They obtained authorization to file the lawsuit. They had it prepared to file and received good response from possible plaintiffs. It was possibility of good strong case by AILA that deterred USCIS to reverse the decision without a formal lawsuit. This is exactly what we need to further our cause. USCIS could care less about other petty tricks. They will only understand language of laws/court. For that we need congress to pass laws favoring us.
Our decision to send flowers was initiated around 2-3 July and the first of flowers were booked to be sent the same day.

That one phrase in your LC requirement could turn out to be a life saver for you. Can you further clarify the educational/experience requirements mentioned in LC. Was it Masters or equivalent with zero experience OR Bachelors with 5 yrs of progressive experience? Your educational evaluation should meet atleast one of the requirements mentioned in the LC. Either Masters or Bachelors + 5 yrs exp. I think for your educational background (non 4 yr BS degree), I feel more comfortable with getting the evaluation done to satisfy the BS + 5 yrs requirement rather than going for Masters equivalent. NSC is known to be strict w.r.t 3 yr BS degree when it comes to EB-2 cases. However, since your initial evaluation showed you as holding a masters equivalent, I am not sure if its a good idea now to try to defend your case with BS + 5 yrs equivalence. A good attorney would be able to guide you through with this. I also suggest you to consult any reputed attorney regarding this and get feedback on your company attorney's plans and not just blindly follow what your company attorney says.

1) My employer does not want to share the original I-140 either, so i too want to apply via FOIA, do you know what is the cost of applying ?
2) If we apply, will the employer get to know ? does uscis send some notification to the employer that the employee requested a copy of I-140 approval notice?

I would love to get involved with bunch of like minded people.....I have all the experience needed for starting and running a company. I have successully done thrice.....We have so many experienced folks who would love to start and run a company but lack the experience/knowledge of running one. it would be a good start to bring all such people to get together and pool our knowledge, skills, money and succeed.

My I140 is pending at TSC from Apr 2007. No RFE. Called the CS and opened an SR in jan 08 and i got the standard reply. My Attorney opened another SR in May. Hoping to get some information on my case from TSC this time
I think all these processing times are unreal and who knows how they process these cases (may be GOD)

I highly doubt they pull up state criminal record at POE.
If its a federal crime, then i can believe that.
You want to bet with me on this.. I am not wrong here. Why would I scare someone..Even if this is Misdemeanor or felony charges irrespective of wheather this is state or federal it is one's record and every officer at POE has an access to this record.

at least they are approving 2003/2002 PD applications as we have seen.....now that surelymeans they are working a little bit....
Whether they are short on staff, or whatever teh reason maybe, the bottom line is our complains to any higher ups/Senators..etc will just fall on dead ears as we are not the Voter Base.....

500000 legal immigrants, even if u assume 4 per family , ONLY 125000 houses can be sold...(even if 50% qualify for a loan.. thats just 62500 houses sold.. last i read..there were millions of homes for sale)
if the average cost of the house is 250000, thats additional 31.25 Billion $ in credit borrowing... where is the money?

It appears form the wording in the text that, anyone who has maintained a continuous stay for at least 5 years preceding and up to the date of enactment of this bill, gets to apply for AOS and be granted permanent residence.
so with respect to EB folks, this provides GC aspirants (with 5 year stay) an immediate relief. The total quota numbers are not modified. Everything stays as is. This appears to be a one time relief to free up the choke in the system (at least for EB).

Folks, democrats are really serious about this bill. This hearing is not at the Immigration subcommittee level instead it is at the FULL JUDICIARY COMMITTEE level. That says, they are really serious about this bill.
Also, in my previous response (quoted below), there is an audio link in which Senator Menendez clearly says something: This bill S 1085 is a pre-cursor to the comprehensive immigration reform. That means, this is like building a border, which is the pre-cursor that anti-immigrants are asking for. Anti-immigrants often argued that, before dealing with the Undocumented immigrants issue, we need to make sure the problems with the Legal immigration should be fixed and the laws should be enforced including border protection. Democrats are using that point to fix the existing problems of the legal immigration system as a pre-cursor to the CIR which will deal with the fate of the Undocumented immigrants.
So, folks even if there is no chance for the passage of CIR this year, passage of a PRE-CURSOR bill is very much possible. Now the Full Senate Committee hearing shows something - Democrats are showing the will to deal with this issue (at least at the Legal Immigration front).
Iron is getting hotter....May be it's just a matter of time to find out when we can strike.
There is so much momentum - I think, IV should join this bandwagon.
If groups supporting employment based immigration like IV are not there to explicitly support this bill, during the mark-up of this bill, our recapture clause could get eliminated under pressure.

Just sent emails and mailed hand-written and signed letters to Senators Boxer and Feinstien in Calif. both to their DC and SF offices.
Will send a few more to local representatives. Hope we can enable Congress to make this change in legislation before Election '08. If we can, it will be quite an achievement!

The only thing that can help us predict Sep bulletin is how many visa # have been used so far from 2009 quota. Since USCIS will be rushing to use up all visa # the quantity can least give us an idea if dates will move few months or few years. USCIS should not have trouble with either since they have so many pre-adjudicated applications to take care of both scenario's. I am pretty optimistic (realistically confident) that there will be a forward movement.
Knowing about future, or predicting what is to come, would help if we ought to do something in preparation; an advance action, such as nailing our windows shut if we are predicting a storm. That is not the case here. Therefore, sure shot 'prediction' is just to wait and see. It is only a few days away. If new cutoff date encompasses your PD, pray and check your email every day (or every hour or even minute), and hope for the best.

I personally think that 6 month rule-of-thumb is nonsense.
AC21 clearly states you can switch employers 6 months after your green card application has been pending. On what legal basis could USCIS then come back and deny citizenship to anyone for switching employers too soon after getting their green card?
I'd really be interested to hear if someone has specific knowledge of a case where someone had their citizenship denied due to switching companies too soon after getting their green card.

The way USCIS functions, I would rather see the movement of the dates back rather than forward...why?
This is the time when USCIS actually TRIES to follow FIFO: meaning tries to work on old cases. Last quarter is usually a mess and approval pattern goes to TB to BB (top of the box to bottom of the box).
So, It is a actually a good thing, if PD stays there or moves back; that will make USCIS work on approving older cases at this time.
It is also a good sign that DOS mentioned that "they are waiting from USCIS for pending numbers": that means, they actually asked for those!!!!!! AND USCIS is working on it (or atleast told them so). This has been the crux of all the visa number movements including random approvals. If this is sorted out somehow, it will be a great deal of improvement in implementing FIFO system to some extent. If USCIS gives that info to DOS, there will be someone (DOS) to ask USCIS: WHY DO YOU NEED TO MOVE PD FORWARD TO 2008 WHILE YOU HAVE SO MANY THOUSANDS OF CASES FROM 2000-2005 PENDING??

While waiting for GC ( which may take several more yrs !!!) I want to go for Life Insurance, Since I am at age of about 40 its need to be done, though I have enough of that in India, not in US. In that regards I just started evaluating different options. Plesase share your comments and experiences during search of Life Insurance.
(1) which is better to go for term life or whole life
(2) I started contacting agents (mainly desi) and they recommend Whole life ( if you can afford premium). They tell that it is ultimately result in Saving, Dividend etc. So my question is Does paying EXTRA PREMIUM ( i think it will be substantially high for whole life) RESULT in EQUIVALENT OF SAVINGS OR DIVIDENS? or just agents recommends that because they get more commissions with that?
(3) I see lot of DESI agents in New york Life, So is it due to their speciallity in Indian Community market? Does they offer competative products?
(4) How to search of best rate for Whole or Term Life, Does Select qoute and Other such agencies are good to their promise of getting low cost? Does companys that we get through Select qoute give Insurance to NON-PERMANENT RESIDENTS like US
(5) Which reliable comanies offer Life insurance to non-greencard holders (menas H-1B holders)
