The way i see it, they've asked for past emp letter with tax forms and some w2s.
None of those would indicate that you were on the bench.
The emp letter should basically just indicate your dates for employment - start/end date, designation, duties and perhaps salary. that's all.

what kind of attitude is this. If he/she is eligible to apply they should apply.
Guys who r going 2 get married and have their PD after Dec 2006 and have atleast 2 years of H1-B period left!!Y apply 485 now and wait for atleast 3 to 4 years to apply your spouses. The way I see it you can only apply your spouse's 485 when the PD becomes current again!!Instead y not wait 3 to 4 years and apply simultaneously!!Atleast give the guys who have older PD's a break!!

I concur with the opinion of getting into IIT's is not a bench mark for success. It depends on what a person considers success. As far as "Best among best" is concerned, I used it only to compare the number of seats available for equally intelligent students in India and US. A student in India with similar aptitude, IQ and what ever comparable metrics has lesser chances of accomplishing what a student accomplishes in the US. let it be getting into IIT's or Ivy leagues.

One does NOT need EAD to use AC21. I don't understand the panic.
In fact, one can be working at Employer B and can claim AC-21 for Employer C as a future job.

I was not planning to change company and just filed my 485 without EAD last week. But now situation has changed and the lawyer said i need EAD if i want to use AC21 after 6 months. I'm hoping to get a receipt notice soon so that i can file for EAD without the increased fees. Anybody has any link to where it says we don't need EAD for AC21 so i can check with my lawyer?

now individuals will discuss it based on their own experience, and fortunately or unfortunately the majority here belong to one country, it really should not offend you, although once again i repeat, i do not think it is ideal.
being so sensitive is easy here, bet you have much thicker skin at work in in your neighborhood. please show tolerance in your comments, that's all i asked. you can point out the same think politely, or gently refer to the irrelevance of the discussion which is clear anyway to most people. not a lot of contributors to the thread you may note....
oh and by the way- when threads like this are shut down, people scream free speech. everyone will dislike something when there are 10,000 people. please chill out. live and let live.
as for the plenty of people that won't come here- sounds to me like they forgot what the real problem is. just my humble opinion, but anyone that won't help with fighting this crisis because of petty trite reasons like "some threads are so country centric" would have been of no stinking use here anyway but to whine and complain. as it is barely 200-300 people bother with anything concrete.

How to find out the group that lobbied for this bill ?
Based on EB recapture provisions in this bill, I strongly believe they have EB2/3 (I/C) folks like us behind this lobbying.
IV can join hands with them and leverage assets jointly. Including call for funding to a larger audience.

I agree that it's really a personal choice. It's quite risky in this economy with housing prices going down. It needs a lot of reasearch and lot of thinking before you can make that decision. I don't think surveying people will help because there's lots of personal factors that can play a role in making that decision. Maybe it may help to listen to different people's decision making process. Having GC is a factor but it's not the only limiting factor. I know a lot of people who bought homes much before they filed the i-485 and i know few others who didn't and you can't blame them for their decisions.
For the record, i bought my home in 2008 and i must admit that owning a home is one of the nicer things i did in this country. We and the kids love the extra space and the luxury. My kids will be going to public school next year so will be making full use of the taxes we pay.
If you have a stable job, IMO you can buy a home and i bet you won't regret that decision. But stable job is as hard as finding a treasure these days.

my NY dl is valid until 2009, but in red letters it says "Temporary resident until" showing my H-1 date of expiry, which of course expires every year.
I called DMV, and she said although you should change it to reflect your new H-1 expiration date, it will still work if you have your H-1 renewal papers (so in your case your EAD dcouments) with you. should probably be sufficient to keep a copy in your car. and this is only if you get stopped by a police car, or are travelling by air.
if you know differently let us know

India Was in 1998 for some time. Not sure if this is right "IN - 1/1/2002 7/1/2001" .
Well in Jan 2005 VB IN was 1/1/2002.

Till 2007 that was how it was being interpretted and then suddenly DOS realised it should be by category and not by country of chargebility.
The earlier Eb1 ROW>Eb2 ROW>Eb3 ROW spillover is called vertical spillover
The current since 2008 spillover Eb1>Eb2>Eb3 regardless of country is called horizontal spillover.
However see in Horizontal spill over Eb2 India backlog takes of the numbers (14k in 2008)
In vertical spill over Eb3 India backlog takes the numbers(17k in 2007)
So either method wont help Eb3 ROW. Its a double whammy.

Honestly, I am tired too. I have canadian PR but I am not even sure if I want to go there now and start afresh there. Maybe I should think about semi/retirement in India too.
Gar Gar ki yahi kahani, ( it's typical story for any immigrant family),
main issue for us now we had invested so much time on this f** GC, we can't bail out now, feel like we are so close,
for myself I don't have that much energy left in me to go back to start allover in India, worest case scenario I just want to stay couple of more years and save as much as possible and go back to India for semi/retirement

In a letter to Senate Majority Leader Harry Reid and Minority Leader Mitch McConnell, ITAA President and CEO, Phillip J Bond, said America's economy is strong and vibrant, but the country's future competitiveness rests on the ability of firms to recruit globally.
"As you know, the H-1B cap for FY '08 was reached in April, shutting out US employers from recruiting highly skilled foreign nationals who are graduating from US institutions with degrees in computer science, engineering, mathematics and other scientific and technical fields.
"Vacancies go unfilled and highly valued workers are forced to leave the country. Even worse, significant shortages exist in the permanent resident visa (green card) programme," Bond said.
Jeff Lande, a senior vice-president at the ITAA said the industry wants more people to be able to come into the country to fill shortages.
"We also want more green cards because for many companies they want someone to come in here who can innovate for their companies work for their companies and who can transition to permanent status," Lande told the National Public Radio.
