Hi,
Here is my situation. I can apply for I-485 since my labor(PD - Mar 05) has cleared and I-140 has been filed.
But, I have a fiancee and we are getting married in September 2007. She is on H1-B but currently traveling in India.
We cannot get married before September 2007, so, as far as I understand, I cannot add her into my AOS filing right now. And, as far as I understand they are gonna retrogress the dates to oblivion after August 17, 2007.
1. So, my question is, would she have to wait until my priority date become current again before she can add herself into my AOS application?
2. Let's say the answer for question 1 is YES. What happens if due to whatever reason, my I-140 gets approved BEFORE my priority date becomes current, so, in that scenario I wouldn't have been able to apply for her AOS anyway? Then, what are our options?
3. Let's say the answer for question 1 is NO. Then, is there a special processing I need to do to add her since my priority dates will not be current anytime soon because of the retrogression?
Please remember, she DOES carry H1-B on her own.

Ask her to come back to USA, get married in USA. You have plenty of time to make this happen. Personal reasons aside, you are in a way better situation that most others (including myself). Good luck!

If you can provide a good medical reason like hospitalisation here in US, RBI will approve upto $100,000 to be sent to USA by your parents.Just get a letter from a desi doctor and ask your parents to approach RBI.good luck.

My Wife's I-140 RD is May 9th 2007 and it was filed at Nebraska center.
Online Case status says that this case was transferred from Nebraska Center to Texas center in end of april 2008. So now this case will be processed using the original Reciept date or it will have a reciept date when this case was transferred? Current processing date is way past then her original RD.
We have to file for her H-1 B Extension and it is critical to get I-140 so that we can extend it for 3 years instead of one year.
Please let me know if someone has any info...
Technically it should be your original receipt date , thats means your wife 140 should be processed now but guess what that happens only if TSC finds your wifes file , not sure where the tranfer cases are stored , If they use computer they will definetly find the case but looks like they find the cases by boxes ... that such approvals would be due to visa number allocated to a persons case when the visa dates were current. or allocated to prevent visas from being unused in the FY 2007. It may be an unlikely that such approvals (without PD being current) will continue in the 1st 3 quarters of FY 2008. Also it would be very safe to issue EB GC visas to ROW applicants as most likely they wont hit per country limit.

Visa recapture cannot happen with an administrative fix. Anyone who is telling you that visa recapture can happen by some admin fix or through a lawsuit is simply lying, possibly just to grab your attention. We have been repeatedly told by the administration that recapture cannot happen by an executive order.
A few days back a group of disorganized folks were writing to USCIS Director asking him to recapture. That is just a waste of time because CIS director cannot do recapture. Even Presidential executive order cannot recapture unused visas. It has to be done legislative because recapture will require change in the law.
We do not mean to dampen your enthusiasm but please do not expect for something that cannot happen. Recapture cannot happen with an administrative fix. In this admin fix initiative we are working on other possible good provisions that are possible.

No. Bernankes support wouldn't hurt. But statements like these, by you, may give the impression that IVs approach is ineffective which is not the case.
In America, people gets recognized when they offers a solution for a problem faced by the country. Whiners are (who write to Bush or Senators) do not get noticed nor are respected.

EB3 discrimination is quite blatant. Folks with a date of March 2004 should be automatically considered EB2 based on five year experience. This is not just for EB3-I or EB2-I but for all chargeabilities.
That will require a change of law. Current law is based on qualification for the job, not that of candidate filling that job. If I am a PhD, but an employer needs a tool cleaner, which I am willing to accept, I'll be sponsored for whatever category the tool cleaner position falls in.
If someone has gained 5 yrs experience waiting for on EB3, and wants to move to EB2, he/she will need to look for a job/sponsorship which requires 5 yrs experience. It is that simple. Lot of people do that...and retain their original PD. Isn't it a nice thing?

We have a few people making their way to USCIS - so we should know in sometime.
Actually when I say a few, there are probably only 3 or 4. Even after working the phones, emails and private messages, we could not get too many DC area members to help out.
If I have one regret for this campaign it is that I should have booked my flight tickets to DC - it would have been just so exciting to have such a good opportunity to voice our issues and concerns.
