I am very happy for India.
1.Now most of the work that is being done here by H-1B professionals will be done in India.
2.Innovations will be made in India. As more money is available for the companies to pump in to R&D
3.Indian IT infrastructure will improve.
I am not so happy for USA.
1. They are doing a big mistake on immigration. They do not have enough resources with right skill set.
I am not so happy for myself.
1. I am disappointed by the fact that USA is going in the wrong direction.

My wife's EAD was applied on July 30th. She didnot recieve her EAD for 90 days, hence we took a infopass appointment and went to the local office on 92 nd day. They have informed us that they had sent a RFE on 88th day of filing and we need to wait for another 90 days after we send a response to the RFE.
Strangely the RFE that she got is for Birth Certificate which is not a required document for EAD.
I did not read anywhere that 90day count starts from the day when a response to the RFE is sent.

When does the "Approval notice sent" status appear, it is about 7 days since I got the production ordered.

My EAD is pending for 8 months due to security clearance. I requested interim EAD but no luck. Have made several info pass appointments, the IO called Texas Service Center and spoke to the officer who has my application. the Texas service center replied to local IO that they will soon get to it. As of January 11, 2008 my application is sitting on the desk of the IO in Texas waiting to be adjudicated. However, with pending security clearance I am not sure when that would happen....Biometrics were done in July 2007.
Any advise is greatly appreciated

And most important thing is it's timing -- Can we believe that these orders to make visa bulletin come from none less than some big political clout to suppress / divide the cry of legal immigrants?
This confirms unless we get major reform for addressing backlog, all this idea of making 485 current is eyewash and nothing but trap for exorting money out of legal immigrants every year to pay for USCIS funding.

Can anyone with some indepth knowledge predict availability for EB3 Rest of world (Canada). Here is some of what I understand - although I know it may be wrong (some infor from Shusterman site)....
- 300,000 applicants in BEC
- assume 200,000 get through
- assume 1/2 have a spouce and 1 child
- therefore need 400,000 visa numbers (Shusterman had 300K here, I think they are wrong??? - pls check my math)
- now most EB immigrants are from China & India (half?????) - restricted to 7% of the annual 140,000 EB visas annually
- all* applicants up to first half of 2002 are "gone" - *except for ones in BEC = how many????????????
- AND if rest of world is 200,000 people in line for 120,000 visas annually (140,000 - 7% China - 7% India)
- now people in line go from 2001 - mid 2005 in BEC??????; but very few 2001 & 2002s left????
- thus: rest of world with PD of March 2004 - should get visa availability within this fiscal year - e.g. by Oct 2007????

Thanks Almond... your post summarizes exactly how ppl in my position feel. one of my frds did MBA from top 20 B-school but could not change to a new job in management career becoz his I-140 approved but did not file for I-485 yet and worse yet he crossed 6 year H1b. now he is also living on 3 year h-1b extensions with approved I-140. when he was venting his frustration like me, one a$$hole (GC holder) suggested he move back to his home country. funny thing was this a$$hole got her GC becoz she married some bakra who already applied for GC. within 6 months after she arrived in US, her huby got them GCs. This dumb wothless piece of $hit doesnt know how hard (impossible ?) to get GC in this lifetime becoz she got it in 6 months :mad: .
The price of GC is what you assign to it. The value of GC is not what other people tell you it is. If you get depressed, make your life hell - it's because you chose it. My PD is 2010 in EB2 and I came here in 2004. I know what I'm getting into and it's my decision so I won't fret about it or get depressed. GC is just a document, it should not define you or your life.
Enjoy time with your Family, wife, kids - it's priceless.....a new sports car will also help. Life is a great gift and will have ups and downs....don't let GC define who you are. I rejected filing in EB3 3 years back with a big 4 consulting firm and changed jobs. I also feel this "promotion" thing but I chose to be in that position. My friends in India are all PM's and Sr PM's.....they got what they chose.

Should we write letters individually stating how this law has been unfair to us personally? I do not think DOJ will respond to each of us individually. This has to be a mass campaign under one umbrella to be effective. I understand that the leaders in IV are pursuing this with congress currently so probably cannot participate in this campaign? What other ways do we have? Could this be an online campaign?
On a separate note, it has been frustrating to see politics in US congress over last two years. I am sure they know about the legal immigrant issues and about retrogression, but clearly say no piecemeal legislation would be passed. They work purely for vote bank which we are not. I would favor working on alteranative means to try to get relief.

IV supports AILF efforts to file the lawsuit and feels that if the lawsuit has a favourable judgement then, it will provide respite to lot of people in the Community IV represents. IV is not an organization which works with one motive and that is to get people out of the greencard mess and IV will support whoever helps its member community.
We feel that revision of Visa bulletin was not correct and AILF is absolutely correct to file a lawsuit against this directive and hence we support AILF in their bid to sue USCIS & DOS

Your good fight on the retrogression issue kind of kept us going without giving up. In just a few days what some of you have done with www.immigrationvoice.org is amazing and it truly deserves a lot better than the faint response they have got so far from all of us in this legal black hole. Honestly, I do not care if we are not able to raise 100K dollars for the lobbying efforts for the next immigration bill on February. I don not care if this money is finally lost. It will be money well spent if we all realize that we have to do something instead of waiting years and years and years� Any money is worth the effort regarding our goals, even if our present intention does not succeed. Is worth it!!. Lets move on, hoping for the best� It is worth to try this next immigration bill. Any money spent on this is worth it� Can not you guys see it? More and more years on this black hole!! More years paying our lawyers for H1B renewal, more years for renewal of our driving licenses, more years for our wives to wait, more years for our employers exploiting us� This next immigration bill could be our last chance in many years to get our unfair and sad situation known and probably solved. The information was very helpful for me and others as well.
I think my education evaluation and MCA degree doesn't specifically state that my Master's degree was a three year degree course.
I now have a letter from University stating that it was a three year degree course and we are going for a fresh education evaluation.
I think the lessons learned here is to make sure that the degree and/or EE should clearly state the duration of course.
Any other suggestion or past success is highly appreciated.
Also, my RFE respond date is April 22, 2011 and not March 22nd as mentioned in my orginal post.

What can Obama do when most of the Republicans are dead against the immigration reform. They didn't allow their own party president to pass the CIR. Do you think they will allow Obama to do it?
He won't be able to pass any new laws anymore, they can't even agree on a budget. Forget any other controversial topic. BUT , when he ran for the office, he had promised to fix "the broken immigration system" within the first year of his office. He hasn't kept many of his major promises and is highly doubtful to get re-elected if the Republicans have a strong candidate(disclaimer: Trump isn't a strong candidate)
We're bound to be in this rut for a very long time if we want to stay here!

As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.
