    Dear Members,

    We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.

    Our angst, our insecurity:

    Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.

    Early effort wins:

    The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.

    How you can help:

    You and help in two different ways:

    Join the advocacy effort in DC on June 7th and 8th. (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1437978-iv-announcement-advocacy-days-in-washington-dc-7th-and-8th-june.html) If you have never done this before, we encourage you to help us with this and join us. Immigration voice will arrange the logistics of setting up meetings and arranging the material for you to take to your Congressmen and Senators. We are expecting about 150 immigration voice members to gather in DC and participate in over 200 meetings with Congressmen and Senators.

    Contributing Funds to help finance the effort (http://immigrationvoice.org/forum/forum85-action-items-for-everyone/1534974-funding-drive-iv-needs-your-support-for-advocacy-events-in-dc.html). You are most welcome to come to DC and join us but if your job demands are such that you cannot take two days off on June 7th and 8th, then you can still contribute to this effort by contributing financially to Immigration Voice. Many expenses tied to the travel of grassroots members from distant states is being expensed by Immigration Voice. So kindly contribute funds to this effort by clicking on this link. You have an obligation to yourself and your family to plant your career in this country once and for all. EAD and AP, if you have them, are not going to cut it. We are not there yet.     I also think TSC online update is out of sync, I received my AP without any update

    My wife's H4 expires on Oct 1, 2007......We plan to file our I-485 by July 16, 2007.......I am sure it will take atleast 90 days to get her EAD.....whats her status between Oct1,2007 till the time EAD gets approved?......Will she be in valid status during that period?

    just sit and wait and assume that nothing will happen..? ever wonder what would have happened during the July 2nd Fiasco if we did not stand up and campaign for our cause, you think they would have done any thing? Following your principle of do nothing would have lead us no where during the July Second fiasco. THINK!

    The issue is that there a lot of anti- legal and illegal immigration activists and congress members who will make sure nothing goes thru the senate or the house.

    ^^ Please keep poll bumping for next few days ^^

    A recent post asking about how many people have EB2-India PDs of 2003 or earlier had no responses, so I am curious about the potential spread of waiting people (atleast in the sample set of whoever responds to this poll).

    RESPOND ONLY IF YOU ARE EB2 INDIA, HAVE FILED 485, AND ARE WAITING FOR APPROVAL.

    (we can do separate polls for EB3-I, china, ROW etc)

    Those who are using EAD have to use AP, as H1 is no longer valid!! This whole correct/incorrect thing is useless as these rules were made when AOS processing time was less than a year. People with older PD who dont expect to get GC in coming 2-3 years and already working using EAD have to use AP. This was even the case when H1 used to be valid for six year only and once someone got EAD/AP they were using it happily during 2004-2005.

    I and many folks in this forum have seen very few approvals for this category. How come USCIS says that this category is over subscribing the visa quota. Why they are moving un used visas to EB2 (no offense) why not for EB3?

    We need IV help in this area.

    H1b and Green cards are allowed to have out of country stays. so if you are out of country for less than six months, it may still be considered as continuous stay. the intent of writing the word "continuous" is to declare that at any point, the immigrant had no intentions to leave the country and relinquish his immigrant status. for the legal immigrant, that should be acceptable.

    Looks like it is for illegal immigrants as it asks for continous stay. Most legals would not have stayed continously as they might went out of country for vacation

    How bad it can be for those with approved I-140?
    Earlier it was 140K times 7% = 9800 with everybody and now it is 90K times 10% = 9000 with most of them gone into new merit based system.
    I still don't get it?
    what do you mean? Who are these rest who will go into a new merit-based system? Even if you count only the number of people here who have approved I-140, that alone is enough to delay us for a very long time even with the current quota (140K). Otherwise we would not have had retrogression.

    I filed mine in July and still dont have the AP renewal yet. Its coming close to 90 days. does anyone know what I can do after the 90 day period to get my AP? is there such a thing as an interim AP or an expedited process after 90 days from the notice date?

    That's ridiculous :rolleyes: So did you pursue with MTR or filing in EB3?

    As i said lawyer told me that no use of MTR. We went with EB3 and now i am on EB3 train with I-140 approved. I was wondering that can i re-appeal now after 2 years .

    1) AC21 is used for H1B Transfer AND
    2) AC21 is use for EAD (485 phase) Job change

    This bill is addressing number 1 above NOT number 2. The above scenarios reflect the current system not the future merit based or whatever else. I am assuming a case where an applicant continues under the old system.

    If anyone disagrees please substantiate.

    We have added more words to the meta keywords of the site. However we do have to realize that what really matters in Search Engine rankings is the linking from other sites. Hence as we're getting more and more exposure, more sites link to us and it is boosting our ranking.

    Two days back I searched "Immigration Voice" and "immigrationvoice.org", it gave no results. As I posted in this thread (http://immigrationvoice.org/forum/showthread.php?p=9527#post9527) here on IV, I suggested that we should modify the meta tags of IV site and expose them to search engines.

    While I am awaiting those changes, I did the same search again at Google. The first 2 results are for immigrationvoice.org

    So for a position classifed as a jobzone 4 and an svp between 7 <8, which of the following job requirements would be a better option for EB-2 filing:

    - MS+0 / No BS requirement
    - MS+0 / BS+5

    And by better I mean less chance of an audit or proof of business necessity requirements.

    I am afraid I am missing something. According to the worst case interpretation you can't require more than 2 years even for BS for zone IV.

    Can somebody remind me how BSs can still qualify for EB2? I heard this BS+5, but don't see how it can fit into zone IV and qualify for EB2

    It looks to me the only way for zone IV would be MS + 0.

    I am still puzzled why DOL accused me of having only 5 yrs of SVP on my first PERM. There I required MS+5 (stupid me - hoped to supply "business neccessity" later), which means 9. But they didn't say "you put 9" they said "you put 5" on the denial notice!

    Per 9089 instruction for Section H, item 5: "Do not duplicate the time requirements." So one would think experience is counted separately.

    Do they not follow their own rules?

    Thanks Belmont for support, as explained in other thread for some guy who is beating me or people like us, it's a mistake/accident. It can happen with ones mistake or without mistake (Car accident).. Some one get caught and some one don't... as example I knew many people who steal/use office supplies in the company they work...

    When we conducted D.C. rally, there were roughly 1500 people attended. Each member has his/her own reason for not attending the rally.

    The reasons could be, taking a day off from work or to far from their place etc..,

    As a first step��..:)

    Why don�t we plan for rally on the same day, same time at various major cities? This would enable members to attend in their respective cities.

    We knew that, we are 25K+ members strong and can hold rallies/protests, where we have (major cities) at least 100+ members.

    We must invite media and local US leader�s for rally and show our strength and request them to work towards the Green Cards.

    Why don�t we plan for a rally during the this Christmas season?
