepted it and sent a notice to local office, but also alerted us its discretionary.
On Sep 16 we got approval text message for my wife too.
after 3 days we got the physical copy for my wife, also got the letter in a different envelop about the "Acceptance of expedite process " ( well it was no use, but thats how their systems are inlined )
Out of curiosity we were tracking other AP receipt notices ( by altering last few numbers of ours and they showed same receipt dated ) online in case status window. it showed one applicants approval was done and the adjoining applicant was kept pending for few days. after we got my wife's text message, we searched again those other APs and surprisingly all those got approved as well.
My recommendation to others in hurry ,if they crossed 50days , try taking info pass , talk to NSC . just donot leave it at its pace.

Figures suggest that there are over 800,000 pending applications. Recapture will get around approximately 215,000 green cards. We are shot of around 600,000 green cards, which will take around 4 years (@140k/yr EB green card) to address the current backlog, which contains your and mine application. This is a deep deep hole and EB3-I is at the bottom of this hole.
.
Sanju:
Actual number of I-485 pending is 673,694, please refer the following link.
http://www.uscis.gov/files/article/Natz_Benefits_Oct2008.pdf
I don't know this number is only Employment based or it has included family based too.
Can someone please confirm this?
I beleive that the recapture is going to help us a lot.

Guys,
I know there are a lot of ppl on this forum who have been in the US 6+ years and because of BEC/retrogression are thinking of moving to Canada. I am not suggesting that we should leave but I think its good to have a plan B.
Feel free to discuss matters like below (related to moving to Canada/Aus/India)
1. Canadian immigration process.
2. Finding jobs in canada.
3. Continuing current education (MS/MBA) in canada.
4. Operating current business from canada.
5. Move related issues: Taking household goods/cars etc.
6. Getting settled in canada.
7. Letting the GC process continue here.
8. Financial Matters: What happens to bank a/c's, 401K etc.
Anything else you can think of :-)

Buddy,
everyone loves their money....but think if nothing will change how much of your loved money you will spend every year to renew EAD and AP...just do the calculations and you will think that it is worth to part some of our loved money..

Do you know many of the deals/contracts are done in a golf course ? That's why your account manager has marketed you with higher rates. Rate is not always based on skill sets.
You should start playing golf and you can market yourself too..

thanks for your replies desi3933........is there any way one one can apply for H4 extension/stamping at the consulate based on the receipt of the H1b extension filing ?
One needs H1 extension approval letter in order to get H4 visa at the consulate for the period mentioned in H1 extension. It does not matter if the person was on H4 status or not on the last day in US. One can be in AOS pending status and get H4 visa stamp.
Please check and verify details with your attorney/lawyer. This is NOT a legal advice.

I received my EAD last month. But no AP yet. However, i received an email from my lawyer today that.....my AP got rejected. The rejection letter is saying that I485 got approved that's why the I131 is rejected.....therefore, my lawyer is waiting for the I485 approval.....but my lawyer told me that I can expect my card soon.
I don't know how to react. The online doesn't have any update about the I485 status yet. They received my application on July 2, 2007.
Congratulations to Shimul99. Good for him.
Did he have a aging out kid who filed for 485 along with him. I have heard thoses cases get prioritized.
In any case, I am happy for him.

You can't generalize. If your kids are smart they can get into better colleges like IITs etc. I think you are confusing the issue about adaptability with good future prospects.
Wait a second. If you are not adaptable to the new environment, it becomes a rat race.If the situation is not conducive, your smartness aint gonna help. I think thats what the OP clearly meant. Its not easy for a kid who is in 8th grade in US to snugly fit into Indian System. Coming to the IIT's, Have you ever compared the total number of seats available in IIT's to the accepted numbers from IVY leagues and other big schools. In India, you have to be the best among the best to get into IIT's. You have to be best here and oh yeah.. You dont have to lose some of the smartness to reservations. But I agree with you that parents should let children pursue their own interests rather than thinking about him/her being a doc/eng.
DISCLAIMER: SPECIFIC TO THE INDIAN EDUCATION SYSTEM
I am sorry but I disagree with the "best among the best" comment. To equate success in the IIT entrance exam to being the best is a mistake. Success in the entrance exams to those Insititutions comes from focus and hard work. This does not necessarily mean that the people who go there are the best. They ARE definitely the best at preparing for the exam.

Hillary just cares about vote bank. The Bay area group that invited her should not endorse her.
Shame on Dems.
The short answer is most republicans voted yes for the senator Cornyn's bill to recapture the unused employment -based visas from previous years and almost all Democrats voted No (except Murray democrat from Washington voted yes for the bill. I guess Microsoft does have influencial power on the senator from Washington state)
see the info here about bill: http://www.immigration-law.com/Canada.html
Yesterday, Senator Cornyn introduced on the Senate floor Amendment 2339 to H.R. 2669, FY 2008 Budget, proposing the following temporaary relieffor the employment-based immigrants. Sadly, the bill was rejected by 55 Nays, 40 Yeas, and one No Vote. Do your want to know who voted against this bill? Click here.

Yes very nicely put.
Yes all of you that are posting on this thread. please leave USA and go back home. Lets see how many people actually do it.
Its a good thing, and I fully support it. Afterall it will make my line shorter and wait lesser.
Little harsh but true.

Man, everyone gave me REDs for opening this thread and I am surprised it is keep coming to the top. I can see this going to several pages :confused:
Reasons for RED is that the OP wanted to open this thread, but you did it before him/her. The thread is on top because everyone loves it.

Now that Democrats have taken the house and will soon bid adieu to rabidly anti-immigration Republicans in key posts like Sesenbrenner and Hastert, it does bring in a new ray of hope for us.
What this means for us in two houses:
Senate:
- To get anything done in the Senate, a bill needs support of more than 60 votes.
- Even if Democrats control Senate, which we will find out after a Virginia recount, they will really have to work in a bi-partisan manner. If we look at past trend the Senate was open to immigration reform.
Lower House:
- Due to "majority of the majority" rule by soon to be former house speaker Hastert, NO non-conservative agenda saw the light of the day in last congress.
-This effectively turned into a do-nothing congress.
- New Democrat speaker Nancy Pelosi brings hope for millions.
- This is a good chance for Bush to show what he can rally around all Americans not just the conservatives.
This election has shown that the American democratic system does work and that there is still hope for immigration reforms.
Maybe, this is too early to celebrate but I will go out and have an ice-cream :o some good news after a long draught
